REQUEST: Land Development Division requesting Commission approval of Ordinance No.
660 vacating a portion of of a 15 foot drainage easement located to the rear of Lot
44, Chestnut Ridge (216 Chestnut Ridge Street). Action at this meeting is for the
First Reading of this Ordinance. The Second Reading and adoption of this
Ordinance No. 660 will be at a later meeting.
PURPOSE: The purpose of this Board Item is to vacate a portion of an existing 15 foot
drainage easement located to the rear of Lot 44, Chestnut Ridge (216 Chestnut
Ridge Street). This will allow the owner of the property to build a screen
enclosure.
FINDINGS:
1.) Chestnut Ridge was platted April 12, 1993.
2.) The Public Works/Utility Director and the City Engineer have reviewed
this request and have no objection to this action.
CONCLUSION:
The vacating of a portion of this drainage easement will allow the owner to build a
screen enclosure to the rear of his property.
RECOMMENDA TION:
It is recommended that the Commission approve the First Reading of this
ordinance, and at a later meeting approve the Second Reading and adoption of the
ordinance.

Drainage Easement Vacation
Attached for your legal review is the above referenced proposed Ordinance No. 660 which will
vacate a portion a drainage easement located in Chestnut Ridge subdivision. The Public
WorksfUtility Director and the City Engineer have no objection. The other utility companies are
not involved with drainage easements.
It is the policy of the City Manager that you review all ordinances prior to enactment.
This proposed ordinance will be on the April 28, 1997 Commission Agenda for First Reading.

Dear Don:
I would like to request an easement vacation of 8.5 feet into the IS-foot drainage
easement, on the rear lot line of lot #44 in Chestnut Ridge.
This would enable me to put a screen enclosure on the back of my new home.

the rear of Lot 45 to reach the storm inlet at the rear of Lots 41

ORDINANCE NO. 660
AN ORDINANCE OF THE CITY OF WINTER SPRINGS, FLORIDA
V ACA TING, ABANDONING AND CLOSING THE SOUTHERLY 8.5
FEET OF THAT 15 FOOT DRAINAGE EASEMENT LOCATED TO THE
REAR OF LOT 44, CHESTNUT RIDGE, PLAT BOOK 46, PAGES 25 AND
26, PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA, MORE
PARTICULARLY DESCRIBED AS FOLLOWS; PROVIDING FOR
CONFLICTS, SEVERABILITY AND EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs, Florida has determined
it to be in the best interest of its citizens to vacate the drainage easement described herein;
NOW, THEREFORE, be it ordained by the City Commission of the City of Winter
Springs, Florida as follows:
SECTION I: The City hereby vacates, abandons and closes the following described
property:
THA T SOUTHERLY 8.5 FEET OF THA T 15 FOOT DRAINAGE EASEMENT
LOCA TED TO THE REAR OF LOT 44, CHESTNUT RIDGE, PLAT BOOK
46, PAGES 25 AND 26, PUBLIC RECORDS OF SEl\UNOLE COUNTY,
FLORIDA.
THE ABOVE DESCRIBED PARCEL OF LAND LIES IN SEMINOLE
COUNTY, FLORIDA.
SECTION ll: That any portion of any City Ordinance in conflict herewith shall
be hereby repealed.
SECTION HI: This Ordinance shall be effective upon its passage.
