REQUEST: The Community Development Department, Land Development Division,
requesting Commission action on the recommendation of the Staff Review Board
that the Tuskawilla Trace (formerly Tuskawilla Road Site) final engineering be
approved with the stipulations stated in the attached Staff Review Minutes.
PURPOSE: The purpose of this Agenda Item is to forward to the City Commission the
recommendation of the Staff Review Board that the final engineering for
Tuskawilla Trace (formerly Tuskawilla Road Site) be approved with stipulations.
This proposed subdivision is located on the southwest corner of Tuskawilla Road
and Orange Avenue and is to have twenty-four (24) units.
APPLICABLE CODE:
Section 9-71. When final development plan is to be filed; extension.
(a) The final development plan including engineering and plat for all or a portion of
the area covered by the preliminary plan shall be submitted within one (1) year of
the date of approval of the preliminary plan; otherwise; such preliminary approval
will automatically become null and void unless the city commission grants a
specific extension of time.
Section 9-72. Processing of final plans.
Processing of final plans shall be as follows:
(1) City planner.

(2) City engineer.
(3) Staff review.
(4) Only if significant changes, alterations or modifications have been made to the
final plans which would cause to be construed at the time of staff review that a
substantial difference between the final and the preliminary plans now exists, plans
must then be sent to planning and zoning for further review. If no substantial
difference between the preliminary and final plans exists, this step in the process
will not be required.
(5) City commission.
Section 9-73. Form and contents of final development plan.
(a) The final development plan and plat shall conform substantially to the
approved preliminary plan as approved and shall include all conditional
requirements specified by the city commission on any conditional approval of the
preliminary plan.....
(b) Additional engineering/plans to accompany the final development plan/plat:
(1) Potable water including fire protection systems.
(2) Sanitary sewer.
(3) Drainage and stormwater management facilities including underdrains.
(4) Bulkheads.
(5) Excavation and fill.
(6) Sidewalks, bicycle paths, and bridle paths.

(7) Streets and curbs. Street grades and elevation shall be established to
minimize the need for underdrains. In soils where high groundwater is
found or suspected, cuts shall be minimized in order to reduce the need for
underdrains. Wherever along the proposed roadways projected
groundwater elevation is less than one (1) foot, six (6) inches below the
bottom of swale (or bottom of road base where curb and gutter is used),
underdrains shall be required.
(8) Soils explorations. The results of comprehensive soils explorations,
evaluations of results and recommendations by a city-approved soils
engineering and testing firm. The soils explorations work shall include as a
nummum:
a. Results of borings located by survey at suitable intervals along the
proposed roadways; classification and properties of soils encountered;
and groundwater elevation to United States Geological Survey datum
found subsequent to making the borings. The evaluation of the results
and recommendations by the soils firm shall include as a minimum:
Recommendations on the type of base construction; projected high-water
elevation to United States Geological Survey datum along the proposed
roadways, need, design, size, location, depth and details of underdrains;
and a recommendation on the elevation of street grades including depth
of cut. The results of the soils work, evaluation of results, and
recommendations shall be incorporated into the plans and specifications
submitted for review.
b. If during construction of improvements, the city determines in the
field that soils and/or groundwater conditions are found to be different
than shown in the data submitted with final development and engineering
plans, or there is question about adequacy of the approved plans caused
by conditions found in the field, the city shall have the right to require the
performance and submission of additional soils work and/or to require
modification of the previously approved design plans including, but not

