REQUEST: Land Management Division requesting Commission approval of Ordinance No,
639 vacating a portion of that utility easement identified as Tract "H" located to
the rear of lot 46, The Highlands Section One (896 Stirling Drive). Action at this
meeting is for the First Reading of this Ordinance. The Second Reacting and
adoption of this Ordinance No. 639 will be at a later meeting.
PURPOSE: The purpose of this Board Item is to vacate a portion of an existing utility
easement identified as Tract "H" located to the rear of Lot 46, The Highlands
Section One (896 Stirling Drive). This will allow the owner of this property to
screen in an existing patio.
FINDINGS:
1.) The Highlands Section One was platted in June 1973.
2.) It appears, from past requests, that the developer not only sold the lots, but
portions of the utility easement were also sold to abutting property owners.
3.) A patio was built into this utility easement and the owner now wishes to
enclose this patio. The City allows horizontal intrusion into utility
easements, but not vertical ones, except for a fence.
4.) All concerned utility companies have reviewed that portion of the utility
easement to be vacated and have offered no objection to this action. All
the utility companies with the exception of TWC agreed to vacate the
entire easement. TWC only agrees to vacate that portion which the
proposed ordinance addresses.

CONCLUSION:
The vacating of a portion of this utility easement will allow the owner to enclose
the patio area which is in the easement.
RECOMMENDA TION:
It is recommended that the Conunission approve the First Reading of this
ordinance and at a later meeting approve the Second Reading and adoption of the
ordinance,
