HomeMy WebLinkAbout1980 02 21 Board of Adjustment Regular Minutes ,*",~, -"",","",.- 4' BOARD OF ADJUSTMENT CITY OF WINTER SPRINGS FEBRUARY 21, 1980 The Board of Adjustment Meeting of the City of Winter Springs, Florida, was aa11ed to order by Maurice Brown at 7:33 p.m. The pledge of allegiance to the flag was led by Carrie Weaver. Ro 11 C a 11 : Maurice Brown, present Carrie Weaver, present Andrew Montvai, present Motion by Montvai, seconded by Weaver, to accept the minutes of January 10, 1980. Vote: All yes. Jacqueline Palmer, present Frank Bracht, Late REQUEST OF RICHARD MILANO for Special Exception to keep one horse on less than one acre in zone R-1AA (Williams Road). Mr. Milano spoke for the request. He showed the Board the Rea1tor1s Multiple Listing pointing out erroneously that horses were allowable. According to Mr. Milano none of his neighbors have complained, with the exception of one anonymous complaint. The City Planner pointed out that there is a six months limitation to the special exception at which time Mr. Milano may apply for one six month extension, the maximum time the exception may be granted. Bracht moved to grant the Special Exception to keep one horse on less than one acre in zone R-1AA (Williams Road), not to exceed the limi- tation of one horse. Palmer seconded. Vote: Brown, yes; Weaver, yes; Montvai, yes; Palmer, no; Bracht, yes. Motion carried. The Board requests the City Council look into the possibility of waiving the expiration date of the above request, to allow a permanent exception. REQUEST OF JAMES HATTAWAY for Conditional Use to build duplexes in zone C-l (North Edgemon and North Devon Avenues), and, dependent on approval of the conditional use, request for Special Exception to the side setback requirement for multi-family development. Mr. John Zabel, Silver Creek Dr., associate of Mr. Hattaway, spoke for the request to build two duplexes. Mr. Charles Shaw, 10 N. Devon Ave., spoke against the request and presented a petition from 22 homeowners protesting the above request. He commented that the Shop and Go which is directly behind his home is run down and that the same situation could occur with the duplexes with transients. Mr. Shaw cited that the property was originally Eoned for one home not two. The Board cited the types of uses presently allowable under C-1 zoning which would not require any notification to the residents. Mr. William Robinson and Carol Robinson, 20 N. Devon Ave. spoke against the request, citing the possibility of the duplexes becoming .....-... "- Bo~rd of Adjustment February 21, 1980 Page Two. ... an eyesore, and that they had no guarantee as to the outcome of the area if the request was approved. Weaver questioned the plans for the duplexes. Mr. Zabel reported the duplexes would be 2 bedroom, 1 bath, all-adult, probably in the neighborhood of $275-$300 a month rental units. There was discussion on the maintenance of the units. Mr. William Jacobs, 1204 S. Edgemon reinforced the zoning allowable under C-l. Mr. Richard Rozansky explained the Site Plan Review Board process to Mr. Robinson. Mr. Robinson questioned the adequacy of the Fire Dept. Mr. Rozansky replied that the Winter Springs Fire Dept. has a 5 rating and that no problems would exist responding to a fire with regards to the duplexes or Mrs. Robinson's home. Montvai moved to accept the request of James Hattaway for Conditional Use to build duplexes in zone C-1 (North Edgemon and North Devon Avenues), seconded by Bracht. Vote: Brown, no; Weaver, yes; Montvai, yes; Palmer, yes; Bracht, yes. Motion carried. The City Planner recommended disapproval of the special exception to the side setback, in order to maintain as great a buffer area as possible between the single family homes and the duplexes and between the duplexes and the commercial developments. Montvai moved to vote no on the Special Exception to the side setback requirement for multi-family developments and maintain the setback be set at ten feet. Bracht seconded. Vote: Palmer, yes; Bracht, yes; Brown, no; Weaver, yes; Montvai, yes. Motion carried. REQUEST FOR CONDITIONAL USE to build multi-family residential living units on land zoned C-2 (Old Sewer Plant on Moss Road) - Tom Binford. No one was present to speak for the request, therefore Bracht moved to table the request until someone would be present. Seconded by Brown. Vote: All yes. There was discussion as to why the resi- dents were not notified of the above request. The City Planner commented that the City Attorney reported it was not required in this case. Mr. Rozansky spoke on the notification and the use of the property. The date of the next meeting was set for March 13, 1980. There was discussion as to the process of notifying board members of meetings. Brown moved to adjourn, seconded by Bracht. Meeting adjourned at 9:00 p.m. ~."
