REQUEST: Utility Department Requesting Approval of the City Commission to Execute
a Utility Termination Agreement with FDOT.
PURPOSE: The purpose of this Board item is to request approval of the City Commission for
the execution of a Utility Termination Agreement with the Florida Department of
Transportation to terminate a Joint Participation Agreement that was approved in
December, 1993.
CONSIDERA TIONS:
The approval of the Utility Termination Agreement is needed to terminate a Joint
Project Agreement that was executed with FOOT in December, 1993 that no longer is
applicable. There were two JPA's executed in 1993; one for utility work related to the
construction of S.R. 434 from S.R. 419 to Tuskawilla Road and one for the construction
of S.R. 434 frolli Tuskawilla Road to S.R. 417.
When these JPA's were executed in 1993, the section of S.R. 434 east of
Tuskawilla Road was planned to occur first. Subsequent rescheduling of the construction
of S.R. 434 by FDOT caused the reassignment of utility work from one project to the
other. The 1993 JPA which remains needs to be terminated so that the only valid JPA is
the one which was approved at the May 12, 1997 City Commission meeting.
FUNDING:
There are no costs associated with approving the Utility Termination Agreement.

RECOMMENDATION:
It is recommended that the City Commission authorize the execution of the Utility
Termination Agreement with the Florida Department of Transportation to terminate a
Joint Project Agreement that was executed on December 22, 1993 for State Job No.
77070-6517 (S.R. 434 from Tuskawilla Road to S.R. 417).
IMPLEl\1ENTATION SCHEDULE:
The Utility Termination Agreement will be forwarded to the FDOT project
representative by May 30, 1997 along with other required documents. The construction
of S.R. 434 is scheduled for bid letting in September, 1997 with a projected construction
start date of January, 1998.

Dear Mr. Lockcuff:
The enclosed Utility Termination Agreement requires execution by the City Commission. The
Agreement which is being terminated is the IP NUIHC for the water main relocation work to the west
of Tuskawilla Road. This work was transferred, under a separate IP NUIHC Agreement, to the
roadway project on SR 434, WPI 5117657. However, the IPNUn~lC for WPI 51] 7664 was not
terminated. The attached Termination Agreement will close that project's utility work. The JPNCM
Agreement, State Project No. 77070-6518 will then be the only open JP A Agreement under WPI
5]]7664.
As such, please let me know when the IP NCM will be forwarded to the City Commission for
approval. In addition, please forward your Technica] Special Provisions and Estimate to our office by
May 30, 1997 along with the executed Termination Agreement.
