REQUEST: Community Development Department, Land Development Division, requests Commission
approval of the Second Reading of Ordinance No. 700 vacating the southern seven and
one-half(7 1/2) feet of that fifteen (15) foot utility easement located to the rear of Lot 31,
Walden Terrace (555 Brookside Drive).
PURPOSE: The purpose of this Board Item is to have the Second Reading of Ordinance No, 700 to
vacate the southern seven and one-half(7 1/2) feet of that fifteen (15) foot utility easement
located to the rear of Lot 31, Walden Terrace (555 Brookside Drive). A swimming pool
and screen enclosure have been built into this portion of the easement.
FINDINGS:
1. The City Commission approved the First Reading of this proposed Ordinance No. 700
at their regular meeting of April 13, 1998.
2. The Public Notice for the Second Reading of Ordinance No. 700 was duly advertised
in the Orlando Sentinel for the scheduled meeting of April 27, 1998.
RECOMMENDATIONS:
It is recommended that the Commission approve the Second Reading and adoption of
Ordinance No. 700.

PURPOSE: The purpose of this Board Item is to have the First Reading of Ordinance No. 700 to vacate
the southern seven and one-half(7 1/2) feet of that fifteen (15) foot utility easement located
to the rear of Lot 31, Walden Terrace (555 Brookside Drive). A swimming pool and
screen enclosure have been built into this portion of the easement.
FINDINGS:
1) Walden Terrace was platted June 8, 1973.
2) A swimming pool permit was issued for this location February 14, 1984, but the utility
easement was not depicted on the drawing.
3) The subject property is under a sales contract and the easement must be vacated to get
a clear title.
4) The Public WorkslUtility Department, the City Engineer, and all concerned utility
companies have reviewed this request and have no objection to the vacation of a portion
of the easement.

CONCLUSION:
It is unclear why the City issued the permit for pool construction in 1984. Current
building department personnel were not employed in 1984. Currently all permit applications are
accompanied by a survey plat depicting all easements. If a survey plat is not available, the
building department checks the plat book to ensure that there are no easement
encroachments.
RECOMMENDATION:
It is recommended that the Commission approve the First Reading of Ordinance No. 700,
and at a later meeting approve the Second Reading and adoption of this ordinance.

request a resolution vacating and abandoning a certain portion of
the utility easement at the rear of the subject property, as de-
scribed in the attached copies of a survey and legal description
of said portion.

the following utility companies and interested parties:

BellSouth Telephone Company
Florida Public utilities
Winter Springs City Engineer
Said property is currently under Contract for Sale and Purchase
and it would be very much appreciated if this matter could be
expedited in any way possible in order that we may honor the

I am in rec:eipt of a letter from Bette McJunkin, dated March
11, 1998, and a letter from Patti D'Amour, dated March 10, 1998,
requesting an I~asement encroachment variance for an existing
swirmning pool and shed at the subject address. The plat shows a
15-foot wide utility easement on the rear lot line.
I have no objection to the variance request. It is my
understanding a building permit was issued in 1984, by the City, to
construct the existing pool in the easement. I have no record of
any complaints created by the pool encroachment.

ORDINANCE NO. 700
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA
V ACA TING, ABANDONING AND CLOSING THE SOUTHERN
SEVEN AND ONE-HALF (71/2) FEET OF THAT f4'U-IEEN (15) FOOT
UTILITY EASEMENT LOCATED TO TIlE REAR OF LOT 31, WALDEN
TERRACE, ACCORDING TO THE PLAT THEREOF AS RECORDED
IN PLAT BOOK 18 PAGE 69 OF THE PUBLIC RECORDS OF SEMINOLE
COUNTY, FLORIDA, PROVIDING FOR CONFLICTS, SEVERABllXfY
AND EFFEC11VE DATE.
WHEREAS, the City Commission of the City ofWmter Springs, Florida has determined
it to be in the best interest of its citizens to vacate the utility easement described herein;
WHEREAS, the City Commission of the City of Winter Springs finds and declares that
the herein described property is not longer needed for public purpose.
NOW, THERlCFORE, be it ordained by the City Commission of the City ofWmter
Springs, Florida as follows:
SECTION I: The City hereby vacates, aband.ons and closes the following descnbed
property:
THE SOUTHl:RN SEVEN AND ONE-HALF (71/2) FEET OF THAT
f4'UTEEN (15) FOOT UTILITY EASEMENT LOCATED TO THE
REAR OF LOT 31, WALDEN TERRACE~, ACCORDING TO THE PLAT
THEREOF AS: RECORDED IN PLAT BOOK 18 PAGE 69 OF THE PUBUC
RECORDS Ol~ SEMINOLE COUNTY, FI,ORIDA.
SECTION IT: That any portion of any City Ordinance in conflict herewith shall be hereby
repealed.
SECTION ill: _If any sentence, phrase or pOJ1ion of this ordinance is for any reason held
or declared to be unconstitutional or void, such holding shall not affect the remaining portions of
this ordinance.

SECTION IV:~ This Ordinance shall be effective upon its passage.
