REQUEST: Fire Department requesting the City Commission conduct a Public Hearing and
approve the Second Reading for adoption of Ordinance No. 673, concerning the
fee charges for the City's emergency medical patient transport service.
PURPOSE: To request that the City Commission conduct a Public Hearing and approve the
Second Reading for adoption of Ordinance No. 673 amending the fee charges that
were approved with Ordinance No. 608, establishing new fees, and providing for
future fee changes by Resolution of the City's emergency medical patient transport
service, providing for conflicts, severability and effective date.
CONSIDERA TIONS:
A. December 11, 1995 - Regular Meeting City Commission
The City Commission approved the Second Reading and Public Hearing by motion
Ordinance No. 608 (attachment 1) authorizing the provision of Emergency Medical
Services Patient Transport by the Winter Springs Fire Department. The fee charge for
transport service for each person is hereby established as $184.63 per transport. This fee
is to be re-evaluated each year at budget review. If a fee change is warranted, the change
shall be accomplished as permitted by law and approved by the Winter Springs City
Commission.
B. July 14, 1997 - Regular Meeting City Commission
The Fire Department presented Regular Agenda Item G (attachment 2) requesting the City
Commission review the proposed fee schedule recommended by the Fire Department and
approve a fee schedule that the Commission determines appropriate for this service.
Discussion was held among the Commission and the proposed fee changes were approved

with the following addition. Regarding emergency medical transport, when a resident of
Winter Springs is transported from within the city limits by another entity, the resident will
pay only the established fee for a city resident. The balance of the bill will be forwarded to
the City of Winter Springs for payment from the Patient Transport Fund.
With approval of the City Commission of the proposed fee schedule with the addition as
previously stated, the Fire Department will prepare an Ordinance amending the fee charges
that were approved with Ordinance No. 608, establishing new fees, and providing for
futu:e fee changes by Resolution of the City's emergency medic~l patient transport
servIce.
C. July 28, 1997 - Regular Meeting City Commission
The Fire Department presented Regular Agenda Item B requesting the City Commission
approve the First Reading for adoption of Ordinance No. 673, concerning the fee charges
for the City's medical patient transport service. The City Commission discussed previous
language in Ordinance No. 608 that had the word emergency in the text of the Ordinance
and decided that it was important to include this language in the text of the new ordinance
to avoid confusion.
It is important to point out that the City is not operating a non-emergency patient
transport service such as to nursing homes or doctor's offices but that the Fire Department
would respond to emergencies and evaluate the patient's condition per protocols for
transport to area hospitals. Non-emergency transports would be performed by the County
or an agency approved by the County to conduct these services. The Fire Department
would revise the language in the Ordinance to include the word "emergency" and present
the revised language in the Second Reading scheduled for August 11, 1997.
FUNDING:
No additional funding is required. Fees collected for this service will be deposited in the
Medical Transport Services Fund and will be expended as approved by the City
Commission in the budget process.
RECOMMENDATION:
Conduct a Public Hearing and approval of Second Reading of Ordinance No. 673.

Ordinance effective immediately upon passage and adoption after Second Reading and
Public Hearing scheduled for August 11, 1997.

PROVISION OF EMERGENCY MEDICAL SERVICES
PATIENT TRAL'iSPORT BY THE WlNTER SPRINGS
FIRE DEP ARTMDl'T; PROVIDING FOR CONFLICTS,
SEVERABILITY AND EFFECITVE DATE.
WHEREAS, Sections 3-01, 4.14 and 12-01 of the Wmter Springs City
Charter and state law provide; and
WHEREAS, the Wmter Springs City Commission with the authority to
authorize the provision of emergency medical services patient transport by the Wmter
Springs Frre Department; and
WHEREAS, the City ofWmter Springs Fire Department has transport
equipment and personnel qualified to provide medical transport; and
WHEREAS, the Wmter Springs CIty Commission desires to provide such
service by the Wmter Springs Fire Department
NOW, THEREFORE, BE IT RESOLVED BY mE CITY
COMMISSION OF THE CITY OF WlNTER SPRINGS,
F1..0RIDA, AS FOLLOWS:
SECTION I - The Wmter Springs Fire Department is hereby authorized to
take those steps legally necessary to provide emergency medical services patient transport .
utilizing equipment and personnel of the Wmter Springs Ere Department.
SECTION II - The fee charge for transport service for each person
transported is hereby established as $184.63 per transport This fee is to be re-evaluated
each year at budget review. If a fee change is wamnted, the change shall be accomplished
as pennitted by law and approved by the WInter Springs City Commission.
ATTACHMENT 1
SECTION ill - All ordinances or parts of ordinances in conflicts with this
ordinance are hereby repealed.
SECTION IV - This ordinance shall take effect immediately upon its
passage and approval.

