PURPOSE: The purpose of this Board item is to request authorization for the execution of Amendment 58 for the Design of Master Systems for Stormwater Management, Water Distribution, Wastewater Collection and Wastewater Transmission for the Winter Springs Town Center with Conklin, Porter & Holmes Engineers, Inc. at a cost of $60,000. CONSIDERATIONS: This amendment is needed to develop master plans for the Town Center infrastructure so financial evaluations can be performed and preparation for the permitting process can begin. The infrastructure to be addressed includes a master stormwater management system, potable water distribution, wastewater collection and wastewater transmission. The scope of work includes the preparation of all analysis and calculations necessary to support subsequent permit applications to the St. Johns River Water Management District and Department: of Environmental Protection. All work will be performed based on the land planning of Dover, Kohl, and Partners Planning. Construction cost estimates of the backbone infrastructure including main streets will be developed for financial review. The scope of services is described in more detail in Section 3 of the Amendment. April 27, 1998 Consent Agenda Item C Page 2 FUNDING: The cost for Amendment 58 is $60,000. The source of funds would be the Stormwater Utility Reserves ($35,000) and Utility Enterprise Fund Reserves ($25,000). Funds would be expended in 90 days. RECOMMENDATION: It is recommended that authorization be given for the execution of Amendment 58 for the Design of Master Systems for Stormwater Management, Water Distribution, Wastewater Collection and Wastewater Transmission for the Winter Springs Town Center with Conklin, Porter & Holmes Engineers, Inc. at a cost of $60,000.00 payable from the Stormwater Utility Reserves ($35,000) and Utility Enterprise Fund Reserves ($25,000). This Amendment dated . , 1998, by and between the City of Winter Springs (hereinafter called the OWNER) and Conklin, Porter & Holmes. Engineers. Inc. (hereinafter called the Engineer), is mutually agreed upon and declared an authorized Amendment to an Agreement dated November 27, 1984, between the parlies, herein setting forth the scope, telms and conditions of the services herein authorized. The appropriate provisions of the November 27, 1984, Agreement, apply as fully as if repeated herein. Apr-20-98 03:33P P.03 SECTION 1 GENERAL 1.1 The purpose of this Amendment is to provide for Engineering Services. more specifically itemized herein, in the preparation of a Master Stormwater Plan, a Master Water Distribution Plan and a Master Sewerage Collection and Transmission System Plan for the Winter Springs Town Center anchored at the Tuscawil1a1S,R. 434 intersectkm. It is the intent to develop a master infrastructure plan for this area of approximately 230 acres. SECTION 2 BASIC SERVICES OF THE ENGINEER 2.1 GENERAL 2.1.1 The ENGINEER agrees to perform professional services in connection with the project as hereinafter stated. 2.1.2 The ENGINEER will serve as the OWNER's professional engineering representative in those phases of the project to which this Amendment applies, and will give consultation and advice to the OWNER during the perfonnance of his services. The ENGINEER will perform the services tor the City Conunission under the general supervisi<m of the City Manager, Community Development Director, and Utilities Director tUld will submit interim plans to them for their review, input, decision, etc. as appropriate. SECTION 3 SCOPE OF SERVICES 3.1 GENERAL The OWNER hereby authorizes the ENGINEER to proceed with the preparation of master stormwater, water and sewerage plans for the Winter Springs Town Center. 3.1.1 The Engineer's work product (the Water, Sewer, and Stonnwater Master Plans) will be based on the land planning perfonned by Dover, Kohl and Partners Planning and others on the planning team. Street layouts will be as shown in their planning Apr-ZO-9B 03:34P P.04 documenl;s and we will utilize the previous wetlands delineation prepared as part of their work and others'. 3.1.2 We will utilize the topographic maps which were previously prepared for the City. 3.1.3 A key element of the plans is to provide flexibility for development type, density and configuration, 3.1.4 We have provided time for three coordination meetings with the planners and the Cit y staff. 