REQUEST: The Community Development Department - Planning Division requests the City
Commission hold a public hearing to consider whether to transmit the large scale
comprehensive plan amendment (LG-CP A-2-97) to Florida Department of
Community Affairs, that would add a vision statement and goals, objectives and
policies in the Comprehensive Plan.
PURPOSE:
The contents of the plan amendment are intended to add to the current text of the Land
Use Element in Volume 2 of2 the S.R. 434 Corridor Vision Plan Vision Statement, and
associated goals, objectives, and policies. The additional language to the text requires the
submission of a large scale comprehensive plan amendment to the Florida Department of
Community Affairs.
APPLICABLE LAW AND PUBLIC POLICY:
The provisions of 163.3167(11) F.S. which state "Each local government is encouraged to
articulate a vision of the future physical appearance and qualities of its community as a
component of its local comprehensive plan, The vision should be developed through a
collaborative planning process with meaningful public participation and shall be adopted
by the governing body of the jurisdiction."
The provisions of 163.3184(3)(a) F.S, which state: "Each local governing body shall
transmit the complete proposed comprehensive plan or plan amendment to the state land
planning agency, the appropriate regional planning council and water management district,
the department, and the Department of Transportation immediately following a public
hearing pursuant to subsection (15) as specified in the state land planning agency's
procedural rules. The local governing body shall also transmit a copy of the complete

proposed comprehensive plan or plan amendment to any other unit of local government or
government agency in the state that has filed a written request with the governing body for
the plan or plan amendment."
The provisions of 163.3184(15)(b) F.S. which state: "The local governing body shall hold
at least one advertised public hearing on the proposed comprehensive plan or plan
amendment as follows:
1. The first public hearing shall be held at the transmittal stage pursuant to
subsection (3). It shall be held on a weekday at least 7 days after the day
that the advertisement is published.
2. The second public hearing shall be held at the adoption stage pursuant to
subsection (7). It shall be held on a weekday at least 5 days after the day
that the second advertisement is published."
The provisions of9J-11.006(1) F.A.c. which state "Each proposed amendment including
applicable supporting documents which include data and analyses shall be submitted
directly to the Florida Department of Community Affairs, Division of Resource Planning
and Management, Plan Processing Team, the appropriate regional planning council, water
management district(s), Department of Transportation and Department of Environmental
Protection. Proposed plan amendments, except those discussed under the exemption
provisions of Rule 9J-l1.006(1)(a)7. F.A.C., shall be consolidated into a single submission
for each of the two plan amendments adoption times during the calendar year. The
comprehensive plan submitted pursuant to Section 163.3167 F.S., shall be counted as one
of the two plan amendment adoption times during the calendar year; however, only the
submittal requirements of Rule 9J-11.004 F.A.C. must be followed,"
CHRONOLOGY:

The S.R. 434 Corridor Vision Plan Visioning Workshop was held on May 20,
1995 with representatives of the City Commission, Planning & Zoning Board,
other boards, and the public in attendance. At the workshop there was agreement
on the need for the corridor to be divided into three (3) areas. A graphic depiction
of the three subareas of the S.R. 434 Corridor was presented at the March 25,
1996 City Commission meeting showing the "Redevelopment Area", the "Town
Center", and the "New Development Area".

The City Commission held workshops on the "New Development Area" Overlay
District Regulations (Design Guidelines) of the State Road 434 Corridor Vision
Plan on December 9, 1996, January 6 and 20, 1997. Additional workshops were
held on February 4th, March 3rd, and April 21st, 1997.

The collaborative planning process had been established involving the City
Commission and the various boards, City staff, the City consultant, the property
owners along S.R. 434, the residents, and general public in the Visioning Seminar
and later development of the Design Guidelines for each of the three (3) districts of
the S.R. 434 Corridor.

All meetings were open to the public and publicly noticed according to the
requirements of286.011 F.S., and Sec. 4.13 of the City Code.
Berryman & Henigar and Wadley & Associates were paid together $ 20,224 to date for
work on the S.R. 434 Corridor Vision Plan.
No funds required to transmit the large scale comprehensive plan amendment to the
Florida Department of Community Affairs.

