"-"-, Amended Board of Adjustment Minutes Thursday, September 1, 1983 7 : 30 PM ~ The regular meeting of the Board of Adjustment was called to order by Chairman Holz. ROLL CALL: Ted Holz,Chairman,present Harry Reid,Vice-Chairman,present Louise Poole,absent Gil Artman,present Richard Kessler,present CITY OFFICIALS: Jacqueline Koch, City Planner The Pledge of Allegiance to the Flag led by Chairman Holz. APPROVAL OF MINUTES OF AUGUST 4, 1983 Kessler made motion minutes of August 4, 1983 be approved as submitted. Seconded by Reid. Vote: All ~e. Motion carried. CONTINUATION OF REQUEST OF MICHAEL AND ELAINE JONES FOR SPECIAL EXCEPTION TO CONSTRUCT QUADRUPLEXES AT DENSITY OF 17.4 UNITS PER ACRE WITH REDUCED REAR SETBACK AT 201 SOUTH MOSS ROAD (CONDITIONAL USE FOR MULTI-FAMILY DEVELOPMENT APPROVED AUGUST 4, 1983). ZONE C-2 Michael Jones came forward amending his request to two buildings with a total of ten units. Jones also stated with this plan the reduced setback was not required. Discussion. Artman made motion to amend the conditional use from 8 units to 10 units limited to two buildings. Seconded by Kessler. Vote: All aye. Motion carried. REQUEST OF TOM A. BINFORD, PROPERTY OWNER, AND JOE ABRAMS, APPLICANT, FOR VARIANCE TO SECTIONS 14-87 AND 14-88 OF THE CITY CODE, TO DEVELOP A MULTI-FAMILY SUBDIVISION ON AN UNPAVED STREET (NORTH MOSS ROAD NORTHEAST OF NORTH THIRD STREET). Koch gave presentation. Koch stated if this approval is granted, a provision is recommended by Koch and Director of Public Works that the developer be required to stabilize the portion of Moss Road from First Street to about 50' beyond their proposed street and to maintain it until such time as the road is paved. Also, the suggestion was made by Koch to advise prospective owners or tenants of the indefinite timetable on paving, to avoid disgruntled residents. Joe Abrams, 1030 Huntington Ct., Longwood, FL., came forward and was sworn in to make his presentation as the applicant. Tom Binford, 409 Sheoah Blvd., Winter Springs, came forward and was sworn in to make his presentation in favor of the applicant. Discussion. Reid made a motion to grant approval for variance subject to: 1) Developer maintaining the road, stabilizing same road to the satisfaction of the City Staff to the First Street paved portion; 2) Developer while in the construction phase utilizing same road from 434 to First Street for access with heavY equipment will also maintain this portion of the road or if the developer uses access from 419 that portion also will be maintained by the developer, otherwise the portion from 50' North of the entrance to the subdivision to First will be stabilized indefinitiely until the road is paved. Seconded by Kessler. Vote: All aye. Motion carried. REQUEST OF ELAINE WACK FOR CONDITIONAL USE IN ZONE C-l TO CONSTRUCT MULTI-FAMILY DWELLINGS ACCORDING TO R-3 STANDARDS, AND, IF GRANTED, FOR SPECIAL EXCEPTIONS FOR BUILDING HEIGHT OF 50 FEET (SECTION 44.45.4) FOR DENSITY OF 31.5 UNTIS PER ACRE (SECTION 44.45.5) AND FOR PROVISION OF ONLY 1.5 PARKING SPACES PER UNIT (SECTION 44.45.8), ON PROPERTY SOUTH OF SR 434 BETWEEN FAIRFAX AND MOSS ROAD. Vote: Reid, aye; Holz, nay; Artman, aye; Kessler, aye. Motion carried. Reid made motion to deny special exceptions of height 50', density of 31.5 units per acre, reduced parking spaces, reasons being not conducive to the area, burden on public services and creating a parking problem.
