REQUEST: Utility Department Requesting Authorization to Execute Amendment 5 for
Consulting Engineering Services with Conklin, Porter & Holmes Engineers, Inc.
to Design a Residential Reclaimed Water Distribution System for Greenspointe
PURPOSE: The purpose of this Board item is to request authorization for the execution of
Amendment 5 for the Design of Residential Reclaimed Water Distribution System
Extension for Greenspointe with Conklin, Porter & Holmes Engineers, Inc. at a cost
of$35,010.00.
CONSIDERATIONS:
The engineering design of this extension of the reclaimed water distribution system is
needed to continue the orderly expansion of the West reclaimed water system as outlined in
the Reuse Feasibility and Implementation Plan adopted in 1994. This agreement is
Amendment 5 to the October 14, 1992 Agreement for Consulting Engineering Services. This
agreement was entered into after CPH was selected by the City Commission after RFP's were
solicited for consulting engineering services for design of the reclaimed water pumping,
storage and distribution facilities.
The design scope of work includes an extension of the distribution main to
Greenspointe, a system within or adjacent to Greenspointe to seNe all the residences, and an
extension of the distribution main northward to Wildwood. The terminus of the main would
be near the southwest intersection of Tanglewood Road and Wildwood Drive. The reclaimed
water distribution system within the Wildwood subdivision is scheduled for FY 1998/1999.

In addition to the design scope of work, bidding services ($3,000) and construction
administration ($6,000) are included.
FUNDING:
The cost for engineering services in Amendment 5 is $35,010 of which $13,410 is for
the surveying sub consultant, $3,000 is for bidding services, and $6,000 is for construction
administration. This project was budgeted in the current fiscal year Utility Budget Capital
Improvements at an estimated cost of$210,000 including construction. The capital
improvements line code of the Utility Fund to which this cost which be charged is 3600-
56310. Funds would be expended in 90 to 120 days.
RECOMMENDATION:
It is recommended that authorization be given for the execution of Amendment 5 for
Consulting Engineering Services related to the Design of Residential Reclaimed Water Distribution
System Extension for Greenspointe with Conklin, Porter & Holmes Engineers, Inc. at a cost of
$35,010 payable from the Capital Improvements line code (3600-56310).
IMPLEMENTATION SCHEDULE:
The design of this project should be completed within 120 days of authorization.
Construction bids should be let within 30 days after that.

This Amendment dated I 1996, by and between the City of Winter Springs (hereinafter
called the OWNER) and Conklin, Porter & Holmes - Engineers, Inc. (hereinafter called the
Engineer), is mutually agreed upon and declared an authorized Amendment to an Agreement dated
October 14, 1991, between the parties, herein setting forth the scope, terms and conditions of the
services herein authorized. The appropriate provisions of the October 14, 1991, Agreement apply
as fully as if repeated herein.

SECTION 1
GENERAL
1.1
The purpose of this Amendment is to provide for Engineering Services, more
specifically itemized herein, in the preparation of Plans and Specifications for
reclaimed water main extension into the residential subdivision of Greenspointe and
an extension up to Wildwood Drive along the power easement.
SECTION 2
BASIC SERVICES OF THE ENGINEER
2.1 GENERAL
2.1.1 The ENGINEER agrees to perform professional services in connection with the
project as hereinafter stated.
2.1.2 The ENGINEER will serve as the OWNER's professional engineering
representative in those phases of the project to which this Amendment applies, and
will give consultation and advise to the OWNER during the performance of his
services. The ENGINEER will perform the services for the City Commission
under the general supervision of the City Manager and Utilities Director and will
submit interim plans to them for their review, input, decision, etc. as appropriate.
SECTION 3
SCOPE OF SERVICES
3.1
GENERAL
The OWNER hereby authorizes the ENGINEER to proceed with the preparation
of plans and specifications for reclaimed water main improvements as listed below.
No construction permitting from FDEP is required since this line improvement is
within the reclaimed water service area.
3.1.1 Route
The route for this line extension was previously selected and provides a residential
loop around and through these subdivisions. The route consists of an extension
from the Water Reclamation Facility within the power easement north to
Greenspointe and Wildwood. Distribution lines and services will be provided for
Greenspointe.
3.1.2 Evaluate the existing Reclaimed Master Plan and the associated piping for the
Highlands area. Meet with City staff to discuss changes to the pipe sizes and
routes. Revise the computer model and prepare an update to the master plan.
3.1.3 This is a zero-lot line subdivision with minimal roadway ROW. Therefore, we will
evaluate the possibility of serving this subdivision from the golf course side. To
do this, we will obtain a 1" =50' aerial to prepare a preliminary layout prior to
obtaining the survey for the site.
3.2 ENGINEERING SERVICES - DATA COLLECTION, ANALYSIS
AND DESIGN
3.2.1 Survey services will be provided by a licensed surveyor. The surveyor will
perform the survey for a full right-of-way along the route selected using an aerial
base. The aerial base was previously flown for the 12" line extension project.
ENGINEER will coordinate the work of the surveyor with the design. The power
easement section from the WRF to Wildwood will not be placed on an aerial base.
Obtain a 1" =50' aerial for a preliminary piping layout.
The survey will include:
a) Approximate right-of-way location
b) Location of all visible improvements
c) Coordination with utilities
d) Location of utilities (horizontal)
e) Cross sections at 100' intervals
f) Inverts of crossing or adjacent sanitary and storm structures
g) ACAD disc with drafting at 1" = 30' which will be merged with the aerial
drawing.
3.2.2 Perform final designs of the reclaimed water main on double plan sheets for the
Greenspointe distribution system and the power easement. Scale shall be 1 inch
equals 30 feet. Plans will also include a cover sheet, general notes sheet, and the
City of Winter Springs standard reclaimed water details sheet. Line sizes will be
based on the Master Plan piping model as discussed in 3.1.2.
3.2.3 Prepare a Specification using the short form documents for review by OWNER.