A number of changes have occurred since the preparation and adoption (on April
27, 1992) of the City's Comprehensive Plan, prompting the need for an update of
the Traffic Circulation Element.

City Commission hired Berryman & Henigar and Wadley & Associates to
prepare: the S.R. 434 Corridor Vision Plan involving a Visioning Seminar;
development of a Corridor Schematic; vision statement; goals, objectives and

RECOMMENDA TION:
The Local Planning Agency, at its November 19, 1997 meeting, voted to recommend that
the City Commission transmit the large scale comprehensive plan amendment
(LG-CP A-2-97) to the Florida Department of Community Affairs for its review and
comment.
Staff recommends that the Commission transmit to the Florida Department of Community
Affairs the large scale comprehensive plan amendment (LG-CP A-2-97), which would add
to the current text of the Land Use Element in Volume 2 of2 the S.R. 434 Corridor
Vision Plan Vision Statement, and associated goals, objectives, and policies, based on:
1. The findings indicated above;
2. The recommendation of the Local Planing Agency that the City Commission hold a
first (transmittal) public hearing and transmit to the Department of Community
Affairs the proposed large scale comprehensive plan amendment (LG-CPA-2-97).
IMPLEMENTATION:
The City Commission would hold a second public hearing within sixty (60) days to adopt
the amendment, or adopt the amendment with changes per 163.3184(7) F. S. Within forty-
five (45) days from adoption, the Department of Community Affairs publishes a "Notice
of Intent" to find the plan amendment in compliance or not in compliance per
163.3184(8)(b) F.S. An "affected person" may file a petition, which petition shall receive
a hearing by the Division of Administrative Hearings of the Florida Department of
Management Services.

The provisions of 163.3174(4) Florida Statutes which states "Be the agency (Local Planning
Agency) responsible for the preparation of the comprehensive plan or plan amendment and
shall make recommendations to the governing body regarding the adoption or amendment of
such plan. During the preparation of the plan or plan amendment and prior to any
recommendation to the governing body, the Local Planning Agency shall hold at least one
public hearing, with public notice, on proposed plan or plan amendment."
The provisions of Sec. 2-57 of the City Code which state in part", . . the planning and
zoning board shall serve as the local planning agency pursuant to the county comprehensive
planning act and the local government comprehensive planning act of the state. . ."

1. BACKGROUND:

REQUEST:
For the Local Planning Agency to review and recommend the requested changes to the
City's Comprehensive Plan Land Use Element Goals, Objectives and Policies
(Volume 2 of2).
PURPOSE:
The City Commission held a joint workshop with the Planning & Zoning BoardlLocal
Planning Agency concerning the Town Center and State Road 434. The Commission
directed staff to hire a consultant to prepare a S.R. 434 Corridor Vision Plan. The Plan was
to recommend ways to improve the corridor between U.S, 17/92 to Hayes Road, to ensure
that development that will occur along those presently undeveloped areas of the corridor is
done in a manner that emphasizes aesthetics, efficiency of land use, and economic benefit to
the City and its residents,
EXISTING CONDITIONS:
REDEVELOPMENT AREA: The area along State Road 434 between U.S. 17/92 and
Hayes Road is a commercial district that developed through the years without Land
Development Regulations that promote integrity of design and attention to aesthetic
considerations. As a result, this commercial district has experienced the problems of many
older commercial areas with loss of business brought on by lack of identity, visual clutter,
etc. This developed area is currently characterized by overhead utilities, lack of street trees
and landscaping, and excessive asphalt.
NEW DEVELOPMENT AREA: This area currently has a rural character with considerable
vacant land, scattered residences, and some environmentally sensitive areas, Traffic flow is
fairly unimpeded throughout this area. The recent widening to four (4) lanes of S.R. 434 as
a divided urban arterial has increased the ease of traffic flow which is fairly unimpeded
throughout this area.
TOWN CENTER: This area has extensive vacant land, part of which is a county enclave
near the intersection of S,R. 434 and Tuskawilla Road, but also includes the City Hall, the
59 acre Central Winds Community Park, the 'vVinter Springs High School and the U.S. Post

