REQUEST: The City Manager requesting City Commission adopt
Resolution 842.
PURPOSE: The purpose of this agenda item is to have the City Commission
adopt Resolution 842 supporting Seminole County School Board's
request for a special exception to construct a middle school and
elementary school on Econ River Place.
CONSIDERATIONS:
Commissioner Michael S. Blake is sponsoring Resolution 842.
The Seminole County School Board is appealing a decision from
the County's Board of Adjustment denying a special exception
to construct a middle school and elementary school on Econ River
Place.
The attached letter from Dianne L. Kramer, Executive Director of
Facilities for the Seminole County School Board, details the reasons
for the new schools. Ms. Kramer's letter also explains the School
Board's position for its request for approval of a special exception to
construct the new schools.
The Seminole County Board of County Commissioners has the
authority to approve Special Exceptions and overturn the action of
the Board of Adjustment.

RECOMMENDATIONS:
It is recommended that the City Commission adopt Resolution 842
and authorize the City Clerk to mail a copy to each member of the
Seminole County Board of County Commissioners.

A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA, IN
SUPPORT OF THE SEMINOLE COUNTY SCHOOL BOARD'S REQUEST
FOR A SPECIAL EXCEPTION TO CONSTRUCT A MIDDLE SCHOOL AND
ELEMENTARY SCHOOL ON ECON RIVER PLACE.
WHEREAS, Local Governments in Seminole County share a common interest in
maintaining an acceptable level of classroom space for the children of Seminole County and,
WHEREAS, the Seminole County School Board's request for a special exception to
construct a Middle School and Elementary School was denied by the Seminole County Board of
Adjustment and,
WHEREAS, the Seminole County School Board demonstrated that the proposed site on
Econ River Place was consistent with the County's general zoning plan and,
WHEREAS, the Seminole County School Board demonstrated that the new schools fulfil
an important public need and,
WHEREAS, the Seminole County School Board demonstrated that the new schools would
not be detrimental to the character of the neighborhood and,
WHEREAS, the Seminole County School Board demonstrated compliance with the public
schoollocational criteria in the County's land development code and the County's guidelines for
special exception.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA THAT:
The Winter Springs City Commission finds it to be in the public interest to construct a
Middle School and Elementary School on Econ River Place and encourages the Seminole County
Board of County Commissioners to accept County Staff's recommendation for approval of the
special exception.

Request for Special Exception
Construction of Schools in an M-IA zone
Honorable Commissioners:
On behalf of the Seminole County School Board, I appeal to yo~' to overturn the action of the
Board of Adjustment on February 26, 1998 in their denial of our request for a special exception to
construct a middle school and elementary school in an M-IA, Light Industrial zone. There was no
evidence presented to the Board in opposition to this request and staff recommended approval
with minor conditions that were consistent with our preliminary site plan. We demonstrated that
the proposed use was consistent with the general zoning plan and with the public interest and that
it was not detrimental to the character of the neighborhood Several aQjacent property owners
were even present to speak in support of the schoel construction.

After searching almost one year for an acceptable site, the School Board now has an option
contract to purchase thirty five acres on Econ River Place, west cf Alafaya Trail. This site'~an
house both an elementary and a middle school to relieve the current overcrowded conditions at
Jackson Heights Middle School and Lawton and Stenstrom Elementary Schools. The property
under consideration is currently zoned M-lA...and C-2. It.is'4ldjace.nt to the Iron Bridge Sewage
Treatment Plant and the Remington subdivisions. The other surrounding property is currently
vacant The schools are a demonstrated public need and the proposed location is compatible with
the current and furore land use in this area. Our contract for purchase includes a provision for' a
fifty foot easement across the property to the east of our site. This easement will be helpful in
realigning Carrigan A venue and providing a secondary vehicular and pedestrian access to the
school site.
I have attached additional information on the site demonstrating its compliance with the public
school locational criteria in your Land Development Code and the guidelines for special exception
approvals. Please feel free to call me if you have any questions or need additional information. We
of course would appreciate your scheduling this appeal hearing as soon as possible because we
need to have these schools open for school year 1999/00.

· 35 acres zoned M-IA, Very Light Industrial; with a small portion zoned C-2 Retail
Conunercial
· approximately one mile north of the Orange County line; Remington, Stillwater, and
parts of Carillon subdivisions within two miles of site cA Ql)j e-S
· access to site is not located in "close proximity to ... expressway inte~, arterial-
arterial intersections, or active railway crossing". ·
· "elementary schools shall be located within or adjacent to existing or planned
residential neighborhoods"* - site is immediately adjacent to Remington
· "elementary school shall not be located along arterial roadways"* - site is located on
a local road
· "Middle schools... shall have access to a collector or arterial roadway"* -- site has
two roads providing access to Alafaya Trail .
· "Middle schools... shall not be located immediately adjacent to single family
residences unless the site is of adequate size to provide additional setbacks"* - a 75
foot natural buffer will be maintained along the northern boundary of the site
· The M-IA district provides "very light, clean, industrial development... .of an
exceptionally clean, non-objectionable type and protected from encroachment of
smoke, fumes, vibration, or odors of any objectionable nature"* - that district is
compatible with the needs of a public school site
· A special exception must be "consistent with the general zoning plan". - the attached
zoning map indicates a mixture of surrounding land uses and zoning consistent with an
elementary and middle school use, including residential, low intensity commercial and
very light industrial
· A special exception must be consistent with "the public interest"* -- the residential
growth and development of the adjacent area and the entire southeast portion of the
county has generated the public need for additional educational facilities. It is in the
public interest to adequately house and educate its citizens. The excellent county
school system is a documented positive factor in the economic growth and
development of the County in that companies choose to locate in Seminole County
because of the school system.
· A special exception is "not detrimental to the character of the neighborhood"* - the
area to the east and south of the site is undeve!oped and thus has no defined character.
The area to the north is residential and the proposed school use is more compatible
than the M-IA permitted uses. A 75 foot natural buffer has been included in the
conditions of approval and the homeowners' association has expressed support for the
special exception.
