BOARD OF .ADJUSTMENr CITY OF WINrER SPRINGS SEPTEMBER 18, 1980 Meeting of the Board of Adjustment was called to order at 7:30 p.m. by Chainnan Tom Binford. ROIL CAIL Present: Absent: City Officials: Tom Binford Richard Kessler Ellen Weiss Al Davis, late Chainnan Binford reported Sonnie William telephoned him and said she had been called out of town on business. Kessler roved to excuse Sonnie William's absence. Seconded by Weiss. Vote: All aye. Motion carried. Sonnie William, Excused . Jacqueline Koch, City Planner Kessler roved to approve the minutes of July 17, 1980. Seconded by Weiss. Vote: All aye. r.'btion carTied. REQUEST OF SUSAN BRIZARD FOR SPECIAL EXCEPTION 'ID SEarION 44.24 ( 27) 'ID OPERATE A BEAurY PARI.DR AS A HOME OCCUPATION rn ZONE R-l AT 424 SOUm: HAWIHORN CIRCLE. '!he City Planner stated that beauty parlors are not allowed in the above zone, however according to the City Attorney the Board of Adjustment does have to power to override this exclusion. She pointed out the existing home occupations in the adjacent area. 'Ihe applicant; Susan Brizard spoke for her request. Kessler questioned the number of customers at one time. Ms. Brizard said she could not take rore than 2 customers an hour. The hours will be from 9-5, 5 days a week, Tues.-Sat. Weiss questioned what type of equip- rent the applicant would have in the garage. Ms. Brizard stated she would have 2 dryers and a wet station. Weiss questioned overload of electricity. Ms. Brizard said there would be none, however she plans to contact the Hairdresser's Board and the Board of Health and plans to comply with the codes. She now has an enclosed garage with sliding glass doors. Weiss questioned if Ms. Brizard was requesting a permanent exception. She said yes. Davis reminded Ms. Brizard of restroom requirements. She stated the main reason she wants to stay in the Winter Springs area is that her clientele is here. Weiss asked if there had been any complaints reported to the Police Dept. or anyone speaking against the request. 'Ihe City Planner reported there had not. Pam Cullen, 422 S. Hawthorne spoke for the applicant. She reported their yard is well-kept and the applicant is neat and did not expect the above request to alter the outlook of the neighborhood. Eleanor Fall asked if Ms. Brizard would be the sole operator. 'Ihe appli- cant said that she would be. There was no one to speak against the applicant. Davis questioned parking area. The applicant stated she plans to widen the dr1 veway . There will probably be no evening work. ., Board of Adjustment September 18, 1980 Page Two. The City Planner reported that 11 residents had been notified by letter of this request. She recorrmended a 6 rronth limitation be given the applicant, giving her time to possibly find another location. Binford recommended a 6 rronth limitation as well as Weiss stating this would allow time to study traffic situation, etc. Weiss rroved to grant the request of Susan Brizard and that she be the only operator in her shop (garage). Kessler seconded. Discussion Weiss withdrew her rrotion, Kessler withdrew his second. Weiss rroved to grant a six rronth exception with Ms. Brizard as the only employee and that the driveway be widened to acconmodate no rrore than 4 cars at one t1me. Kessler seconded. Vote: Kessler; aye, Davis; 'MY; Weiss; aye, Binford; aye. Motion carried. Binford reminded the applicant that the approval could be revoked at anytime if problems arose and suggested she look for another location in the next six rronths. REQUEST OF RICHARD MILANO FOR EXTENSION OF SPECIAL EXCEPrION GRANIED FEBRUARY 21, 1980, 'ro KEEP ONE HORSE ON IESS THAN ONE ACRE IN ZONE R-lM (626 WILLIAMS ROAD). Mr>. James Milano, father of the applicant was present to speak for this request. Mr>. Milano reported they had spent considerable am:mnt of lOOney for fencing, fill, etc. The cost of the upkeep for the horse is approximately $40. OO/rronth as opposed to keeping the horse at a stable for approximately $125. OO/rronth. His grandchild is cUITently taking riding lessons. The applicant lacks 2/l0ths of an acre to carply with the code. A special exception was granted last February. There have been no complaints. Weiss questioned whether the applicant would be willing to put up a stable or barn. Mr. Milano said they planned to as soon as they got a decision from the Board. Kessler moved to grant a permanent exception contingent upon a 6 rronth limitation to construct a stable on or before Feb. 21, J98land that if the property should change hands the extension would cease.
