REQUEST: The City Manager requesting the City Commission to authorize the City Manager
to enter into a contract with Berryman & Henigar to conduct an Evaluation and
Appraisal Report (EAR) of the City's Comprehensive Plan, as required ~y Florida's
Local Government Comprehensive Planning and Land Development Regulation
Act (Chapter 163, Part II Florida Statutes)
PURPOSE:
The purpose of this Board Item is to gain the Commission approval to engage the firm of
Berryman & Henigar to prepare an Evaluation and Appraisal Report of the City's
Comprehensive Plan as required by state law.
APPLICABLE LAW AND PUBLIC POLICY:
The provisions of 163.3191(1) F.S. which states in part: "The planning program shall be a
continuous and ongoing process. The local planning agency shall prepare periodic reports on the
comprehensive plan, which shall be sent to the governing body and to the state land planning
agency at least once every 5 years after the adoption of the comprehensive plan... . . The
evaluation and appraisal report process shall be the principal process for updating lo~al
comprehensive plans to reflect changes in state policy on planning and growth management. "
The provisions of9J-l1.018 F.A.C. which state in part: "The proposed evaluation and appraisal
report will asses and evaluate the success or failure of the local government's adopted
comprehensive plan, including the validity of the projections, the realization of the goals and
objectives, and implementation of the plan's policies. The proposed evaluation and appraisal
report shall also address changes in local conditions, the effect on the comprehensive plan of
changes to: the state comprehensive plan, Chapter 163, Part II, Florida Statutes, Chapter 9J-5,
Florida Administrative Code, and the appropriate strategic regional policy plan; suggest changes
needed to update the comprehensive plan, elements, or portions thereof; suggest reformulated or
additional goals, objectives, policies, maps, schedules, and procedures; and otherwise address the
requirements specified in Section 163.3191, Florida Statutes, and this Rule."

FUNDING:

It requires approximately one (1) year to complete all the data and analysis
requirements indicated in 163.3191(2) F.S.

For a city the size and complexity of Winter Springs the cost of preparation of an
EAR is approximately $ 30,000 to $ 35,000. The RFP indicated that the project
cost limit is $ 35,000.

Of the three (3) respondents to the RFP, Berryman & Henigar offers to prepare
the EAR for $ 34,740.

The subcommittee appointed by the City Manager evaluated the three responses to
the RFP by the consultants, and recommended to the City Manager that B~rryman
& Henigar be selected to prepare the City's EAR of its Comprehensive Plan.

The cost of this project is $ 34,740. Funding for this project is shared between the
State and the City a follows:

The project will be completed over two budget cycles as follows:

Sufficient funds are available in the FY 97 budget to cover the expenses for FY 97.

RECOMMENDA TION TO THE CITY COMMISSION:
The City Manager recommends the City Commission to give the City Manager the authority to
enter into a contract with the firm of Berryman & Henigar to prepare the City's Evaluation and
Appraisal Report of its Comprehensive Plan at the maximum cost of$ 35,000.
IMPLEMENTATION SCHEDULE:

For the City of Winter Springs, the deadline to submit the draft of its Evaluation
and Appraisal Report (EAR) is 5:00 p.m. June 3,1998.

The City Commission must adopt the EAR by September 1, 1998.
