REQUEST: Police Department providing the Commission with information regarding the
attempt to acquire a vehicle through forfeiture procedures.
PURPOSE: The purpose of this item is inform the Commission regarding the Police
Department's attempts to secure a 1988 Mercury Marquis automobile through the process
of asset forfeiture as a vehicle involved in a felony.
CONSIDERATIONS: On February 19, 1997 an officer of the Winter Springs Police
Department came in contact with the driver of a 1988 Mercury Marquis dwing the normal
course of duty. Through that contact, a sizable quantity of Marijuana was discovered in
the vehicle, in violation of Florida Statutes. In addition to other criminal charges pending
against the driver, the Police Department is attempting to obtain possession of the vehicle
through forfeiture proceedings. Applicable provisions ofPlorida Statutes allow the
seizure of vehicles and other personal property ifused in the commission of a felony, or to
transport and conceal contraband. If the process is successful, the Police Department may
then convert this vehicle for department use, or sell it and convert the proceeds to
purchase other needed equipment that is not already covered under the budget.
In order to accomplish this goal, a filing fee of $91. 50 must be paid to the Clerk of the
Court to file the proceeding,