3.2 MASTER STORMWATER PLAN A Master Stormwater Plan for the development of the Winter Springs Town Center will be developed to both analyze the existing pre-development condition and the effect of development of the Town Center area. It is intended that the Master Stormwater Plan, and its attendant calculations and stormwater analysis be used to support a future application to the S1. Johns River Water Management District for an overall Individual permit for the Winter Springs Town Centerl and the subsequent permitting of individual development locations within the area covered by the overall individua,1 permit. The development analyzed under the Master Stormwater Plan would be: as shown on the overall Winter Springs Town Center Master Plan, to be developed by Dover, Kohl and Partners, Gibbs Planning Group, and Michael Design AssociatEls. Street and parcel development indicated on that plan would be used as the basis for the developed condition analysis under this work item. 3.2.1 Data Collection and Review The Engineer proposes to collect existing base mapping and stormwater analyses prepared for this area of Winter Springs and on-hand and available from the City, SeminolE: County, and adjacent cities, and the St. Johns River Water Management District. Specific items to be collected and reviewed under this work item include: a) City-provided aerial topography of the entire site. b) Slormwater basin studies by Seminole County, the City of Winter Springs, and the City of Casselberry for Gee Creek and Howell Creek, and the Lake Jc:ssup Basin. c) Wetlands delineations for the subject site already performed by others and available from the City and from the Water Management District. d) Existing overall wetlands mapping from the Water Management District. e) Drainage plans from the Florida Department of Transportation for State Road 434. Under this work item, the data collected would be reviewed relative this particular work arE:a, and maximum use be made, of previous analyses, including previously Apr-ZO-96 03:34P P.05 done stonnwater parameter delineations, wetlands delineations, directions of flow, etc., taken from existing data. 3,2.2 Meetings with the project Planners, the City, and others would be concluded to discuss b(lth the existing condition data and the projected land use plan. 3.2.3 A pre-development condition base map showing the pre-development condition, including topography, wetlands lines, existing structures identified in previous analyses, etc., would be prepared to be used as a basis for determining the pre- development condition run-off directions, amounts, and conditions. 3.2.4 Using thl~ pre-development condition base mapping, and previous analyses, pre- developm.ent condition parameters would be developed and input into an interconfil~ted pond routing model (ICPR) computer model for determination of pre- development condition run-off rates, points of discharge, water levels, etc. 3.2.5 A preliminary stonnwater collection system and detention and retention lake and pond locations would be developed based on the City of Winter Springs Town Center Master Plan by Dover, Kohl and others, speaking to the following issues: a) Plan would be developed to provide an infrastructure stormwater system with detention and retention ponds and lakes, external to the individual d'evelopment parcel. b) The overall intention is to provide future parcels for which stonnwater t~tcilities are either designed or in-place, so as to yield a parcel that, as far as S1.onnwater is concerned, is totally developable (i,e" a "net-net" development parcel), c) Stormwater plan would be developed so as to provide a plan that can be implemented in phases to accommodate as much flexibility in the overall development, as possible. It is understood that the intention is to provide a S1:ormwater system which, itselt: would be built in phases, to acconunodate an as-yet unknown schedule of specific development. d) Parcel coverage, percent impervious, nature of development of each individual parcel, etc., would be estimated from the Master Plan and from discussions with the City and their Planners. 3.2.6 The preliminary stormwater pond, pipe, and outtalllocation plan would be discussed with the City, the Planners, and others, to encourage their input into the overall drainage solution and to gain their understanding of the site's stormwater constraints. 3.2.7 Upon review of the preliminary stormwater plan, the Engineer would put that plan into a computer modeling format to analyze the effect of the development and hone in on required final pond sizing, outfall directions and flows, levels in proposed ponds, etc. Storm events chosen for the post-development analysis, as in the pre- development analysis, would be as required by the Water Management District Apr-20-98 03:34P P.06 criteria, as well as the criteria of the City of Winter Springs. 3.2.8 A set of cliteria for the construction of the stonnwater facilities would be developed to be used! by the City in providing to individual parcel developers, if the City should decide that the parcel developer would be required to put in that portion of the stormwater system. 