Meeting of the Board of Adjustment was called to order by Chairman Ellen Weiss. The Pledge of Allegiance was led by Ted Holz. ROLL CALL: CITY OFFICIALS: Ellen Weiss-Chairman, present Bill Jacobs-Vice Chairman, present Louise Poole, present Ted Holz, present Harry Reid, present (late) Jacqueline Koch, City Planner APPROVAL OF OCTOBER 13. 1982 MINUTES: Motion was made by Poole to approve the minutes of October 13, 1982. Second by Jacobs. Vote: Poole, aye, Weiss, aye, Jacobs, aye, Holz, aye. Motion carried. REQUEST OF MARY ELLEN FIEDELMAN FOR SPECIAL EXCEPTION TO SECTION 44.42 (2) TO CONSTRUCT AN ADDITION AS NEAR AS 23 FEET TO THE REAR PROPERTY LINE IN ZONE R-l AT 200 WEST PANAMA ROAD (FOXMOOR UNIT 2, BLOCK L, LOT 12). The City Planner stated the property in question is at the corner of Edgemon and Panama Road, a corner loct with the rear of the property facing north. It is currently zoned R-l. The request is to enclose the existing patio with a screen. The patio is2 feet within the rear setback. Mary Ellen Fiedelman of 200 W. Panama came forward and was sworn in by Chairman Weiss. MS. Fiedelman stated that basically she WaS requesting to enclose the existing patio, stating that she does not want to extend the patio in depth, but put a screen fixture around the existing patio and extend the patio in length'(along the house). Discussion. There was no one to speak for or against the request. Motion was made by Jacobs to approve the request of Mary Ellen Fiedelman as requested. Second by Reid. Vote. All aye, motion carried. REQUEST OF LAWRENCE E. ERICKSON FOR SPECIAL EXCEPTION TO SECTION 44.29 TO CONDUCT A HOME OCCUPATION (DRAFTING) IN ZONE R-lA AT 11 N. CORTEZ AVE. (LOT 11, BLOCK 24, NORTH ORLANDO 1ST ADD). The City Planner stated that the property in question is adjacent to the La Petite Nursery on N. Cortez. She went on to state that the request is to extend to zone R-1A a home occupation which under certain criteria is allowed in zone R-l. Discussion on general guidelines on home occupations. Reid asked the City Planner if this would be a change in the zoning. The Planner stated that the pratiee has been that the citizen has the right to request any exception to any zoning. Discussion. Mr. Lawrence E. Erickson of 11 N. Cortez was sworn in by Chairman Weiss. Mr. Erickson stated that his request is to have one room in the house used as his office, in the pro- fession of drafting. This room is approximately ~~ by 5, the smallest room in the house. Mr. Erickson stated there would be approximately 3 to 4 vehicles a week, traffic that would be stopping to pick up drawings, etc. Discussion on the length of Mr. Erickson's request. Mr. Clarence Grady of 20 N. Cortez was sworn in by Chairman Weiss. Mr. Grady was not for f I""-. ~ , ," Board of Adjustment Minutes December 2, 1982 Page 2 or against the request, but was concerned if this would increase traffic, for he was con- cerned about, the children in the neighborhood since he feels a problem already exists. Discussion. Mary Guthrie of 10 N. Cortez came forward and was sworn in by Chairman Weiss. She went on to state that she has no problem with Mr. Erickson's request, but wanted to know if this would change the zoning. The Chair stated no, if that was the case it would go before another Board. Mary Guthrie then inquired about the restrictions on this request as to future growth of Mr. Erickson's business. Discussion. The Board members then discussed Section 44.21, subsection 3, of the Code and decided to have the City Planner obtain an interpertation from the City Attorney. The matter of clientele parking was questioned by Poole. Discussion. Mr. Erickson stated he would inform his clients to pull into the driveway to park. Jacobs moved that the request of Lawrence C. Erickson be approved as submitted, providing that there are no complaints in reference to traffic. Discussion. Jacobs amended the motion to approve the request of Lawrence C. Erickson as submitted for the length of time being as long as Mr. Erickson owns his residence and provided there are no complaints in reference to traffic. Second by Holz. Discussion. The City Planner asked Jacobs to specify what he meant by complaints, (oral, written, to the Police Department, etc.) and at what point would this require Mr. Erickson to return to this Board for a review? Discussion. Jacobs amended the motion to read that the request of Lawrence C. Erickson be approved as submitted with the conditions if there are any formal complaints in reference to traffic problems this Board will reconsider the approval for the duration of the time Mr. Erickson owns his home. Second by Holz. Discussion. Vote. All aye, motion carried. Discussion among the Board on the oral notice of possible appeal within 30 days. It was then decided to have this formal notice placed on the application form. Chairman Weiss then adjourned the meeting. bmitted,
