BOARD OF ADJUSTMENT MEETING
MAY 9, 1979
The Board of Adjustment Meeting was called to order by Chairman Jacqueline Palmer.
Roll Call:

Carrie Weaver, present

The minutes of March 28, 1979 were read by Chairman Palmer and accepted.
First order of Business, home occupation -Nelson B. Tullar, Custom reloading sporting
ammunition:
Carrie Iveaver read the letter from the City Planner. There is no Florida statute
precluding such an occupation in a residential area per City Attorney Stalnaker.
Chairman Palmer had Mr. Samiljan read Article IV, R1A and R1AA One Family ~welling
District to the Board and the audience due to the fact that two of the requests
were in the R1A and R1AA zoning. Mr. Tullar spoke to the Board and demonstrated
the non-explosiveness of gun powder. Mr. Samiljan asked how sensitive is the gun
powder to heat and Mr. Tullar said temperatures of 900 have not ignited it. The
powder is kept in original containers in a steel desk in his garage. Mr. Samiljan
asked where the primars are kept and they are also kept in the steel desk.
Mr. L. Boyle, 633 Pearl Road spoke against this request.
Mr. Bracht explained that Mr. Tullar will be loading for personal use. Chairman
Palmer said as a hobby this could be done, but granting an exception for a license
is the issue.
Mr. Joe Haros, 629 Pearl Road said there is no guarantee how large the business may
grow and did not feel any business should be allowed in the neighborhood.
Mr. Al Feldman, 627 Pearl Road, said the safety factor has been covered but he was
not convinced it was safe.
Mr. Bracht asked the Board members for comments.
Chairman Palmer said she felt the letters from the Police Chief and the Fire Chief
and the Attorney felt that with certain precautions, there was no problem as far as
their area of expertise.
Mr. Samiljan asked Mr. Tullar about his license. He is Class 06 dealer in Firearms
and ammunition.
Bracht asked for vote: Samiljan voted no; Bracht, no; Weaver, no; the Special
Exception was denied.
Next request for Special Exception - Judy rlaiuri, 270 Tradewinds Road, in RCl zoning
requesting to start a janitorial service and wanted to use her telephone. No one
would be coming to her home.
No one in the audience spoke for or against this request.
Chairman Palmer moved to gr2nt the special exception, seconded by Bracht. Board
voted unanimously to grant the Special Exception.

Mr. Sami1jan opened the meeting for the Special Exception for Mr. William B. Kent,
116 South Edgemon Avenue, zoned R1A, to park a 14 foot step van in his yard.
Section 44.81 was read to the Board and audience. Mr. Kent stated that he worked
for a potato chip company and that he had to bring the truck home as the Company
had no place to park the truck.
Chairman Palmer asked how long he had had the job and he had the job two months.
He has talked with his employer and if he cannot keep the truck he will lose his job.
Mr. Bob pacewood, S. E1derwood, said he has a similar problem. the police told him
to park in the area near the police station and $75.00 worth of material was stolen.
Mrs. K. Case, 123 Burgos Road said trucks are allover the streets.
Joy William, S. Edgemon, trucks are allover the streets.
Don Welch, S. Edgemon, doesn't like trucks on the streets.
Carrie Weaver, said where the truck is now is an eyesore but a person has to work
we must try to resolve this problem. Mr. Sami1jan said he knows it is a hardship
but the ordinance does prohibit it.
Weaver moved to grant the special exception for 90 days to allow Mr. Kent time to
solve the problem. Seconded by Bracht. Vote: Sami1jan, yes, Palmer, yes; Weaver,
aye; Bracht, aye.
Bracht moved to adjourn meeting at 9:35 p. m.