Office. The intent of the City is create a focus (as indicated in the Traffic Circulation
Element Objective A Policy 3c.) "of a primary civic, business and service focus for the
City. "

II. COMPREHENSIVE PLAN AMENDM"ENT ANALYSTS:
The following summarizes the data 'and issues which staff analyzed in reviewing this
application.
In discussions during the Visioning Workshop held on May 20, ] 995, it was decided that a
series of goals, objectives and policies for the three areas of the S,R. 434 Corridor would be
developed along with an overall vision statement. The consultant developed the vision
statement and the goals, objectives and policies from the results of the Visioning Workshop.
These statements were then reviewed and revised by the City staff and the S.R. 434
Property Owners Committee, and are presented below.
A. CHANGES TO VOLUME 1 OF 2 CITY OF WINTER SPRINGS
COMPREHENSIVE PLAN 1990-2010, THE LAND USE ELEMENT DATA,
INVENTORY & ANALYSIS.
NOTE: There are no new data and analysis that will replace or be added to the
existing data and analysis of the Land Use Element,
B. CHANGES TO VOLUME 2 OF 2 CITY OF WINTER SPRINGS
COMPREHENSIVE PLAN 1990-2010, THE LAND USE ELEMENT GOALS,
OBJECTIVES, AND POLICIES.
NOTE: The following Vision Statement, Goals, Objectives, and Policies will be in
addition to the existing Land Use Element Goals, Objectives and Policies
to form a separate section in the Land Use Element Volume 2 of2 and
begin on page 25,
S.R. 434 CORRIDOR VISION PLAN:
VISION STATEMENT:
Create and preserve a pleasant view while traveling along the corridor with the perception
being a "Green Image" characterized by canopy trees (existing and planted), planted or
natural landscape buffers, controlled sign age and site access, reasonable parking and
building setbacks and other site development standards.

Enhance the visual quality, promote design excellence, and build a
distinctive image to the S,R. 434 Corridor.
Provide a uniform basis to establish quality development along the
S.R. 434 Corridor through the development of Design Standards
and Guidelines that shall include all design elements necessary to
ensure the desired appearance for the S.R. 434 Corridor through
the City of Winter Springs,
Adopt Design Standards and Guidelines as part of the revised Land
Development Regulations of the City as required by 163.3202(3)
F.S., which would provide the basis for subsequent adoption and
implementation of recommended procedures and regulations.
While recognizing that S.R. 434 Corridor through the City of
Winter Springs is urbanizing, preserve and enhance the remaining
natural environmental features.
Review development proposals within the environmentally sensitive
areas of the S.R. 434 Corridor in accordance with Policies 1-8 of
Objective B and Policies 1-6 of Objective C in the Conservation
Element of the City's adopted Comprehensive Plan.

Work with the Florida Department of Transportation to install
"green" medians between V.S, 17-92 and S.R, 419. Median
openings shall be maximized to the greatest extent possible to
promote economic viability,

The manner of landscaping and the materials to be used for
roadway medians shall be consistent with an urban theme planting.

some measure of the existing diversity of character,
Adopt architectural design standards for the S.R. 434 Corridor
which are compatible with the surrounding area,
The Development Review Committee shall serve as the Corridor
Design Review Board for development in the S,R. 434 Corridor
and shall review such developments for a unifying theme according
to the architectural design standards and make recommendation to
the Planning and Zoning Board.
Review developments within the S,R. 434 Corridor for architectural
appropriateness based on the architectural design standards in the
S,R. 434 Corridor Overlay Districts contained in Chapter 20,
AI1icle VI,
The City shall not issue building permits for any proposed
development within the Corridor unless development proposals
have been reviewed by the Corridor Design Review Board for
recommendation to the Planning and Zoning Board.

