The regular meeting of the Board of Adjustment was called to order by Chairman Weiss. The Pledge of Allegiance to the Flag was led by Harry Reid. ROLL CALL: CITY OFFICIALS: Jacqueline Koch, City Planner Ellen Weiss, Chairman, Louise Poole, present Ted Holz, present Harry Reid, present present Motion was made by Holz and seconded by Poole to approve the Minutes of April 7, 1983. Vote: all aye, motion carried. REQUEST OF MARONDA HOMES FOR SPECIAL EXCEPTION to construct a home on a corner lot with a 21.67 foot setback (rather than 25 feet) from one street right-of-w~ (Mocking Bird Lane) on Lot 1, Block 13, Ranches Section 10. Presentation by Ms. Koch. James Murphy, 3615 Palm Ave. Apopka, came forward and was sworn in. Discussion. There was no one present to speak for or against this request. Motion was made by Reid and seconded by Poole to approve the request of James Murphy (Maronda Homes) Vote: all aye, motion carried. REQUEST OF MICHAEL AND COLLEEN DePASQUALE FOR SPECIAL EXCEPTION to City Code section 44.29 to allow a home occupation in zone R-IA and to permit outdoor activity in connection with the home occupation (swimming lessons annually for six-week term) on Lot 17, Block B, Ranches Section 8, (616 Alton Road). Presentation by Ms. Koch during which see stated there is a possible home occupation although it is not a profit-making operation. otherwise involved is the use of the home for an activity that is not a customary accessory use. Also, this is an outdoor activity. There are two exceptions requested: (1) home occupation in zone RI-A; (2) outside activity. A letter in favor of this exception was presented to the Board. Review of letter. The City mailed certified letters to all adjacent property owners within 150' of the above-mentioned property (616 Alton Road). There were no written responses received until this date. Weiss requested this letter be entered into the minutes. Michael and Colleen DePasquale came forward and were sworn in. Mr. & Mrs DePasquale presented the swimming lessons as a service to the community rather than a home occupation, which has been requested by several neighbors who feel this is necessary because of the number of pools in their neighborhood. DePasquale's pool maintenance was the reason for the nominal fee of $15.00 for a two week session. Mrs. DePasquale stated she is a certified Red Cross Swimming Instructor. These classes are in accordance with and recognized by the Red Cross. Poole read the letter that was previously entered in the minutes. The following neighbors were present and testified in favor of the exception being granted: John Hotow, Sally McKuen,~Doreen Rulloff, Beau T~lor, Joe LaMonico, Sandra Bafoff, Linda Harvey, Linda Melvin, Walter Monter, Diane Brown. Mr. Don Workman, Safety Director Red Cross was present and testified to Mrs. DePasquale's qualifications and the fact she is in accordance with the Red Cross. Mr. Frank Bracht came forward and was sworn in. Mr. Bracht opposed the granting of the special exception, stating the character of the neighborhood is changed by allowing a business to be conducted in a residential area. Mr. Bracht, residing at 613 Pearl, is an adjacent property owner. Discussion. ". r-... ---, . ,Bom-d of Adjustment Minutes July 7, 1983 7:30 P.M. Page 2 Motion made by Reid and seconded by Holz that the Board consider swimming lessons be permitted without granting an exception. Vote: Reid, Aye; Holz, Aye; Poole, Nay; Weiss, Nay; Motion not carried. Motion made by Reid and seconded by Holz that the Board grant special exception and grant permission to continue the swimming lessons. Vote: Reid, Aye; Holz, Aye; Poole, Aye; Weiss, Nay; Motion carried. Discussion reference to the decision if this would be considered a home occupation. Motion made by Reid and seconded by Holz that this particular situation is not a home occupation. Vote ~ All aye . Motion carried. Ms. Koch advised the Board the City Attorney advised that this could be granted either as a permanent exception or for a specified amount of time. Motion was made by Poole and seconded by Holz that this would be a permanent exception for six weeks during every summer; Vote: Reid, Aye; Holz, Aye; Poole, Aye; Weiss, Nay. Motion carried.