limited to modification of street grades and/or installation of additional
underdrains, use of soil cement base course, or other modifications.
(9) Lot grading. At the time final engineering plans are submitted, lot
grading and drainage plans shall be submitted for review and approval.
The plans shall show minimum floor elevations for all homes, existing
topography, grading of all lots, and any drainage improvements proposed
or required on the lots. The lot grading and drainage plans shall show the
lot lines, existing topography (one-foot contour intervals), and proposed
lot filling, grading and drainage at a scale of one (1) inch is equal to one
hundred (100) feet (or larger) in general accordance with FHA standards
for lot grading. Substantiating soil borings, evaluations and studies shall
also be submitted to document soil conditions, projected high-water
groundwater elevation on the lots, and adequacy of the lot grading and
drainage plans.
(10) Street lighting plan, demonstration power company participation.
(11) Landscaping plans. Where site is commercial, industrial, or
multifamily in nature, landscaping plans shall be presented along with the
final development plans, unless specifically waived by the staff at the time
of processing the preliminary plan.
Section 9-74. Action on final development plan; expiration of approval.
( a) If the developer elects to request approval of a final development plan
separately and prior to approval to record the plat of that development, the city
commission may approve such final development plan if the plan is in substantial
conformity with the approved preliminary plan or a subsequently approved
modification to the preliminary plan. The final development plan may be approved
if it complies with all relevant regulations included in this chapter. Approval of the
plan shall be subject to fulfillment of all conditions specified by the city staff and
sanctioned by the city commission. Action to approve a final development plan

shall be taken by the city commission within thirty (30) days after receipt by the
city of the complete plan with all suppo~ing data required by this chapter.
CHRONOLOGY:
September.22, 1997 - City Commission approved Preliminary Engineering
September 23, 1997 - Final Engineering Plans submitted to the City for review
December 23, 1997 - Staff Review
FINDINGS:
1. There are no significant changes, alteration or modifications made to the final
engineering plans. Therefore, further review by the planning and zoning board is
not required.
2. The final engineering conforms substantially to the approve preliminary
engmeenng.
3. The Staff has found this project to be in general compliance with Code
requirements.
4. The developer has chosen to request approval offinal engineering separately
and prior to approval to record the plat of this development and the City
Commission may approve the final engineering if the engineering is in substantial
conformity with the approved preliminary engineering.
5. The plans, as submitted, show a portion of the wall, namely three (3) columns
will exceed the eight (8) foot hight limitation for walls. The City Commission has
in the past granted exceptions to the eight (8) foot height limitation for walls.
Seville Chase and The Reserve at Tuscawilla were allowed to construct walls in
excess of eight (8) feet in height.

CONCLUSION:
The Staff has found this project to be in general compliance with applicable code
requirements.
RECOMMENDATION:
It is recommended that the City Commission approve the final engineering, with
the stipulations listed in the Staff Review Minutes and the attached Staff
comments. It is also recommended that the City Commission authorize the
column heights of the wall to be eleven and one half(11 1/2) feet in height and
two (2) sections of the wall to be nine (9) feet eight (8) inches in height. Further,
that the Commission allow the City Engineer approve the wall once the signed and
sealed plans are delivered.

Commissioner Blake asked about the 30' R-O-W south of the property. Mr. LeBlanc said there is
a 30' R-O- W south of the property and there has been talk of utilizing that 30' R -0- W as part of the
Rails to Trails if the realignment on the Schrimshier property is changed from the railway bed, to have
it go further to the east of the Schrimshier property; to make it more scenic and it wouldn't cut the
Schrimshier property in half. Commissioner Blake asked about the improvements to the R-O-W.
Charlie Madden, engineer, said there were some drainage improvements in the 30' R -0- W, but they
were removed.
Motion was made by Commissioner Conniff to approve agenda Item G. eontingent upon tbose
items listed in tbe Staff comments being addressed in tbe Final Engineering submittal.

9 of the Ci Code of Ordinances:

Kip Lockculf, Public WorkslUtility Director, stated that this is a culmination ofthe update to the
TraIIic Circulation Element of the Camp. Plan. We took a lot of Capital Improvements projects off
and the balance of the project had some significant lower costs which resulted in about a 40%
reduction in the Transportation Impact Fees for commercial and residential properties.
Mr. Lockculfstated that Terry Zaudtke, from Conldin. porter & Holmes, is present and that he did
the traffic element update and is present to answer any questions.
Commissioner Blake asked about Table 3, Phase 4, regarding the lane miles. Mr. Zaudtke said they
used the total length of the area that is going to be improved as a lane mile calculation, rather than
the individual, because the whole road section gets improvement by adding the turn lanes, making it
effectively a three lane road so we used the entire length of that for the lane mile calculation.
Commissioner Blake asked how does that fall down into the cost calculation, and asked if the cost
calculation based on the total lane mile number, and said that would tend to over state that. Mr.
Zaudtke said if we decreased the amount of lane miles then the cost per lane mile would go up.

