ROLL CALL: Ted Holz, Chairman, Present Harry Reid, Present Louise Poole, Present Richard Kessler, Present Al Girda, Present CITY OFFICIALS: Bob Powell, Land Development Coordinator Jacqueline Koch, Director of Administration APPROVAL OF MINUTES OF April 5. 1986: Kessler moved to approve the minutes of April 5, 1986. Seconded by Reid. Vote: All Aye. Motion Carried. Request of Howard Bowen for Special Exception to Section 44.3 (2) for Approval of Construction of an Accessory Building Within the Required 35ft. Rear Setback in Zone R-lAA (22 Morton Lane). Powell gave his presentation. Mr. Bowen desires to locate a 20' X30' building with a 10' X 20' concrete apron next to it within the rear setback.. The building is somewhat done, so he has come in now to make amends and to go through the proper procedures. Kessler asked Bowen about the structure on the west side of his property, if it was in the setback also. Bowen stated that it was and stated it was built ~ years ago. Poole asked if Bowen had obtained a building permit to construct this new structure. Bowen stated that no he hadn't, that it was built while he was out of town. Kessler stated that it was brought up at the last Commission Meeting and that the Commission had approved the vacation of an easement within the setback area. Poole asked when was he aware that he needed a Special Exception. Bowen stated that he received news of this while he was out of town. Koch stated that the Building Official and Building Inspector had tagged the building, for lack of a permit. She stated that she had told Mr. Bowen that he needed two approvals: one from the City Commission no approve the vacation of the easement and one from the Board of Adjustment to approve the setback exception. There was a discussion about the vacation of the easement and the setback. Holz asked if there was anyone present who was for the Special Exception. Gary Cooley spoke in favor of the Special Exception. Holz asked if there was anyone present who was against the Special Exception. Billy McNair spoke against the Special Exception. Poole stated that this Special Exception comes after the fact, that the building is already constructed and that this situati.on may not have happened if the applicant had taken the proper procedures to construct the building. There was also a discussion about the vehicles @eing stored on the property. It was determined that no company vehicles were being stored on the property. Bowen stated that his mother lives in a building on the property, and that no construction vehicles are stored there. Bowen stated that this building was strictly to be used to store antique cars. . Kessler made the motion to approve the Special Exception as applied by the applicant. Seconded by Reid. Vote: Girda: nay; Kessler: aye; Poole: nay; Reid: aye; Holz: nay. Motion d1sapproved. Special Exception denied. Request of Frank Bracco for Special Exception to Section 44.33 (2) Requirement for 25ft. Rear Setback in Zone Rl-A, to Permit Construction of an Addition as Close as 18ft. to the Rear Property Line on Lot 30, Bolck D, North Orlando Ranches Section 2A (648 Dolphin Road) Powell gave his presentation. Bracco is requesting to construct an~addition as close as 18ft, to the rear property line. Frank Bracco stated that he would like to construct an addition as he needs the extra room for his family. Reid asked if this would be a single story structure. Bracco stated yes. There was some discussion on whether an additional air conditioner would be installed, in that there had been a problem disposing of the water from the current air conditioner last year. Holz asked if there was anyone present to speak for the Special Exception. There was no'one to speak for the exception. Holz asked if there was anyone present to speak against the Special Exception. Gail Skelton spoke in discussion. Robert Sizemore spoke against the Special Exception. There was a discussion on a previous drainage problem. It was determined that there was no longer a problem. Girda made the motion to accept the Special Exception as applied by the applicant. Seconded by Kessler. Vote: Reid: nay; Poole: aye; Kessler: aye; Girda: aye; Holz: nay. Motion carried.
