Meeting
REQUEST: The Community Development Department, Building Division, requests the City
Commission approve the First Reading of Ordinance No. 692, adopting the current
State of Florida Minimum Building Codes, as the Building Construction Standards
for the City of Winter Springs.
PURPOSE: The purpose of this Board Item is to request the City Commission, approve the
First Reading of Ordinance No. 692 to adopt the amended State of Florida
Minimum Building Codes, as the Building Construction Standards for the City of
Winter Springs.
APPLICABLE LAW:
Florida Statute 553,73, State of Florida Rule 9B-3.047, and Section 6-81, City of
Winter Springs Code of Ordinances. The State of Florida has adopted the 1997
Standard Building Code, the 1997 Standard Mechanical Code, the 1997 Standard
Gas Code, and the 1995 One and Two Family Dwelling Code as the minimum
codes by which any structure is to be constructed.
FINDINGS:
Effective October 5, 1997, the State of Florida amended the State Minimum
Building Code to include the following:
· Standard Building Code, 1997 Edition
· Standard Mechanical Code, 1997 Edition
· Standard Gas Code, 1997 Edition; and
· The One and Two Family Dwelling Code, 1995 Edition

REcOMMENDA TIONS:
That the City Commission approve the First Reading of proposed Ordinance No. 692 as
the Building Construction Standards for the City of Winter Springs.
IMPLEMENTA TION SCHEDULE:
Ordinance No. 692, providing for the establishment of the Building Construction
Standards for the City of Winter Springs, will be implemented immediately upon approval
of the Second Reading of said ordinance scheduled for a later date.

9B-3.047 State Minimum Building Codes Adopted
9B-3.047 Minimum Build.iD.g Code Adopted.
(1) In order to authorize the use of the most recent advances in technology and materials
in building construction, the Board hereby adopts the following revisions and amendments to the
State Minimum Building Codes.
(a) Standard Codes, 1997 edition. ..
1. Standard Building Code, including the engineering design criteria contain~d in Section
1606 excluding Chapter 11, "Accessibility for People with Physical Disabilities", Section
2405.2.1.6 relating to safety glazing near swimming pools, and Appendix E, "Energy
Conservation". '..,
2. Standard Mechanical Code.
3. Standard Gas Code.
(b) South Florida Building Code (Dade County) 1994 edition.
(c) South Florida Building Code (Broward County) 1996 edition.
(d) EPCOT Code, 1996 edition.
(e) One and Two Family Dwelling Code 1995 edition excluding Section 308.4.9 relating
to safety glazing near swimming pools.
(t) Section 1606 of the Standard Building Code shall be the minimum wind load criteria
used for the design of all one and two family dwellings. Compliance with the engineering design
criteria contained in Section 1606 may be achieved by using the Southern Building Code
Congress International Inc., Standard SSTD 10-97 for Hurricane Resistant Residential
Construction, the Wood Products Promotion Council- High Wmd Project, Guide to Wood
Construction in High Wind Areas 1997 edition "the Builder's Guide", the Wood Frame
Construction Manual for One- and Two-Family Dwellings, 1995 High Wmd Edition, or the Guide
to Concrete Masonry Residential Construction in High Wmd Areas, the "Masonry Guide". The
Builders' Guide implementation shall be limited to the construction and design of wood frame
single story buildings with wind speed design parameters of 100 and 110 miles per hour. The
Manual is limited to a residential buildings of three stories or less, a mean roof height not
exceeding 33 feet and wind speed design parameters between 90 and 120 miles per ?our. The
Masonry Guide is limited to residential buildings of one story with a maximum height not
exceeding 25 feet and wind speed design parameters of90, 100, and 110 miles per hour (fastest
mile).

SECTION I - That section 6-61 Standard Building Code, Standard Existing Building Code. And Standard
Housing Code adopted 01 Article III. Building Construction Standards. is hereby deleted in its entirety and t"e lollowing
replaced therelor:

There is hereby adopted by the City the Standard Building Code - 1994 Edition. In ii's enllrety. excluding
Sect. 102.2.1. Chapter 11. and Appendix B & E: the Standard Existing Building Code - 1966 Edition: and the
Standard Housing Code -1991 Editlon, as promulgated by the Southern Building Code Congress Inlernatlonal.lnc.

(b) In addition to the requirements olthe Standard Building Code Chapter 10 Sec. 1004 - Footings and
Foundations, "In all masonry buildings there shall be a minimum 01 either two (2) one half (112) Inch or three (3)
three eighths (3/8) Inch steel rods in the foundation of same."

