PURPOSE: The purpose of this Item is for the Commission to approve a Temporary Use Permit which will allow the placement and use of a modular office at 225 Old Sanford Oviedo Road for a period of time not to exceed six (6) months while the Staff Review Board reviews the site plan for this project. APPLICABLE CODE: There is no applicable code section which authorizes the issuance of a temporary use permit for a modular office. There is an analogous code section which has been previously used to grant the same type request in order that a business be allowed to operate while the site plan was being reviewed. This code section is: Section 20-412. Trailer uses. Trailers may be kept only in areas designated as trailer parks, except as designated in Section 20-432. A temporary permit may be obtained from the City Commission for use in commercial, rural and residential (areas). CONSIDERA nONS: The Hall Company, clients of American Civil Engineering Co., had a lease at 255 Old Sanford Oviedo Road (County jurisdiction) which expired on October 31, 1996 and must vacate the building. The Hall Company desires to remain in Winter Springs and in this regards have purchased the property at 225 Old Sanford Oviedo Road (City jurisdiction) and are in the process of having site plan developed. November 25, 1996 CONSENT AGENDA ITEM A Page 2 A conceptual plan was presented to the Staff in late October 1996 and the Staff offered comments to be included in .the formal site plan submission. A site plan, according to American Civil Engineering Co., is to be submitted to the City for formal review the week of November 18, 1996. American Civil Engineering has made the request for a temporary use permit on behalf of their client so that they may continue uninterrupted operations on property purchased within the City of Winter Springs while the site plan is being reviewed. RECOMMENDA TION: It is recommended that the Commission approve the request for the issuance of a temporary use permit for a time period of six (6) months with the caveat that the site plan must be approved by Staff and construction commenced by the end of that period. Please find attached construction infonnation supplied by GE Capital Modular Space. Under the 'Building Criteria' table it appear that the unit was 'manufactured per DCA letter' . If you have any other concerns regarding this request for a temporary occupancy permit please fax your concerns in writing to me at 327-0227 so that we will have a record of correspondence. Please schedule this item for City Council action at the next appropriate meeting. Attorney Kruppenbacher said, for the record, the Manager is going to have the Planner transmit to us the complete plan and we will look at what is transmitted. Mayor Kulbes called a recess at 9:30 p. m. and called the meeting back to order at 9:40 p. m. Mayor Kulbes announced that there will be additional public hearings in August after the comments are received back from- the Department of Community Affairs. In those hearings public comments will be accepted and there will be notices in the newspaper. Request of Cast-Crete for a temporary office trailer (Location at terminus of Old Sanford/Oviedo Road): The Land Development Coordinator explained this is to be located at the terminus of the Old Sanford-Oviedo Road. Staff has reviewed this and ask that if Cast Crete continues doing business in the City, that they come in with a formal site plan nine months after approval. Motion was made by Commissioner Kaehler to approve the request of Cast-Crete for a temporary office trailer subject to Staff's comments for the period of one year and that after nine months they have to bring a formal site plan forward. Seconded by Commissioner Langellotti. Discussion. Vote on the motion: Commissioner Kaehler, aye; Commissioner Langellotti, aye; Commissioner Donnelly, aye; motion carried. Appointment of Auditor for Fiscal Year 1990-1991:. City Manager Rozansky said Coopers & Lybrand sent the Commission a letter requesting reappointment. Manager Rozansky said he has no problem with them and neither does the Finance Department. Manager'Rozansky said he thinks they did a good job and it was a very good audit. Bill Jacobs, S. Edgemon Ave., spoke in discussion of the auditors. Commission discussed going out for "bid". Motion was made by Commissioner Kaehler to go out for proposals. Seconded by Commissioner Donnelly. Discussion. Vote on the motion: Commissioner Langellotti, .aye; Commissioner Donnelly, aye; Commissioner Kaehler. aye; motion carried. Resolution No. 663, recommending to the Council of Local Governments in Seminole County, that a Winter Springs Commissioner be appointed to the Seminole County Expressway Authority: Attorney Kruppenbacher read Resolution No. 663 by title only. Motion was made by Commissioner Kaehler to adopt Resolution No. 663. Seconded by Commissioner Langellotti. Discussion. Vote on the motion: Commissioner Donnelly, aye; Commissioner Kaehler, aye; Commissioner Langellotti, aye; motion carried.
