",,: ,,.' , e e ~ It MINUTES OF THE PUBLIC HEARING OF THE Board of Adjustment of City of Winter Springs, Florida A public hearing was he~d at 7:30 p.m. Wednesday, June 6, 1973, at the city hall with all three members in attendance. The meeting was called to order by the Chairman, Don Smith. He read the legal notice of the meeting concerning the special exception to a variance, requested by the Cumberland Farm Stores. Howard Marcy, representing the Cumberland Farm Stores, requested a special exception to the variance as the Zoning Classifications in the C-l list varied. He said he felt that Paragraph 18 was consistent with other uses of the C-l classification. e He declared that there would be three businesses involved, first the grocery or convenience store, and two other rental units. The building would be 3,250 sq. ft. Gas would never be sold. Parking would be one space for each 300 ft. (actually their alloted 17 spaces was one for each 191 sq. ft.). Drainage regulations would be met. The one sign would be free standing on the corner of Fairfax and ~34. The zoning code is C-l neighborhood and the convenience store would be consistent with these uses. . He went on to state that the objections included avoidin~ competition. In a survey there were 5,000 cars going by within a 2 mile radius and 6,000 to 10,000 cars daily within a 5 mile radius. The situation of the store is properly placed on the property. A previously filed petition against the building of said convenience store was shown to Mr. Marcy. ---.-.---, . --. "",,~,,;"'r1~\3~'~Z. e e . --~ 'YJ1f.p~ A-;- -- e e page 2 - public hearing Mrs. Albert Moore or 200 Fairfax, one of the closest neighbors, objected on the grounds of additional traffic, the garbage and refuse, teenagers and broken glass, all of which would bring down the value of the area, especially with three convenience stores in a row. Another objector was Vicki Baker, also of Fairfax Avenue, who stated she believed that any exceptions in tne C-1 classifications must be controlled by the city. She personally feels that the city government should establish a criteria within ordinances for stores, grocery and otherwise and should so be defined so that the Board of Adjustment doesn't have to meet and that the Zoning Board can declare it either C-1 or C-2. After the rebuttals were heard, the motion to deny the exception to the variance was made by Me1 Campbell and seconded by Mary Cook. The vote was unanimous. adjourned.
