HomeMy WebLinkAboutResolution 2005-32 Joint Planning Process RESOLUTION NO. 2005-32 A RESOLUTION OF TIlE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, FLORIDA, RESPECTFULLY REQUESTING THAT SEMINOLE COUNTY AND THE CITY OF OVIEDO PERMIT THE CITY OF WINTER SPRINGS TO FULLY AND ACTIVELY PARTICIPATE IN THE JOINT PLANNING PROCESS THAT IS ClJRRENrLY ONooGOlNG BETWEEN SEMINOLE COUNTY AND THE CITY OF OVIEDO SO THAT THE PARTIES MAY ENGAGE IN INTERGOVERNMENTAL COORDINATION, COLLABORATIVE PLANNING AND BETTER COORDINATI9N ON ISSUES THAT HAVE MUL TI.J1JR.I8DICTlONAL SIGNIFICANCE; PROVIDING roRREPEAL OF PRIOR INCONSISTENT RESOLunONS, SEVERABILITY AND AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Winter Springs is aware that Seminole County and the City:of Oviedo are currently involved in a joint plannn,e process and working on a new joint planning agreement that may ultimately have some impact on the City of Winter Springs; and WHEREAS, the City of Winter Springs desires to fully and actively participate in that joint planning process to enhance intergovernmental cooperation and coordination between the parties; and WHEREAS, in 1997, the Seminole County, Oviedo, Winter Springs, and other cities in Seminole County entered into an agreement for the general purpose of establishing a framework for coordination, communication and notification of proposed land use actions, and to build cooperation between affected local governmentS and the scbool board; and WHEREAS; Vision 2020, Seminole County Comprehensive Plan, states that the County wishes to foster better coordinated land use planning with the Cities in Seminole County and that Seminole County is striving to enter into loint Planning Agreements with tb.e cities; and WHEREAS, Vision 2020 also provides that one of Seminole County's tasks is to strive to implement collaborative planning by coordinating efforts to better alleviate any new land use compatibility issues and to jointly plan growth in Seminole County in order to achieve livable or sustainables communities for generations to come; and WHEREAS; both the cities of Winter Springs and Oviedo have adopted Intergovernmental Coordination Elements in their respective Comprehensive Plans that provide that they will strive to enhance interlocal government coordination on a various issues that may affect them; and WHEREAS, the City, Conunission of Winter Springs recognizes that the issue of joint planning agreementslbetween Winter Springs, Seminole County and Oviedo bas resulted in several intergovernmental disputes in the past; and WHEREAS, by participating and being included in the on-going joint planning process City of Winter Springl!l Resolution 2005.32 Page 1 of 2 between Oviedo and Seminole County the City of Winter Springs desires to find common ground between the parties and to avoid such disputes in the future. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF WINTER SPRINGS, SEMINOLE COUNTY, .FLORlDA, AS FOLLOWS: Section 1. Incorporation of Recitals. The foregoing recitals are deemed true and correct and are hereby fully incorporated by this reference. Section Z. Participate In Joint Planning Process. The City of Winter Springs respectfully requests that SeminOle County and the City of Oviedo permit the City of Winter Springs to fully and actively participate in the joint planning process that is currently on-going between Seminole .county and the City of Oviedo. The parties should use the on-going joint planning process to engage in intergovernmental coordination, collaborative planning and better coordination on issues that have multi-jurisdictional significance to all parties. Section 3. RepeaI of Prior Inconsistent Resolutions . All prior Resolutions or parts of Resolutions in conflict herewith are hereby repealed to the extent of the conflict. Sec:tion 4. Severability. If any section. subsection, sentence, clause, phrase, word, or portion of this resolution is for any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion hereto. Section 5. Effective Date. This Resolution shall become effective immediately upon adoption .by the City Commission of the City of Winter Springs, Florida. RESOLVED by the City Commission of the City of Winter Springs, Florida, in a regular meeting assembled on the 8th day of August , 2005. JOHN F.