3.2.9 The Engineer would prepare an Opinion of Probable Construction Costs for the improvemlents showing the improvement~ on a phased basis, with emphasis on major infrastructure going in first, to be followed by tributary systems to come in second. Both this item and the previous item would be developed in the fonnat to provide the City with as much flexibility as possible, but it is understood that the stormwater systems proposed will have an ultimate outfall to Lake Jessup and. thus. construction of the system may be dictated, somewhat, by existing topography and potential locations for stormwater facilities. Where terrain and locations dictate the scheduling of the pllln, these items would be made known to the City of Winter Springs, as potentiall;onstraints that would need to be included in the planning and development scheme. ).3 MASTER WATER DISTRIBUTION PLAN The Master Water Distribution Plan will be developed to provide service to meet demand emd fire flows for the area. . ),3.1 The wate:r system will be connected into the existing 12-inch water line on S.R, 434, In addition, a cormection will be required into the Tuscawilla service area to provide a.complete system loop with the existing water supply system. 3.3.2 The wate:r system will be analyzed using a computer model to determine pipe sizing. 3.3.3 Layout will be based on the street configuration provided by the planners. 3.3.4 The analysis will include investigation of the existing water main infrastructure and the required improvements to deliver adequate water supply and pressure to this location. 3.3.5 The analy sis will include a flexible phasing program to allow for changes in the type of development. 3.3.6 System looping will be a key element. 3.3.7 Fire hydrllnt placement will be coordinated with the Fire Department. 3.3.8 We will prepare an Opinion of Probable Construction Cost of the improvements itemized into the following categories: Apr-20-9B 03:35P P.07 a) b) c) d) Cmmection to the e")(isting inrrastructure~ Main line necessary improvements (trunk system); Cost per phase for the system to service the individual tracts; Other breakdown established during planning, 3.4 MASTER SEWAGE COLLECTION AND TRANSMISSION SYSTEM PLAN The Master Sewage Collection and Transmission System Plan will be developed to provide gravity sewer service to the area with minimum usage of lift stations. 3.4.1 Wastewater treatment will be provided by the East Water Reclamation Facility (WRF) and all fle,ws will be routed into the collection system of this facility. 3.4.2 System will be coordinated with the existing sewer system in Tuscawilla. 3.4.3 Layout will be based on the street configuration provided by the planners, 3.4.4 Analysis will include a determination of the main (trunk) system which will include a main gra'~ty sewer to the main lift station, the main lift station, and a force main to deliver sewage to the East WRF. 3.4.5 We will prepare an Opinion of Probable Construction Cost of the improvements itemized into the following categories; a) Li.ft station and force main; b) Main (trunk) collection system; c) Cost per phase for the system to service the individual tracts; d) Other breakdown established during planning. SECTION 4 SUP;PLEMENTARY SERVICES OF THE ENGINEER 4.1 If authorized in writing by the OWNER prior to the rendering of such services, the ENGTNEER will furnish or obtain under subcontracts, supplementary services of the following types which will be paid for by the OWNER as described in SECTION 6, Paragraph 6.1.2. 4.2.1 Additions.1 services due to significant changes in the scope of the project or its design including, but not limited to, changes in size, complexity, character of construction or due to time delays in initiating or completion of the work as described herein. Apr-ZO-9B 03:37P P.OB 4.2.2 Additional services in cOlU1ection with the project including services nonnally furnished by the OWNER as described in Section 5 herein and services not otherwise provided for in this Amendment. 4,2.3 Preparing to serve and serving as an expert witness for the OWNER in any protest, litigation, or other proceeding involving the project. 4.2.4 Additional engineering services required by revisions to regulations (after the date of this Amendment) as applicable to the Florida Department of Environmental Protecti()n, the St. Johns River Water Management District, or other regulatory agency requirements. 4.2.5 Provide, through 8 sub-consultant, surveying services if required or requested by the OWNER. 4.2.6 Provide, through a sub-CQnsultant, soils investigation services if required or requested by the OWNER. 4.2.7 Provide. through a sub-consultant, Environmental Scientist Services, if required or requested by the OWNER, SECTION 5 THE OWNER'S RESPONSIBILITIES 5.1 The OWNER will: 5,1,1 Advise the ENGINEER of his requirements for the project and designate a person to act as the OWNER's representative with respect to the work to be perfomled under this Amendment, and such person shaJl have complete authority to transmit instructictns, receive information, interpret and define the OWNER's policies and decisions pertinent to the work covered by this Amendment. 