Following silent prayer, Kessler led in the pledge of allegiance. roIL CALL Present: Absent : City Officials: Jacqueline Koch, City Planner Jack Cooper, City Engineer Tom Binford Richard Kessler Ellen Weiss Sonnie William, Resigned Al !:avis, Excused Kessler roved to approve the minutes of October 16, 1980. REQUEST FDR SPECIAL EXCEPTICN LIMITED TO STORAGE OF MOBILE HOMES, THE NUMBER OF WHICH IS YEr TO BE SPECIFlED, ON THE SITE OF TEE FUI'URE IDHAWK VILLAGE OF WIN'lER SPR:rnGS, PRIOR TO ITS FINAL APPROVAL AS A IDBILE HOME PARK, SAID REQUEST 'ID BE CONSIDERED UNDER THE POWERS OF DETERMINATION ProVIDED TO THE BOARD OF ADJUSTMENr BY SECTION 44.21 (1) b. Cha.innan Binford declared that he has filed a potential Conflict of Interest. The City Planner reported that the final engineering for the robile home park is still urrler review and that the developer is requesting an exception to store robile homes on the site prior to final approval of :rJbhawk Village. MI>. Chris Tanner, President of Winter Springs Mobile Home Corp., spoke for the request. Mr. Tanner stated they are applying for a special exception to take delivery of about 4 or 5 homes in the park. It could be about 40-50 homes before they have obtained final approval. Around 710 homes are planned (total buildout) . Preliminary approval has been obtained from the City of Winter Springs. Final approval of the engineering plans is pending. The City Planner reported the robile home park will be considered approved at such time as the City Manager determines that all of the criteria of Sections 44.70.7 and 44.70.8 have been met. Until the City Manager has determined that a viable robile home park exists, there will always be a special exception required to store a robile home on the property. Weiss asked the applicant what would be the greatest number of robile homes expected. Mr. Tanner reported around 50 by the end of January. There are 4 or 5 on order now ready to be shipped. Weiss questioned whether the robile homes 'Were to be lived in or s:1mply stored. '!he applicant said the robile homes were to be stored and tied down. There will be no occupancy till a "C. 0." is obtained. There was no one to speak for or against the applicant, however, there was a letter received from Florida land Co., dated October 21, 1980, an adjacent property owner, stating that they have no obj ection to the applicant's request. The City Planner reconmended that approval be given to store only those 5 robile homes which have already been ordered, but stressed that this should not -' Board of Adjustment, October 27, 1980 be taken as encouragement to order any further robile homes until after the property is developed. Binford reccmnerrled a stipulation be made on the t:lme l:1mit and the m:ininnmJ. number of mobile homes. Binford roved to approve the applicant's request with a maximum of 6 ronths for storage of the mobile homes with a mirrlnn.nn of 50 mobile homes unless the City M9nager deems it necessary to extend that to a greater rnmber. This special exception will be CDncluded upon approval of the final plat of the applicant. Motion died due to lack of a second. Discussion. The City Planner noted a hardship could exist for the people who have signed contracts for stored mobile homes if their lots should not be developed. Kessler asked if the property was cleared for 50 mobile homes. The applicant said that it was. He also asked whether they actually have 50 solid contracts. Mr>. Tanner said they have well over 50 contracts. Binford amended his motion to approve the applicant's request for a maximum t:lme stipulation of 3 months or January 31, 1981, to allow him to put up 50 robile homes - any number exceeding that nn.lSt be approved by the City Manager. Seconded by Weiss. Vote: Kessler, no; Weiss, aye; Binford, aye. Motion carried . REQUEST OF IDY E. LABOSSIERE, JR., ID PARK A IDW TRUCK ON RESIDENrIAL PROPERI'Y AT 7 NORIH EOOEMJN AVENUE ~tters have been sent to 11 adjacent property owners and no responses have been received. Someone identifying himself as the owner of the duplex where the applicant resides called and asked if the parking of tow trucks was allowed. He was infonned that they were not. Apparently this infonnation was not passed on to the applicant. He inquired as to who the City Attorney was and was also advised by the City Attorney that this was prohibited. The owner of the duplexes has sent a letter stating that he has no objection to the parking of the tow truck at the above residence. Mr>. Roy LaBrossiere, Jr., 7 North Edgemon Avenue spoke for the above request. He stated that the tow truck is the only transportation he has right not until his car is repaired. There was no one to speak for or against the applicant's request. The applicant reported that this ordinance is not enforced throughout the City. The City Planner questioned whether the applicant could walk to the lot by the Police Dept. to get his truck until his car is repaired. He mentioned there l'puld be t:lme lost in responding to a call and that he preferred to have it parked at his house. The City Planner recomnended disapproval of the. request and encouraged more stringent enforcement of the above ordinance, (44.81, 1., (a)). Binford stated he did not want to set precedent. - Board of Adjustment, October 27, 1980 The applicant reported there is another truck exceeding 314 of a ton (for personal use) remaining on residential property not contacted by the Police Iept. Kessler lIDVed to reconmend that the applicant be given 2 weeks to get his transportation problem rectified. Seconded by Weiss. Vote: Weiss, yes; Binford, no; Kessler; yes. lVbtion carried. Binford suggested the City Manager request the Police Iept. be lIDre stringent in the enforcement of this particular ordinance before the Board.
