REQUEST: The Community Development Department - Planning Division requests the City
Commission to approve the second reading and adoption of Ordinance 690
replacing Ordinance 670 which created a "New Development Area" Overlay
Zoning District.
PURPOSE: The purpose of this Board Item is to request the Commission approve the second
reading and adoption of Ordinance 690 replacing Ordinance 670 which created the
"New Development Area" Overlay Zoning District, that included the properties
adjacent to the State Road 434 right-of-way from Hayes Road eastward to State
Road 417 (aka the GreeneWay) with the exception of the Town Center area of
S.R. 434. Ordinance 690 deletes the Casscells' property (located on the north
side of State Road 434 and west of State Road 417) from the New Development
Overlay Zoning District.
APPLICABLE LAW AND PUBLIC POLICY:
The provisions of 163.3167(11) which states "Each local government is encouraged to
articulate a vision of the future physical appearance and qualities of its community as a
component of its local comprehensive plan. The vision should be developed through a
collaborative planning process with meaningful public participation and shall be adopted
by the governing body of the jurisdiction."
In 1995 the City Commission approved the preparation ofa S.R. 434 Corridor Vision Plan
that would include a "New Development Area".
Pursuant to 166.041(1)(c) "Ordinances initiated by other than the municipality that change
the actual zoning map designation of a parcel or parcels of land shall be enacted pursuant
to paragraph (a)."

*
The City Commission held the first reading of the Ordinance 670 on July 14, 1997.
*
In discussions with Mrs. CassceIIs and the City's consultant, it was determined that
the CassceIIs property should be removed from the New Development Overlay
Zoning District and placed in a separate district related to the beltway (the
GreeneWay).
*
This new district will necessitate a large scale comprehensive plan amendment to
the City's Comprehensive Plan.
*
The City Commission approved the first reading for adoption of Ordinance 690
replacing Ordinance 670 which created a "New Development Area" Overlay
Zoning District.
No funds are required for deletion of the Casscells property from the New Development
Area Overlay Zoning District.
*
The CasscelIs propeliy would be more appropriately developed if placed in a
district that is more oriented to the type of activity generated by a major highway,
such as the beltway (the GreeneWay) that intersects S.R. 434 on the eastern edge
of the City.
*
The City will realize a greater potential tax base in this separate highway
commercial oriented district (to be named GreeneWay Interchange District) than if
the property is developed within the New Development Overlay Zoning District.
RECOMMENDA TION:
Staff recommends adoption of Ordinance 690 to replace Ordinance 670 to delete the
CassceIIs' property from the New Development Overlay Zoning District.

IMPLEMENTATION SCHEDULE:
The City Commission would hold a second reading and public hearing to adopt Ordinance
690 on November 24, 1997. The ordinance would take effect immediately upon adoption.

AN ORDINANCE OF THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA
REPLACING ORDINANCE 670, WHICH CREATED A
NEW DEVELOPMENT AREA OVERLAY ZONING
DISTRICT IN ACCORDANCE WITH THE STATE
ROAD 434 CORRIDOR VISION PLAN, WITH A
(REVISED) NEW DEVELOPMENT OVERLAY ZONING
DISTRICT, WHICH EXCLUDES THE CASSCELLS
PROPERTY ON THE NORTH SIDE OF STATE ROAD
434 WEST OF STATE ROAD 417 (AKA THE
GREENEWAY) AS FURTHER DESCRIBED BELOW;
PROVIDING FOR SEVERABILITY AND AN
EFFECTIVE DATE.
WHEREAS, 163.3167 (11) , Florida Statutes, encourages local
governments to articulated a vision of the future physical
appearance and qualities of its community.

WHEREAS, the City, in accordance with 163.3167(11) F.S.
has developed a collaborative planning process with meaningful
public participation in the development of the outline of the
district and the design guidelines of the S.R. 434 Corridor
Vision Plan New Development Area Overlay Zoning District;
WHEREAS,
the Planning and Zoning Board/Local Planning
Agency has reviewed the district and design guidelines for the
New Development Area Overlay Zoning District and has
recommended to the City commission adoption of same;
NOW, THEREFORE, BE IT ORDAINED that the City
commission of the City of winter Springs, Florida, revises the
New Development Area Overlay Zoning District to include the
following properties:
ALL PROPERTIES (INVOLVING THE ENTIRE PARCEL)
LYING WITHIN THE CORPORATE LIMITS OF THE CITY
OF WINTER SPRINGS ADJACENT TO THE STATE ROAD
434 RIGHT-OF-WAY FROM HAYES ROAD EASTWARD TO
STATE ROAD 417 (AKA THE GREENEWAY) WITH THE
EXCEPTION OF THE TOWN CENTER OVERLAY ZONING
DISTRICT OF THE STATE ROAD 434 CORRIDOR VISION
PLAN, AND THE PROPERTY OWNED BY CASSCELLS AND
DESCRIBED AS FOLLOWS:

SECTION I
SEVERABILITY.
If any provision or portion of this Ordinance is declared
by any court of competent jurisdiction to be void,
unconstitutional, or unenforceable, then all remaining
provisions and portions of this Ordinance shall remain in full
force and effect.
SECTION II
EFFECTIVE DATE.
This Ordinance shall immediately take effect upon
adoption, with a quorum present and voting, by the City
commission of the City of Winter Springs, Florida, this
24th day of November, 1997.
