PURPOSE: The purpose of this Agenda Item is to request the Commission hold a public hearing and adopt Ordinance No. 674 using the format for occupational license taxes developed as a result of the 1995 Equity Study Commission's recommendations and to modify the tax rate schedule. APPLICABLE LAW: Florida Statutes 205.0535, Reclassification and Rate Structure Revisions. CONSIDERA TIONS: 1.) To have license classification schedule and tax rate schedule in same format. 2.) On July 24, 1995, the current tax rate schedule was revised by Resolution No. 762. The license classification schedule has remained the same since 1980 with the exception of the addition of "Mobile License" classification. August 25, 1997 AGENDA ITEM F Page 2 3.) Findings: a. Florida State Statute 205.0535. Reclassification and Rate Structure Revisions The 1995 Florida Statute required that reclassification and rate structure revisions made as a result of an equity study were to be made by ordinance. The City's were adopted by resolution. August 25, 1997 AGENDA ITEM F Page 3 FINDINGS: Passage of Ordinance No. 674 will satisfy the requirements of Florida law and will provide a more workable classification and tax schedule. RECOMMENDA TIONS: It is recommended that the City Commission approve Ordinance No. 674 as the official occupational license classification and tax schedule. An ordinance of the City of Winter Springs, Florida amending Section 10-29, of Chapter 10 Article II. Occupational License Taxes; providing for conflicts, severability, and effective date. Whereas, Chapter 10 of the Code of Ordinances of the City of Winter Springs, Florida provides for Occupational Licenses, and Whereas, the City Commission of Winter Springs has detennined it to be in the best interest of the City of Winter Springs to periodically revise the occupational license classifications in accordance with State Statute 205.0535, Now, therefore, be it ordained by the City Commission of the City of Winter Springs as follows: Section I . My notes reflect that the following issues were raised: 1. Businesses not specifically addressed: a. adult entertainment establishments b. scrub parlors c. liquor stores d. video rental stores 2. Solicitors. The issues were the amount of the license fee, the amount this fee could lawfully be raised by this amendment to the fee schedule, and the matter of the actual cost of the criminal background check. Regarding Item # 1 above, I recommend that we add liquor stores and video stores to the general category of MerchantlRetail and assess the fee based on the square footage or other category of measure justified in the equity study. Adult entertairunent establishments and scrub parlors present us with a different issue. I want to discuss this issue on Thursday morning with city development approval personnel regarding the extent to which such establislunents are allowed in the city and where. This is definitely my reconunendation regarding "scrub parlors" which are essentially undefined, and may turn out to be disallowed under state law or local ordinances. Regarding Item # 2 above, I can find no law which would preclude the city from charging the actual cost of the criminal background check plus the occupational license fee to an applicant for a "Solicitor" license. Regarding the actual license fee, I agree with Don that the twenty-five dollar ($ 25.00) license fee can only be raised five percent (5%) during this amendment cycle under state law.
