The meeting was called to order by Chairman Holz at 7:00 p.m.

APPROVAL OF MINUTES OF DECEMBER 5, 1985:
Poole moved to approve the minutes of December 5, 1985. Seconded by Kessler.
Vote: All Aye. Motion Carried.
Newlando, Inc. Request for Variance to Sectio~ 14-90 of the Land Development Code
to Allow Streets to End in Cul-De-Sacs With Paving less than 80 feet in Diameter
in Highland Village I, the Highlands P.U.D.
Koch stated that this project has been reviewed over a lengthy period of time. By
the City Code, cul-de-sacs should have 80 feet of paving; this was indicated in the
original plan that was approved by the City Commission for this development but the
correction was not implemented. It is nbw up to the Board to determine, based upon
this review and technical recommendations, whether or not after-the-fact this can
be allowed. This needs to be decided formally before the City can accept the streets
for public maintenance.
The main factor is whether the cul-de-sacs are adequate in an emergency; and in this
patticular case, the Fire Chief said that he has no problem with the smaller cul-de-
sacs. The City recommends the variance to approve the Kirkcaldy Drive cul-de-sacc
and the squared off cul-de-sac on Montrose Street be granted. The Staff does not
recommend the future one between TractA and Tract B. The fourth one, at the current
northern terminus of McGregar Road is only temporary.

Alex Halberstadt gave his presentation for the developer. He sBated that this design was
approved in April 1983, and the work was done in accordance with the approved drawings.
He stated that just recently he recieved a letter from City Engineer Kozlov that this
did not meet the City code. He also stated that in August 1984 the developer had
furnished the City with a maintenance bond and that the former City Engineer had ;v.e:rbally
approved the construction during the final inspection.
Halberstadt stated that this is a realistic situation, that there is no damage that
has been done and no one has been inconvenienced, and that the information that the
developer had received was that everything was done well, and that tlUs was reviewed
by the Commission, the City Enginee-r, and the City Planner.
Chairman Holz asked for a motion. Reid stated there isaneed for more discussion. It
was discussed that there would not be a problem with parking on the stceet . as the
Highlands Homeowners Association does not allow this and that this is strictly enforced.

Reid moved to accept the variance for the cul-de-sacs at the east end of Montrose Street
and the one on the southern portion of Kirkcaldy Drive, with the conditions that the
parking area be completed and that the landscape area in the right-of-way be kept clear
for emergency vehicles; and move to deny the variance of the far westerly future cul-
de-sac. Seconded by Poole. Vote: Girda: aye, Poole: aye, Reid: aye, Holz: aye,
Kessler: nay. Motion carried.
The meeting was adjourned at 8:21 p.m.