Any requests for variances to the development standards of any of
the S.R, 434 Overlay Zoning Districts shall require review by the
Development Review Committee for recommendation to the Board
of Adjustment.
Develop standards for the facilitation of underground relocation of
utility lines, and relocation of street light standards and traffic
signals.
The City shall enter into negotiations with Florida Power
Corporation to develop an arrangement to place electrical Jines
underground along the S.R. 434 Corridor,
Improve the appearance of the S.R 434 Corridor gateways at
corporate boundaries to the City of Winter Springs with special
"entrance to the City" signage and associated landscape
arrangement,
Work with the City of Longwood to improve the major gateway
entrance to S,R. 434 at U.S, 17-92.
Corridor Function
Maximize traffic circulation functions of S,R. 434 through the City
of Winter Springs from the standpoint of safety, roadway capacity,
vehicular and nonvehicular movement.
Coordinate/cooperate with Florida Department of Transportation in
creating the most appropriate and desirable transportation design
standards and controls for S.R, 434 Corridor and S.R. 419,
Develop an Access Management Plan for the S.R, 434 Corridor
that will balance the goals of promoting economic viability and
protecting the carrying capacity of the roadway.
Require cross-access easements between adjacent commercial or
office properties,
Develop a system that utilizes various transpol1ation modes in the
S.R. 434 Corridor.
Sidewalks shall be provided along both sides of S,R. 434 ,

Provide an appropriately located nonmotorized multi-purpose trail
crossing point over S,R. 434 east ofS,R, 419 linking to the
proposed Cross Seminole Trail and Florida National Scenic Trail on
the north side of the corridor,
Property Values
To maintain and enhance the property values along the S,R, 434
Corridor through the City of Winter Springs.
Recognize that allowances must be made for existing uses,
committed uses, existing buildings, existing structures and existing
parcels that are unable to conform to new uniform design standards.
The City shall recognize the existence of non-conforming uses and
structures that existed prior to the adoption of the design standards
and goals, objectives and policies for the S,R, 434 Corridor Overlay
District.
Accommodate the ever changing market demands and needs of the
Corridor to the greatest extent possible,
The Planning and Zoning Board/Local Planning Agency shall
review the design standards and goals, objectives and policies of the
S.R. 434 Corridor Overlay Zoning Districts and make
recommendation to the City Commission for appropriate changes.
2. Redevelopment Area: The following Goals, Objectives and Policies apply to the
Redevelopment Area only:

Community Redevelopment Agency and establish Tax lncrement
Financing to support redevelopment activities, in accordance with
Objective C under Goall of the Land Use Element of the City's

The following Goals, Objectives and Policies apply to the Town
Center Area only:
Develop a Town Center that will become the identifying focus of
the City of Winter Springs.
The Town Center should be centered around the existing public
facilities of the City Hall, the new Winter Springs High School, the
Central Winds Community Park, and the Post Office.
Revise the Future Land Use Map to include those parcels indicated
in Objective 1.1 in the designation of "Public Buildings".
Include all the parcels indicated in Policy 1.1.1 as well as those

should be developed through a collaborative planning process with meaningful
public participation and shall be adopted by the governing body of the
jurisdiction. "

III. FINDINGS:

This City initiated comprehensive plan amendment addresses and furthers the

articulate a vision of the future physical appearance and qualities of its community as a
component of its local comprehensive plan. The vision should be developed through a
collaborative planning process with meaningful public participation and shall be
adopted by the governing body of the jurisdiction."

The S.R. 434 Corridor Vision Plan Visioning Workshop was held on May 20, 1995
with representatives of the City Commission, Planning & Zoning Board, other boards,
and the public in attendance. At the workshop there was agreement on the need for
the corridor to be divided into three (3) areas. A graphic depiction of the three
subareas of the S.R. 434 Corridor was presented at the March 25, 1996 City
Commission meeting showing the "Redevelopment Area", the "Town Center", and the
"New Development Area".

The City established a collaborative planning process with meaningful public
participation involving a Visioning Workshop, a series of Commission Workshops, and
presentations before the regular City Commission meetings, Such workshops and

IV. STAFF RECOMMENDATION:
Staff recommends the Local Planning Agency make the following recommendation to the
City Commission:
That the City Commission hold a first (transmittal) public hearing and transmit to the
Department of Community Affairs the proposed Large Scale Comprehensive Plan
Amendment (LG-CPA-2-97), to add to the City's Comprehensive Plan Land Use
Element Volume 2 of2 goals, objectives and policies derived from the S.R. 434
Corridor Vision Plan,
