HomeMy WebLinkAbout1981 08 27 Board of Adjustment Regular Minutes BOARD OF ADJUSTMENT CITY OF WINTER SPRINGS AUGUST 27, 1981 Meeting of the Board of Adjustment was called to order at 7:30 p.m. by Chairman Charles Chute. Chute led in the pledge of allegiance. ROLL CALL CITY OFFICIALS: Ellen Weiss, present Al Davis, absent Charles Chute, present Rick Andrase, absent Bill Jacobs, present Jacqueline Koch, City Planner The Chairman made mention of the letter received from the City Clerk regarding the appeal on the part of Mr. Hunt for Mr. Hattaway. He stated the hearing would be September 22nd. The Chairman will write a letter to the City Council and Mayor outlining the reasons for the Board's decision. Jacobs moved to approve the minutes of August 20, 1981. Seconded by Weiss. Vote: All aye. Motion carried. REQUEST OF FRANK CARTER FOR SPECIAL EXCEPTION TO LOCATE OUTDOOR ADVERTISING SIGNS WITHIN 500 FEET OF PROPERTY ZONED RESIDENTIAL AND LESS THAN 1000 FEET APART. (S.R. 419). The Chairman stated the property is adjoining R-T property, but there are no dwellings present at this time. The general location is on S.R. 419 which is across from Mohawk Village and the present zoning is C-l (where he proposes to place the signs). The City Planner pointed out the location. Mr. Frank Carter, Longwood, was sworn in and spoke for his request. Mr. Carter stated he is planning to sell space for advertising and does not intend to have any type of lighting on the signs. Jacobs questioned whether the advertising would be to promote development of his own property. Mr. Carter stated it would not. There was no one to speak for or against the request. The Chairman stated he felt it was within the Board's jurisdiction to grant the request with appropri- ate conditions and safeguards. He stated that in the event this area directly opposite is developed, then the signs must be removed since it is within 1000 feet of an R-T area. The City Planner stated if the exception is granted it should be only until building permits are issued for the R-T property across the road and that Mohawk Village should be included. There was discussion as to whether the Board should limit the content of the advertising. Jacobs moved to deny the request of Frank Carter for Special Exception to locate outdoor advertising signs within 500 feet of property zoned residential and less than 1000 feet apart. (S.R. 419). Seconded by Weiss. Weiss stated Mr. Carter was actually requesting 2 exceptions. Jacobs stated he felt the sign ordinance should be upheld as much as possible and that if the advertising was for his own property he could justify the request. Vote: Weiss, aye; Jacobs, aye; Chute, no. Motion carried. The Chairman notified the applicant of the appeal process. REQUEST OF T. D. OWENS, SPENCO, INC. FOR SPECIAL EXCEPTION TO CONSTRUCT AND OPERATE A MARINE CANVAS AND SPORTING GOODS MANUFACTURING BUSINESS IN ZONE C-2 ON OLD SANFORD-OVIEDO ROAD ON PART OF LOT 2. ENTZMINGER FARMS ADD. NO.2. The City Planner pointed out the location. Mr. T. D. Owens was sworn in and spoke for his request. The applicant stated he receives deliveries via common carrier as well as UPS. He has a l-ton van which he uses. Chute Board of Adjustment Meeting August 27, 1981 Page Two. questioned whether there would be any dangerous chemicals used. The applicant stated there would not be. Mr. Jon Zabel was sworn in and spoke for the applicant's request. He also presented a letter from Mr. James D. Hartman, contiguous propertyowner, speaking in favor of the request. Jacobs moved to approve the special exception by T. D. Owens as requested on his August 19, 1981 application. Seconded by Weiss. Vote: All aye. Motion carried. Jacobs moved to place Ordinance No. 249 on the agenda for discussion. Seconded by Weiss. Vote: All aye. Motion carried. Weiss stated she felt absences should be dealt with since Council has claimed that there must be no more than 2 unexcused absences. Following discussion, the Chairman stated he would write a letter to the Mayor and Council stating their objection of a 7-member Board, however if deemed necessary, the Board would prefer a 4-member quorum. If someone is not attending meetings as he/She should be, the Chairman will advise Council after warnings are issued to the particular member and request that person be removed from the Board. There was discussion on Section 44-19 of the Code. The Chairman stated if a member knows he/she will be absent he should call one of the following: The Chairman, the City Planner, the City Clerk, Recording Secretary, or as a last resort another member of the Board, and let that person know why you will not be able to attend. The Board will then vote at the meeting on whether the absence is excused and if a determination cannot be made at the meeting, it will be made at the next meeting in which the member who has requested the excuse is present. Mr. Jacobs had notified the Chairman prior to the August 20, 1981 meeting that he would not be able to attend, therefore Chute moved to excuse the absence of Bill Jacobs on August 20, 1981. Seconded by Weiss. Vote: All aye. Motion carried. In view of the fact Mr. Andrase's wife telephoned prior to the meeting to inform the Chairman Mr. Andrase was still in Vero Beach and would not be able to make the meeting, Weiss moved to excuse his absence. Seconded by Jacobs. Vote: All aye. Motion carried. The Board held off on voting on Mr. Davis' absence until the next meeting. Discussion.