5.1.2 Guarantel~ access to and make aU provision for the ENGINEER to enter upon public and privelte lands as required for the ENGfNEER to perform his work under this Amendm ent. 5.1.3 Provide data requested that is reasonably available on the existing utility systems, population and projections, land use and planning information. 5.1.4 Provide personnel to locate facilities and mow, trim, or otherwise make them accessiblc~ for inspection. Obtain approval of all governmental authorities having jurisdiction over the project, and apprc1vals and consents from other individuals or bodies as may be necessary for completion of the Project. Furnish, or direct the ENGINEER in writing to provide at the OWNER's expense, soils investigations if advised in writing by the ENGINEER that they arc necessary or advisable. Furnish, or direct the ENGINEER in writing to provide at the OWNER's expense, necessary additional services as stipulated in Section 4 of this Amendment, or other services as required. Provide such legal, acwunting, and insurance counseling services as may be required for the project, and such auditing services as the OWNER may require. Give prompt written notice to the ENGfNEER whenever the OWNER observes or otherwis.~ becomes aware of any defect in the Project. SECTION 6 PAYMENT PAYMENT Payment:; for services and expenses of the ENGINEER to be as set forth below: 6.1.1 Compen:3ation paid ENOTNEER for services described herein and rendered by principa1:t and employees assigned to the Project shall be a Not- To-Exceed Fee of: a) Master Stonnwater Plan ... . . , . . . . . . . . . . . . , , . . . . . . . . . $35,000,00 b) Master Water Distribution Plan .......""..,......... $10,000.00 c) Master Sewer Collection Transmission Plan .............. $15,000.00 6.1.2 Expense:s for items not specifically valued herein are to ~e reimbursed to the ENGINEER at the actual cost thereof Said ex~nses shall include transportation and subsisten,ce of principals and employees, when traveling in connection with the Project, toll telephone calls, telegrams and similar project-related items. Such expenses are included in the lump sum fee described above. Apr-ZO-9B 03:41P P.10 6.1.3 The OWNER will make prompt monthly payments in response to ENOINEER's monthly :itatements without retention for all categories of services rendered under this Amendment and for reimbursable ex;penses incurred. 6.1.4 Charges for the services rendered by principals and employees as witnesses in any litigation, hearing or proceeding in accordance with Paragraph 4.1.4 will be computed at a rate of $800.00 per day or any portion thereof (but compensation for time spent in preparing to appear in any such litigation, hearing or proceeding will be computed in ac<:ordance with the funding levels as set forth in Paragraph 6.1.1 and 6.2.1 herein). 6.1.5 If this Amendment is tenninated during prosecution of the services prior to completion of the services of Section 3, payments to be made in accordance with Paragraph 6.1.1 on account of that and all prior work under this Amendment shall be due and payable, and shall constitute total payment for services rendered. In addition, upon tennination, the ENGINEER shall be paid for any Additional Services authorizE!d and rendered under Section 4. 6,1.6 The ENGINEER shall promptly begin work on the services authorized by this Amendment upon receipt of notice to proceed from the OWNER. SECTION 7 GENERAL CONDITIONS 7.1 Since the ENGINEER has no control over the cost oflabor, materials, or equipment, or over any construction contractor's method of determining prices, any opinion!\ of probable l;onstruction cost which may be provided in the services of this Amendment are mad<~ on the basis of his ex;perience and qualifications and represent his best judgement as a design professional familiar with the construction industry, but the ENGINEER cannot and does not guarantee that bids or the construction cost will not vary from opinions of probable cost prepared by him. 7.2 The OWNER and the ENGINEER each binds himself and his partners, successors, executonl, administrators and assigns to the other party of this Amendment and to partners, successors, executors, administrators, and assigns of the other party in respect t,o all covenants of this Amendment. Nothing herein shall be construed as creating any personal liability on the part of any officer or agency of any public body which may be a party hereto, nor shall it be construed as giving any rights or benefit~ hereunde1r to anyone other than the OWNER and the ENGINEER.