each person transported is hereby established as $184.63 per transport. This fee is to be

B. General Discussion
The City of Winter Springs Fire Department has been transporting Emergency Medical
Patients to area hospitals since January 15, 1996, as authorized by City Ordinance No. 608
(attachment 1). The fee charged for service is a flat fee of$184.63 regardless of
destination. We are requesting to round off the $ 184.63 charge to an even $ 185.00
During the past 18 months of service the fee charged has more than covered the expenses
associated with the transport. However, since most of the public agencies within
Seminole County will be assuming the transport function, the City's fee is the lowest
within the County (attachment 2). We are suggesting a non-resident transport fee of

$280.00. This would be consistent with the non-resident transport fees charged by
Longwood and A1tamonte Springs. However, Seminole County and Sanford are charging
$280.00 for both residents and non-residents. This $280.00 fee is what other Departments
will charge our residents if they come into the City to transport. This is a rare occurrence
but it has happened. We also want to establish a mileage rate of$6.00 per loaded mile to
offset travel expenses if a patient is transported to a hospital outside of Orange or
Seminole County. This has never happened to us but could if a 9-1-1 patient is in a stable
condition, per HRS guidelines the patient can go to their hospital of choice. We can only
make them go to an area hospital when they are in an unstable condition. This mileage rate
is only charged from the City to the hospital facility.
Therefore it is my recommendation that the following changes to the transport fee be
considered.
1. The transport rate for a City resident of$185.00.
2. The transport rate for a non-resident of$280.00.
3. A mileage rate established of$6.00 per loaded mile transporting patients to
facilities located outside of Seminole and Orange Counties.
FUNDING:
No additional funding is required.
RECOMMENDATION:
Approval of the recommended fee schedule.

ORDINANCE NO. 673
AN ORDINANCE OF THE CITY OF WINTER SPRINGS,
FLORIDA, PROVIDING FEE CHARGES FOR THE CITY
OPERATED EMERGENCY MEDICAL PATIENT TRANSPORT
SYSTEM; PROVIDING FOR CONFLICTS; SEVERABILITY AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs, Florida, has upon available
information and data deemed it to be in the best interest of the citizens of the City that it operate a
emergency medical patient transport system; and
WHEREAS, the City Commission of the City of Winter Springs, Florida, has deemed it
important to the citizens of the City that the City's operation of the emergency medical patient
transport system be at a cost that is equal to and/or less than that of private industry, so that no public
monies are used to subsidize said system; and
WHEREAS, the City Commission of the City of Wmter Springs, Florida, has the authority to
establish fees for services;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA,
AS FOLLOWS:
SECTION I: That the following schedule of fees relating to the City's operation of
the emergency medical patient transport system is hereby established;
1. Transport rate for a City resident of$185.00
2. Transport rate for a non-resident of $280.00
3. A mileage rate established of $6.00 per loaded mile transporting patients to
facilities located outside of Seminole and Orange Counties.
4. Regarding emergency medical patient transport, when a resident of Winter Springs
is transported from within the city limits by another entity, the resident will pay only the established

fee for a city resident. The balance of the bill will be forwarded to the City of Winter Springs for
payment from the Medical Transport Services Fund.
SECTION II: That in the event it is determined by the City Commission that a change
to the fee schedule is warranted, the change shall be accomplished by Resolution approved by the
Winter Springs City Commission.
SECTION ill: That is any section or portion of a section or subsection of this
Ordinance proves to be invalid, unlawfu~ or unconstitutional it shall not be held to invalidate or
impair the validity, force or effect of any other section or portion of a section or subsection or part of
this Ordinance.
SECTION IV: That all ordinances or parts of ordinances in conflict herewith are
hereby repealed to the extent of said conflict.
SECTION V: This ordinance shall take effect upon passage and adoption.