Tuskawilla Trace, Final Engineering
The Staff Review Board met on December 23, 1997 to consider the final engineering of
Tuskawilla Trace. R. Spano and C. Madden represented the project. Staff members present were
Carrington, Grimms, Houck, Jenkins, Lallathin, LeBlanc, Lockcuff and Tolleson.
This project consists of 24 single family lots in a gated community.
There are three (3) columns at the entryway which exceed ten (10) feet in height. They are eleven
and one half (II 1/2) feet in height and the Commission will have to approve this variance.
Tract "B" has not been annexed into the City. This tract, to be used for storm water management,
will be dedicated to the City and shall be annexed prior to the platting of the subdivision. Also,
the signage and landscape easements shown on the engineering plans are not large enough to
accommodate the wall, signage and landscaping. This easement will have to be larger and shall be
done at the time of platting the subdivision.
Please refer to the attached Staff comments.
Motion made by LeBlanc that the project be favorably forwarded to the City Commission
provided that the stipulations listed above and in the Staff comments be adhered to - seconded by
Grimms. All voted aye.

Tuskawilla Road Site aka Tuskawilla Trace
We have reviewed the final engineering for the Tuskawilla Road Site subdivision now called Tuskawilla
Trace which were signed and sealed October 29, 1997 and have the following comments:
1. This subdivision is not contiguous to an existing or planned reclaimed water main. A reclaimed
water distribution system is not required for this development.
2. No water and sewer capacity has been reserved for this project although capacity is available. Water
and sewer construction costs as specified in the Oversizing Agreement ($17,964 plus $374.25 interest =
$18,338.25) will be due prior to application to DEP for the water and sewer construction permit.
Connection fees (24 X $2,282/ERC = $54,768) will also be due at that time.
3. Arbor permits will be required for the site work and also for each lot. If some lot clearing is required
during site development due to muck removal or lot filling, a drawing depicting the scope of this work
will be required prior to issuance of the site work arbor permit.
4. Prior to the completion of the DEP water and sewer certifications and acceptance by the City, we
require one set of ~-bui1t mylars, two sets of prints, and a Bill of Sale containing a cost of
improvements and two. year warranty.
5. Any standard street signage required can be provided by the City at the Developer's expense. Please
notify us if you require standard street signs prior to as-built inspection.
We recommend final eneineering approval for this project with the aforementioned comments.

Dear Mr. Madden:
This paragraph appeared in my December 22, 1997 letter:
"My review indicates the wall is acceptable. The 11.5 foot
height of 3 columns will need to be approved by the City Co~mission
since City Code limits heights to 10 feet."
This is not correct. .The wall design is still acceptable for
meeting wind load requirements but Section 6-190, of the City Code
11m! ts wall heiohts to eiqht (8) feet. You wi 11 need a varianc~
from the City Commission on the sections of wall, and 3 columns,
that e:<ceed eight (8) feet. SEE ATTACHED ENTRANCE WALL DRAWING
I do not appose, from an engineering stand point, the design
heights that exceed eight (8) feet. We have walls in the City that
exceed eight (8) feet that were given a variance.

Dear Mr. Madden:
This paragraph appeared in my December 22, 1997 letter:
"My review indicates the wall is acceptable. The 11.5 foot
height of 3 columns will need to be approved by the City Co~mission
since City Code limits heights to 10 feet."
This is not correct. .The wall design is still acceptable for
meeting wind load requirements but Section 6-190, of the Citv Code
limits wall heiahts to eiaht (8) feet. You will need a varianc~
from the City Commission on the sections of wall, and 3 columns,
that e:<ceed eight (8) feet. SEE ATTACHED ENTRANCE WALL DRAWING
I do not appose, from an engineering stand point, the design
heights that exceed eight (8) feet. We have walls in the City that
exceed eight (8) feet that were given a variance.
