BOARD OF ADJUSTMENT MEETING
CITY OF WINTER SPRINGS, FLORIDA
JULY 23, 1981
The Board of Adjustment Meeting of the City of Winter Springs, Florida, was called to
order by Chairman Charles Chute. The pledge of allegiance to the flag was led by
Ric Andrase.

Motion waS made by Jacobs, seconded by Weiss to approve the minutes of July 16, 1981.
In discussion a correction to the minutes was noted on page 4, third paragraph from
the bott<:m1, "14.31" should read "14-3.1." Vote on motion: Weiss, aye; Davis, aye;
Jacobs, aye; Andrase, aye; Chute, aye; motion carried.
Continuation of request of Gary Hunt, Agent, for variance to create more than two
lots each from both of platted Lots 2 and 3, Block A, North Orlando Ranches Section
1, at northeast corner of Moss and Bahama Roads:
Mr. Gary Hunt and Mr. J. R. Hattaway were present to speak for the request. Mrs.
Hannah presented the Board with a letter from Mrs. Bush, 220 Bahama Road, against the
request. Mrs. Hannah spoke in discussion.
Motion was made by Andrase, seconded by Weiss, that we approve the split of the
property with the stipulation that no further divisions of this property be made.
Motion and second were withdrawn.
Motion was made by Andrase that we approve the split of the property in question
as requested by the applicant. Seconded by Weiss. Discussion. Vote on the motion:
Davis, no; Jacobs, no; Andrase, aye; Chute, no; Weiss, aye; motion failed.
Request of Edward Bolton for Special Exception to construct an addition extending
as near as 15 feet to the rear property line in Zone R-l at 623 Murphy Road.
Mrs. Bolton was sworn in by Chairman Chute. Mr. Ralph Nero, 208 Cottonwood, a
neighbor, was sworn in and spoke for the request. No one spoke against the request.
Motion was made by Jacobs that the request of Edward Bolton for Special Exception to
construct an addition extending as near as 15 feet to the rear property line in Zone
R-l at 623 Murphy Road be granted as submitted. Seconded by Davis. Discussion.
Vote on the motion: Jacobs, aye; Andrase, aye; Chute, aye; Weiss, aye; Davis, aye;
motion carried.
Request of Dr. Charles Martin for Special Exception to construct a commercial
building nearer than 30 feet to residential property and to construct a parking
area extending into the front setback on the northwest corner of S. R. 434 and
Algiers Ave.
Dr. Martin was sworn in by Chairman Chute. Mr. Krone, the architect, was sworn
in and introduced to the Board. Dr. Martin presented a petition to the Board signed
by the residents of Algiers Avenue, supporting the request of Dr. Martin. No one
spoke against the request.

Motion was made by Jacobs that the request of Dr. Charles Martin for Special
Exception to construct a commercial building nearer than 30 feet to adjacent
residential property be granted. Seconded by Davis. Discussion. Vote on the
motion: Andrase, aye; Chute, aye; Weiss, aye; Davis, aye; Jacobs, aye; motion
carried.
Motion was made by Jacobs that the special exception to construct parking lots
as submitted to the City July 22, 1981 be granted. Seconded by Weiss.
Motion was made by Davis to amend the motion to include that it would be
necessary that the four foot strip would be landscaped with a mound or low growing
plants. Seconded by Weiss. Vote on the amendment to the motion: Chute, aye;
Weiss, aye; Davis, aye; Jacobs, aye; Andrase, aye; motion carried.
Vote on main motion as amended: Weiss, aye; Davis, aye; Jacobs, aye; Andrase, aye;
Chute, aye; motion carried.
Request of Frank Carter for Special Exception to place outdoor advertising signs
within 500 feet of property zoned residential and less than 1000 feet apart, on
S. R. 419 across from Mohawk Village.
Mr. Carter had to leave the meeting, so this item was discussed last.
Request of Construction Enterprises of Central Florida and Florida Land Company for
Conditional Use to construct multi-family dwellings under R-3 specifications in
zone C-1 on part of Tract A of North Orlando Townsite (north of S.R. 434 between
, Fairfax and Moss).
Mr. Bob Schumaker, Construction Enterprises, was sworn in by Chairman Chute. Mr.
Schumaker said they propose to construct 16 quadraplexes (64 units).
Motion was made by Weiss that the request of Construction Enterprises of Central
Florida and Florida Land Company for conditional use to construct multi-family
dwellings under R-3 specifications in zone C-l on part of Tract A of North Orlando
Townsite (north of S.R. 434 between Fairfax and Moss) be approved with the stipulation
that a six foot wood fence be constructed behind both rows of dwellings. Seconded
by Jacobs. Discussion.
Motion was amended by Davis that it also be stipulated that the density of that area
be limited to 42 units. Amendment failed due to lack of a second.
In discussion, Mr. Davis stated for the record that he waS not in favor of the motion
without the stipulation limiting the number of units because he felt that the number
of units on that small parcel of property with the limited egress and exit that is
there will present future problems because of the existing development and the
potential of commercial development. It does not seem to be in the best interest of
the City to present this additional use of the property.
Vote on the motion: Jacobs, aye; Andrase, aye; Chute, aye; Weiss, aye; Davis, no;,
motion carried.
Request of Charles and Lynn Chavarie for Special Exception to construct a swimming
pool as near as five feet to each side property line in zone R-l at 426 Boxwood
Circle.
Mr. Chavarie was sworn in by Chairman Chute. No one spoke against the request.

Motion was made by Jacobs that the special exception be granted to build a swimming
pool as requested, not nearer than five feet from both side lot lines. Seconded by
Weiss. Discussion. Vote on the motion: Andrase, aye; Chute, aye; Weiss, aye; Davis,
aye; Jacobs, aye; motion carried.
On the request of Prank Carter for Special Exception to place outdoor advertising
signs within 500 feet of property zoned residential and less than 1000 feet apart,
on S.R. 419 across from Mohawk Village, the following motion was made:
Motion was made by Andrase to defer Mr. Carter's request until the August meeting.
Seconded by Jacobs. Discussion. Vote on the motion: Chute, aye; Weiss, aye; Davis,
no; Jacobs, aye; Andrase, aye; motion carried.
Meeting was adjourned 10:22 p. m.
