REQUEST: Land Development Division, Community Development Department, requesting
Commission action on a request by Donald W. McIntosh, on behalf of Wagner
Station Planned Unit Development, to waive certain requirements of Section 9-157
of the Code that provides design/construction and inspection standards established
for private streets.
PURPOSE: The purpose of this Agenda Item is for Commission action on a request by
Donald W. McIntosh, on behalf of Wagner Station Planned Unit Development, to
waive the Code to allow sidewalks meandering in and out of the right-of-way, and
to have a specialty pavement on the entry road into the subdivision. Wagner
Station Planned Unit Development is located on the north side of State Road 434
directly across from Winding Hollow Boulevard.
APPLICABLE CODE:
Section 9-157. Private streets.
A private street as a principal means of access to individually owned lots shall be
prohibited unless appropriate deed restrictions are recorded and legally binding,
and permanent maintenance associations are formed. This requirement may not
apply to the provision of roadways within shopping centers, industrial or wholly
commercial districts, apartment projects or townhouse projects and other
developments under single ownership or commercial ownership, In such cases, the
owner shall be responsible for the construction, maintenance and control of such
private streets, Private streets shall meet design/construction and inspection
standards established for public streets unless waived by specific council action.

FINDINGS:
Section 9-157. Private streets. This section of the City code specifies, among
other things, that. . . "Private streets shall meet design/construction and inspection
standards established for public streets unless waived by specific council action."
The developer is proposing to construct sidewalks that meander outside the rights
of way of the proposed private streets to allow design flexibility. In addition, the
entry road will feature a specialty pavement.
Although code Section 9-157 permits the use of private streets, under certain
conditions, changes in design/construction/inspection standards must be approved
by the commission.
Staff has reviewed the request and has no objection to the change in construction
standards as described and as illustrated on the attached sketches.
RECOMMENDATION:
The recommendation is that the City Commission approve the request that the
developer for Wagner Station planned development be allowed to construct
private streets that do not meet design/construction/inspection standards as they
specifically relate to meandering sidewalks and specialty pavements at the entry
road.

Dear Mr. LeBlanc:
This letter is intended to serve ~.~e Wagner Station applicants fonnal written request for variance to
Winter Springs City Code 9-157 wherein private streets are required to meet City Code in all respects.

As you know, in an effort to create a unique and well planned community at Wagner Station, the
applicant has proposed sidewalks meander outside proposed right-of-way on the proposed private
streets, to allow for optimum aesthetic and flexibility in the PO landscape design.
Please note that otherwise the project meets or exceed City Code for roadway and right-of-way
standards.
In order to bring th6-quality of the Wagner Station property envisioned by all those involved in its
creation, the variance is hereby respectfully requested.
I have enclosed copies of color landscape schematics to provide a vision of the character the variance
will help retain and will be prepared to address Council on the matter as and when directed.
