REQUEST:
City Clerk reporting the results of the Tuscawilla Beautification
Assessmelltt District; City Manager requesting the Commission to
determine if the Commission desires to move forward with implementation
of the assessment district.
PURPOSE: The purpose of this agenda item is to inform the Commission of the
results of the Tuscawilla Beautification Assessment District and to request
direction rdative to the implementation of the district.
On January 12, 1998, the Commission authorized an advisory ballot to
provide the;: Commission with feed-back relative to the residents desire to
implement a Beautification Assessment District for improved lighting and
beautificatiton.
The votes were counted this morning by staff with results listed below:
Issue 1
Fifty (50) ballots were received that had been cut separating the parcel and
sequence numbers from the vote and certification statement.
The question arises as to whether these cut ballots should be included in the
vote. The inclusion of the cut ballots does not change the outcome of a simple
majority voting in favor of the district.
Since the Commission is not bound by the ballot, and the outcome is the same
relative to Ii single majority it appears that the Commission should accept both
votes as information,
Issue 2
As we understand it, the county's policy is that 65% of the persons voting
must vote ]In favor for the county to implement the district.
It is not known if the County Commission reserves the right to deviate
from this policy or not.
Therefore, it is rec:ommended that the ballot results be forwarded to the County
Commission for a formal declaration of its intent relative to implementation of the
district.

... A single developer with 73 parcels representing 8% of the votes cast voted all parcels against the question.
RECOMMENDATION:
1) The Commission review the results of the incorporated area ballot and provide the
staff with direction relative to implementation of the assessment district in the City of
Winter Springs,
2. The Commission direct the City Manager to provide the County Commission with
the results of the ballot and request the County Commission for a formal declaration
relative to its intel1lt to implement the district in the unincorporated area.
IMPLEMENTATION:
If the Commission decides to approve the assessment district the staff will
continue to implement the Task Schedule outlined by the Consultants,

Events
Draft a home rule ordinance that provides the City
with the flexibility to impose and collect the
assessments using the separate bill collection
method for FY 1998-9SI with subsequent transition
to the tax bill collection method for FY 1999-2000
Calculate final schedule of rates based on the
apportionment methodology and revenue
requirements for the improvement program
Draft necessary resolutions that conform to the
home rule ordinance which impose the
assessments and implement the City's policy
decisions and proposed methodology
Develop billing system necessary to implement
and bill the assessments and capable of
interfacing with City data processing capabilities
including billing algorithms
Conduct the final ratE! adoption process which
includes:
(a) meeting the legal rE~quirements for any public
hearings,
(b) The development of appropriate published
notice and/or printing, stuffing and mailing of any
notices or bills, and
(c) the development of a public information sheet
to be mailed with the bills or notices
Coordinating with appropriate finance officials
concerning the City's establishment of systems
and procedures for the City to collect and account
for the payment of the assessments