SECTION 111 - That Sec. 6-101 Electrical Code Adopted. 01 Article IV, Electricity Is hereby deleted
in its entirety and the following replaced therefor:

The City hereby adopts in Its entirety that certain electrical code known as the Nallonal Electrical Code,
1996 Edition as published by the National fire Protection Association and the Central Florida Advisol)' Committee
Notice UK" except as otherwise provided In this article.
SECTION IV - That a new section 6-103 of Article IV Electricity, is hereby created and adopted as
follows:
Sec. 6-103. Electrical Inspection. The building department lor the City shall make all Inspections, Issue
all permits and enforce all provisions of the Nallonal Electrical Code adopted In Sec. 6-101 wllhln the City.
SECTION V - That a new sec, 6-104 of Article IV Electricity Is hereby created and adopted as follows:

All applications lor electrical permits shall be accompanied by an appropriate electrical permit lee as
setlorth by the City Commission pursuanllo resolutions adopted under Ihe authority ~f this article which are on
file in the city clerks office.
SECTION VI - That Secs. 6-103---6-125 Reserved, of Article IV Electricity. Is hereby deleted In Its entirety
and the following replaced therefor:

SECTION VII - That Sec. 6-126. Plumbing Code adopted 01 Article V. Plumbing is hereby deleted
in its enlirety and the following replaced therefor:
Sec. 6-126 Plumbing code adopted. The city hereby adopts In its entirety that certain plumbing code
known as the Standard Plumbing Code -1994 Edition, excluding Appendix H, as promulgated by the Southern
Building Code Congress Inlernalional, Inc., except as otherWise provided In this article.

1996 Edition as published by the National Fire Protection Association and the Central Florida Advisory Committee
Notice "K" except as otherwise provided in this article.
SECTION IV - That a new section 6-103 01 Article IV Electricity. Is hereby ~reated and adopted as
follows:

SECTION XVII - Conlllcts, All ordinances or parts of ordinances In conlllct herewith being the same are
hereby repealed.
SECTION XVIII - Severability. II any section or ~rtion 01 a section or subsection 01 this Ordinance proves
to be invalid, unlawful or unconstitutional, it shall not be held to Invalldale or Impair the validity, lorce or effect of any
olher section or portion 01 section or subsection or part of this Ordinance,
SECTION XIX - Effective Dale. This Ordinance shall become ellectlve Immediately upon its passage
and adoption.

AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA, AMENDING
THE FOLLOWING SECTIONS OF CHAPTER 6, ARTICLE III. BUILDING
CONSTRUCTION STANDARDS, CODE OF ORDINANCES, CITY OF WINTER
SPRINGS, FLORIDA: AMENDING SECTION 6-81 STANDARD BUILDING
CODE, STANDARD EXISTING BUILDING CODE, AND STANDARD HOUSING
CODE ADOPTED; AMENDING ARTICLE VI. MECHANICAL CODE SECTION 6-
146 STANDARD MECHANICAL CODE ADOPTED; AMENDING ARTICLE X
GAS CODE SECTION 6-240 STANDARD GAS CODE ADOPTED; PROVIDING
FOR SEVERABILITY, CONFLICTS AND EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs, Florida has
determined that it is in the best interest of the City of Winter Springs, Florida, to update and
adopted the various standard codes relating to building, housing, mechanical, and gas and
WHEREAS, the adoption of these codes is done to comply with the State of Florida
adopted Minimum Building Codes and to facilitate proper inspection activities by the City of
Winter Springs relating to construction activities, the maintenance of buildings within the
corporation limits of said City and the public health and general welfare.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY
WINTER SPRINGS AS FOLLOWS:
Section I - That Sec. 6-81 Standard Building Code, Standard Existing Building Code,
and the Standard Housing Code adopted of Article III. Building Construction Standards, is
hereby deleted in its entirety and the following replaced therefor:
Sec.6-81 Standard Building Code, Standard Existing Building Code, Standard
Housing Code and One And Two Family Dwelling Code adopted.
The City hereby adopts in there entirety the Standard Building Code - 1997 Edition,
excluding Sec. 102.2.1, Sec. 2405.2.1.6, Chapter 11, and Appendices B & E; the Standard
Existing Building Code - 1988 Edition; and the Standard Housing Code - 1991 Edition, as
promulgated by the Southern Building Code Congress International, Inc. and the One And
Two Family Dwelling Code 1995 Edition excluding Section 308.4.9 as the minimum
standards for building and construction within the City. The provisions of these Standard
Codes shall govern all matters contained therein, except when in conflict with the provisions
of this chapter or other ordinances of the City.
Section II - That Sec. 6 - 146 Mechanical code adopted, is hereby deleted in its
entirety and the following replaced therefor:
Sec. 6-146 Standard Mechanical Code adopted.
The City hereby adopts in its entirety the Standard Mechanical Code - 1997 Edition
excluding Appendix B, as promulgated by the Southern Building Code Congress
International, Inc., except as otherwise provided in this article.
Section III - That Sec. 6 - 240 Code adopted. of Article X Gas Code is hereby deleted
in its entirety and the following replaced therefor:
Sec. 6 - 240. Standard Gas Code adopted.
The city hereby adopts in its entirety the Standard Gas Code - 1997 Edition excluding
Appendix B, as promulgated by the Southern Building Code Congress International Inc. ,
except as otherwise provided in this article.
Section IV- Conflicts . All ordinances or parts of ordinances in conflict herewith being
the same are hereby repealed.
Section V - Severability. If any section or portion of a section or subsection of this
Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to invalidate
or impair the validity, force or effect of any other section or portion of section or subsection or
part of this Ordinance.
Section VI - Effective Date. This Ordinance shall become effective immediately upon
its passage and adoption.
