Authorization
REQUEST: The Parks and Recreation Department requests that the Commission
authorize the City Manager to enter into a contract with Conklin, Porter
and Holmes Engineers, Inc, for topographic survey services for the city
parks at a cost not to exceed $11,300.00 as authorized in the provisions of
Commission Amendment 52 for engineering consulting services,
PURPOSE: The purpose of this request is to map topography, trees and existing structures
necessary to concluding site use master planning and drainage design for Torcaso
Park, Sam Smith Park, Moss Park and Trotwood Park.

CONSIDERA TIONS:
. Conklin, Porter and Holmes are on contract with the City for continuing
engineering services.
. Conklin, Porter and Holmes have on hand considerable engineering data related
to these sites concomitant with earlier engineering work with the City. Use of
other firms could cause additional expenditures seeking such data as already
available to our contract engineers.
FUNDING:
. The source of funding for their expenses will be General Fund surplus. This item
has been included in the 1997 budget ammendment.

RECOMMENDA TION:
That the City Commission authorize the City Manager to enter into a contract
with Conklin, Porter and Holmes Engineers, Inc. for topographic survey services
for four City parks according to the terms of the proposal attached for a sum not
to exceed $11,300.00 thereby authorizing also this fifty second amendment to the
agreement dated November 27, 1984.
IMPLEMENTATION SCHEDULE:
Immediately upon approval by Commission.

fECTION 1
pENERAL
I
The ENGINEER shall provi~e all services required to complete topographic surveys
for Moss Park. Torcaso Park, Sam Smith Park; and Trotwood Park as per the detail
described. The ENGINEERlwill retain the services of a surveyor to accomplish this
work. The ENGINEER shall perform professional services as hereinafter stated in
accordance with good engineering practices.

BASIC SERYIFES OF THE ENGINEER
I
The ENGINEER will serve qs the CITY'S professional representative in those phases
of work to which this Amen~ent applies, and will give consultation and advice to
the CITY during the period crfperfonnance of services. The ENGINEER will assist
the CITY in the coordinati~n of the topographic surveys and provide a ftnished
product from the surveyor tt the CITY.

SUPPLEMENTARY ~ERVICES OF THE ENGINEER

If authorized in writing by tre OWNER prior to the rendering of such services, the
ENGINEER will furnish or (pbtain Wlder subcontracts, supplementary services of the
following types which will tc paid for by the OWNER.
Additional services due to siFfiC"'cUlt changes in the scope of the project or its design
including, but not limited to'1 changes in complexity, character, or due to time delays
in initiating or completion 9f the work as described herein.

THE OWNE~'S RESPONSIBILITIES

The OWNER will: i

A~vise the ENGINEER of lVs requirements for the project and designate a person to
act as the OWNER'S represttntative with respect to the work to be performed under
this Amendment, and sucjh person shall have complete authority to transmit
instructions, r~ceive inforTr!ation. interpret and define the OWNER'S policies and
decisions pertinent to the wrrk covered by this Amendment.

Guarantee access to and m~e all provision for the ENGINEER to enter upon public
and private lands as required for the ENGINEER to perform his work under this
Amendment. I
Provide data requested thati is reasonably available on the existing utility sysrems,
population and projects, lartd use and planning information.
Examine all studies, repo~. sketches, and other documents presented by the
ENGINEER and render deJisions pertaining thereto within a reasonable time so as

not to delay the work of thd ENGINEER.
Obtain approval of all gOv~ental authorities having jurisdiction over the project,
and such approvals and co*sents from such other individuals or bodies as may bt:
necessary for completion of the Project. .

Furnish, or direct the ENGINEER in writing to provide at the OWNER'S expense,

necessary additional servic~ as stipulated in Section 4 of this Amendment. or other
services as required. t
Provide such legal, accoun~. and insurance counseling services as may be required
for the project, and such 11l~iting services as the OWNER may require.

Give prompt written notice~ the ENGINEER whenever the OWNER observes or
otherwise becomes aware ol any defect in the Project.

fAYMENT
I
I
Compensation paid ENGll'!lEER tor coordination services described herein and
rendered by principals and e~plOyees assigned to the Project will be a lump swn of
$150 per site or $600. The ~ee for the topographic surveys totals $10,700 and will
be performed by the subco~sultant. The fee for the scope of services described in
Section 3 shall be $11 ,300.<r unless modified by further written authoriUltion.

REIMBURSED EXPENSEs AND DEFINITIONS

Expenses for items not sltecifically valued herein are to be reimbursed to the
ENGINEER at the actual coft ~ereof. Said expenses shall include traIl:>-portation and
subsistence of principuJs apd employees~ when traveling in connection with the
Project~ toll telephone caBs! telegrams and similar project-related items.
The OWNER will make prpmpt monthly payments in response to ENGINEERS'S
monthly statements withou,t retention tor all categories of services rendered under
this Amendment and tor re~mbursable expenses inCUITed.

Direct Personnel Expense ed as a basis for payment shall mean the salaries and
wages paid to principals an employees of all classifications engaged directly on the
project, plus the cost of Ji'i ' ge benefits including but not limited to, social security
contributions, worker's co ation, h~th and retirement benefits, bonuse!i, sick
leave" vacation and holiday ay applicable thereto. For purposes of this Amendment,
Direct Personnel Expense shall be considered an amount equal to 1.48 times
applicable salaries and wa~.
Charges for the services rehdered by principals and employees as witnesses in any
litigation~ hearing or proieeding in accordance with Paragraph 4.2.3 will be
computed at a rate of S400.pO per day or any portion thereof (but compensation for
time spent in prc;paring to ~pear in any such litigation, hearing or proceeding will
be computed in accordanc9 with Paragraph 6.1.1 and 6.2.1 herein).

Iftbis Amendment is tenn~ted during prosection of the services prior to completion
of the services of Section 3'ipayments to be made in accordance with Pardgraph 6.1.6
and 6.2.1 on account of tl~t and all prior work under this Amendment shall be due

Since the ENGINEER has up control over the cost of labor, materials or equipment,

probable constructlOn cost ~ch may be proVlded m the semces of this Amendment
are made on the basis ofhi~ experience and qualifications and represent his best
judgement a design profesfional familiar with the construction industry, but the
ENGINEER cannot and does not guarantee that bids or the construction cost will not
vary from opinions of probtb1e cost prepared by him.
The OWNER and the ENGiNEER each binds himself and his partners, successors,
executors, administrators, ~d assigns to the other party of this Amendment and to
partners, successors, execu~ors, administrators, and assigns of such other party in
respect to all covenants of fhis Amendment. Nothing herein shall be construed as
creating any personal liability on the part of any officer or agency of any public body
which may be u party heI'fto, nor shaH it be constructed as giving any rights or
benefits hereunder to anyo~e other than the OWNER and the ENGINEER.
