Following silent prayer, Davis led in the pledge of allegiance. ROLL CALL CITY OFFICIAlS: Richard Kessler, present Charles Chute, present Tom Binford, present Ellen Weiss, present Al Lavis, present Jacqueline Koch, City Planner. Kessler moved to approve the minutes of April 23, 1981. Seconded by Lavis. Vote: All aye. lVbtion carried. REQUEST OF EUGENE ROY TO CONSTRUCI' ADDITION TO CARPORl' TO E:xTEND TO NORI'H PROPERrY LmE OF LOr 16, BIDCK 3, NORI'H ORLANro SECOND ADDITION (81 soum EIXfElVDN) IN ZONE R-lA. The City Planner reported the request is to extend an addition on an existing carport. The property is located two lots up from the corner of South Edgem:m and Lombardy. The existing carport is 10 feet from the side lot line. The driveway is already there and in checking with the City Eng:i..r].eer he felt that in as nn.lch as the driveway is already there - the construction on the carport would not create any additional drainage problems. The City Planner reported that twelve property owners were notified and that no written cormnents or calls were received. Discussion. The applicant, Mr. Eugene Roy was sworn in and spoke for his request. The City Planner asked the applicant if the full 20 foot width was necessary and whether it would be possible to park two cars side by side with a lesser wid th and not use all of the side setback. The applicant expressed his desire to maintain his original request. Discussion. There was no one to speak for or against the request. The City Planner stated she is hesitant to assume there are no objections to the request simply because no cormnents were received. She also stated that one of the duties of the Board is to assure exceptions do not constitute a rezoning of the property. She stated a zero lot line concept would be created which else- where in the City is only allowed in R-3 and in condo~um qreas of Planned Unit ~veloprrents. The City Plarmer stated she I 'could no t reconmend approval of the total width, because it would be setting'a precedent in a single-family zone. The City Planner stated she felt some side setbacks should be maintained. She stated in view of the fact that the adj acent property owners could come up to within Th feet of the property - that would create very tight quarters in a zone which is intended to have 15 feet separation between structures. The Board generally agreed that approval of the above request would constitute a change in zoning and would set a precedent. The applicant stated his neighbor, Bo Smart, had no obj ections to his request and that he kntJw of other properties that had construction all the way to the lot line .
