REQUEST: Utility Department Requesting Approval of Resolution #828 Authorizing the
Creation of a Zone for a Water Line Extension on Old Sanford/Oviedo Road.
PURPOSE: The purpose of this Board item is to request approval of Resolution #828
proposing the creation of a zone for recovering costs associated with the extension
of the City's water system on Old Sanford/Oviedo Road which includes
unincorporated areas of Seminole County.
CONSIDERA TIONS:
This resolution is needed for authorization and execution of certain corporate
powers beyond the City's corporate limits so that all persons or corporations living or
doing business in the described area are to connect when available to the water system
extension. The area is generally described as the industrial properties on Old
Sanford/Oviedo Road and Wade Street north of the railroad tracks.
This design and permitting for this water line extension project were completed in
1994 at the request of several property owners in the industrial park. The various owners
were then to construct the project at their expense. Several attempts by various owners to
bring this project to fruition the last several years were unsuccessful.
In 1996, a request was made by owners and also through the Commerce and
Industry Board as to whether this project could be fronted by the City and the costs
recouped through assessments. However, due to seven of the twenty property owners
being in unincorporated Seminole County, the traditional assessment district approach

would not work.
Bids for the water line extension project were opened on December 18, 1996 and
the low bid was $69,960.00. Engineering and permit fees to date have been $6,390.00 for
a total projected cost of $76,350.00. The total projected cost was apportioned to the
property owners based on two components, fire flow and usage. The award of the
construction bid will be brought before the City Commission at a subsequent meeting for
approval.
FUNDING:
The funding source for the $69,960.00 portion of this project will be from the
Utility Enterprise Fund balance. The engineering and permit fees have been expended in
prior fiscal years. The city will recoup the expenditures as users connect to the system.
Approval of the fund expenditure is not part of this agenda item.
RECOMMENDATION:
It is recommended that Resolution #828 be approved authorizing the City to
execute its corporate powers outside the corporate limits to promote the public's health,
safety and welfare by constructing a water system extension on Old Sanford/Oviedo
Road. The project will provide fire protection and a potable water supply to an industrial
area of the City which currently relies on draft tanks and shallow wells.
IMPLEMENT A TION SCHEDULE:
Authorization to enter into a contract for construction will be sought at a
subsequent City Commission meeting.

THE CREATION OF A ZONE FOR THE EXTENSION AND EXECUTION OF
CERTAIN OF ITS CORPORATE POWERS BEYOND ITS CORPORATE LIMITS TO
THE AREA MORE PARTICULARLY DESCRIBED IN EXHIBIT "A" ATTACHED
. HERETO AND INCORPORATED HEREIN; PRESCRIBING REASONABLE
REGULATIONS FOR ALL PERSONS OR CORPORATIONS LIVING OR DOING
BUSINESS WITHIN THE SAID AREA TO CONNECT WHEN A V AILABLE, WITH
THIS CITY'S WATER SYSTEM, CONSTRUCTED, ERECTED AND OPERATED BY
THE CITY UNDER CHAPTER 180, FLORIDA STATUTES; PROVIDING FOR
SEVERABILITY; CONFLICTS; AND AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs, Florida has deemed it
necessary and desirable for the promotion of the public's health, safety and welfare to extend and
exercise its corporate powers to the area more particularly described in Exhibit "A" hereto.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA AS FOLLOWS:
SECTION I - The City of Winter Springs, Florida, pursuant to Chapter 180, Florida
Statutes, hereby proposes the construction and extension of the City's water system for the
purpose of enhancing the public's health, safety and welfare, to the territory proposed and
described in Exhibit" A" attached hereto and incorporated herein. The projected cost of said
extension is $76 350.00 .
SECTION II - Any objections to the provisions of this resolution shall be in writing and
filed with the City Commission of the City of Winter Springs, Florida.
SECTION III - That all resolutions or parts of resolutions in conflict with this resolution
are hereby repealed.
SECTION IV - That if any section or portion of a section or subsection of this resolution
proves to be invalid, unlawful, or unconstitutional, it shall not be held to invalidate or impair the
validity, force, or effect of any section or portion of a section or part of this resolution.
SECTION V - This Resolution shall take effect immediately upon its adoption.
