REQUEST: Public Works Department Recommending Tree Replantings and A
Monetary Fine for an Arbor Violation in Winding Hollow.
PURPOSE: The purpose of this Board item is to recommend to the City Commission that they
require D.R. Horton, Inc. to replant six trees and assess a $500.00 fine for
violating their arbor permit by removing a 24" cypress tree on Lot 255 in Winding
Hollow.
CONSIDERATIONS:
This board item is needed to fulfill the requirement of Section 5-5(b) of the Code
of Ordinances, 5-5(b), which states "...Any person violating the arboreal provisions set
forth herein shall be required to appear before the city commission which shall be
empowered to specify the number and types of trees to be replanted by the individual to
compensate the public for the loss of existing trees...". Section 5-5(a) provides for the
assessment of a fine up to $25,000 in addition to the replacement requirements.
D.R. Horton Inc. was granted Arbor Permit #97-661 on September 5, 1997 which
provided for the removal of trees on Lot 255 in Winding Hollow for a new home. A 24"
cypress tree was requested to be removed but the City Forester indicated on the plot plan
to not remove this tree. On October 9th the City Forester observed that the cypress tree
was being removed and coordinated with the Building Official to issue a Stop Work
Order for this lot to Mr. Richard Ladd ofD.R. Horton which is still in effect.

Findings:
· D.R. Horton obtained Arbor Pennit #97-661 for Lot 255 as required.
· The plot plan attached to the Arbor Pennit requested a cypress tree be removed
due to the proximity to the house. The City Forester at his site inspection
detennined that the cypress tree could be saved and marked "Don't Remove" on
the plot plan. No other notice was provided on the pennit.
· The cypress tree was approximately 24" DBH (Diameter Breast Height) and was a
large tree in good health but it was not of specimen quality.
· The cypress tree and stump were removed on October 9, 1997 by individuals
working for D.R. Horton, Inc. Mr. Richard Ladd ofDRH has stated that the
removal was not intentional and was due to not reading the notations on the plot
plan. The field superintendent stated that the tree was within 10' of the building
pad. The stump was removed before this could be verified.
· The building official issued a stop work order for Lot 255 on October 9, 1997
which remains in effect.
· Based on the aforementioned findings we feel a replacement equivalent to one
half the tree diameter plus a monetary fine is fair. Six 30 gallon trees is roughly
equal to 12" of equivalent diameter. Trees should be Florida #2 or better.
· Mr. Richard Ladd ofDRH was notified on October 15th via certified mail that the
recommendations for enforcement action would be made at the October 27th city
Commission meeting.

RECOMMENDATION:
It is recommended that the City Commission require D.R. Horton, Inc. to replant
three 30 gallon bald cypress within Winding Hollow and three 30 gallon live oaks at a
City park and also be assessed a $500.00 monetary fine pursuant to Section 5-5(a) of the
Arbor Ordinance for a violation of Penn it #97-661 that occurred October 9, 1997 on Lot
255 in Winding Hollow.
IMPLEMENTATION SCHEDULE:
The location of the tree replantings will be designated by city staff The stop
work order will be lifted upon City Commission approval of the enforcement action.
Certificate of Occupancy will be withheld until the enforcement requirements have been
fulfilled.

Sec. '5.5. Enforcement.
(a) Monetary fine for willful destruction. Any
person who willfully destroys a tree shall be as-
sessed a, fine of up to but not exceeding twenty.
five thousand dollars ($25,000.00). In assessing
the fine, the city shall consider, among other things, ,
the size, age, health, and number of trees dam-
. aged or removed. This fine shall be in addition to
the replacement requirements set forth in sub.
section (b) below. . .
(b) Reforestation. Any person violating any of
the arboreal provisions set forth herein shall be .
required to appear before 'the city commission which.
shall be empowered to specify the number and
types and sizes of trees to be replanted by the
individual to compensate the public for the loss'of
existing trees. The guidelines in subsection. (c)
below shall apply to reforestation of land illegally
cleared:
(c) Reforestation point standards:
(1) Mininium points required per acre. The
minimum number of tree points required
in each zoning category per acre. of land
(excluding areas dedicated for rights.of-\vay
fo'r streets) are as follows:

Dear Richard:
It has come to my attention that in the process of clearing lot 255 of \Vinding Hollow, a
specimen cypress tree that was not permitted to be removed per your arbor permit was
removed.
Until this situation can be resolved as to remedy, you are to halt any further clearing or
construction on said lot. Our Public Works Department will be in contact with you.
Any inquiries regarding this situation are to go. to either Richard Brookover or Kip
Lockuffat 327-2669.

Dear Mr. Ladd:
On October 9, 1997, a cypress tree was removed from Lot 255 in Winding Hollow which
was specifically identified as not to be removed on Arbor Permit #97-661. This is a
violation of Section 5-3(a)(2) of the City Code of Ordinances which regulates conditions
under which trees can be removed.
Please be advised that pursuant to Section 5-5(b), you or your authorized
' representative are required to appear before the City Commission. on October 27, 1997
for resolution of this matter. The Commission meetings begin at 6:30 P.M. and are
conducted at City Hall, 1126 East S.R. 434, Winter Springs.
The recommendations of staff to the City Commission at the October 27th meeting will
be for the replanting of three 30 gallon cypress trees in Winding Hollow, three 30 gallon
live oak trees at a City park, and a $500.00 (Five Hundred Dollar) fine. The final
determination of the extent of replanting and monetary fine rests solely with the City
Commission. Upon approval of the City Commission, the stop work order will be lifted.