Perform field checks of completed Plans and Specifications with the OWNER's
representative.
Prepare opinions of probable construction cost based upon fmal plans and Contract
Documents.
Provide the OWNER with three sets of final plans and Contract Documents.
No soils work is included in this scope.
PERMITS
This project is within the reuse service area and does not require an FDEP
Construction Permit.
No permits are anticipated for SJRWMD or other agencies. We do not anticipate
and Dredge and Fill or Wetlands permits at this time.
These are City streets and no right-of-way permit is required.
Assist the OWNER in obtaining a right-of-way use permit from Florida Power
Corporation.
BIDDING SERVICES
The ENGINEER will provide these services after separate Notice to Proceed from
the OWNER.
3.4.1 Prepare advertisement for bid for placement in appropriate publications by the
OWNER.
3.4.2 Distribute and keep records of the distribution of documents to bidders and
suppliers.
3.4.3 Issue addenda to the documents as required.
3.4.4 Answer questions of bidders and suppliers. No interpretations of the documents
shall be made, other than through issuance of addenda to the documents.
3.4.5 Attend the bid opening and OWNER's meetings at which bids are to be opened and
contracts awarded.
3.4.6 Evaluate the bids and assist the OWNER in the selection of the construction
contractor.
3.4.7 Consult with the OWNER and participate in all decisions as to acceptability of
subcontractors and other persons and organizations proposed by the general
contractor for these portions of the work for which subcontractor approval is
required by the documents.
3.4.8 Prepare and review contracts, bonds, insurance certificates, construction schedules
and other portions of the Contracts in order to assist the OWNER in his
determination as to whether to issue a Notice to Proceed to the Contractor.
3.5 ADMINISTRATION OF CONSTRUCTION SERVICES
The construction phase will commence with the award of the construction contract
and will terminate upon written approval of final payment by the ENGINEER on
the construction contract. During the construction phase, the ENGINEER will
provide limited administration of construction services. The contract period is
estimated to be 120 days with in-field construction of approximately 90 days.
3.5.1 Advise and consult with the OWNER and act as his representative as provided in
the General Conditions of the construction contract. The extent and limitations of
the duties, responsibilities and authority of the ENGINEER as defined in said
General Conditions shall not be modified without the ENGINEER's written
consent.
3.5.2 Conduct a preconstruction conference. Conduct all monthly progress meetings
(two anticipated).
3.5.3 Make periodic visits to observe the progress and quality of the executed work and
to determine, in general, if the work is proceeding on time and in accordance with
the Contract Documents. ENGINEER will not be required to make exhaustive or
continuous on-site observations to check the quality or quantity of the work under
this item; he will not be responsible for the construction means, methods,
techniques, sequences, or procedures for the safety precautions incidental thereto;
his efforts will be directed toward providing additional assurance for the OWNER
that the completed project will substantially conform to the requirements of the
Contract Documents, but he will not be responsible for the Contractors' failure to
perform the construction work in accordance with Contract Documents; and during
such visits and on the basis of his on-site observations as an experienced and
qualified design professional, he will keep the OWNER informed on the progress
of the work, will endeavor to guard the OWNER against defects and deficiencies
in the work of the Contractors, and may disapprove or reject work as failing to
conform to the Contract Documents. We have estimated one 4-hour inspection per
week for the 90-day construction period for a total of 48 hours.
3.5.4 Check and approve shop drawings, diagrams, illustrations, brochures, catalog data,
schedules and samples, the results of tests and inspections and other data with the
contractor is required to submit, but only for conformance with the design concept
of the project and compliance with the information given in the Contract

Documents; assemble maintenance and operating instructions, schedules,
guarantees, bonds and certificates of inspection required by the Contract
Documents.
Prepare routine change orders.
Issue all instructions of the OWNER to the contractor; he may as the OWNER's
representative, require special inspection or testing of the work (whether or not
fabricated, installed or completed); he will act as interpreter of the terms and
conditions of the Contract Documents and judge of the performance thereunder by
the OWNER and the Contractor and will make decisions on all claims of the
OWNER and the contractor relating to the execution and progress of the work and
all other matters and questions related thereto; but the ENGINEER shall not be
liable for the results of any such interpretations or decisions rendered by him in
good faith.
Based on his on-site observations as an experienced and qualified design
professional and on his review of the contractors' applications for payment and
supporting data, determine the amount owing to the contractor and approve in
writing payment to the contractor in such amounts; such approval of payment to
constitute a representation to the CITY, that is an expression of the ENGINEER's
opinion, based on such observations and review, that the work has substantially
progressed to the point indicated and that, to the best of his knowledge, information
and belief, the quality of the work is in accordance with the Contract Documents
subject to an evaluation of the work as a functioning project upon Substantial
Completion and to the results of any subsequent tests called for in the Contract
Documents and to any qualifications stated in his approval), but by approving an
application for payment, the ENGINEER shall not be deemed to have represented
that he has made any examination to determine how and for what purposes the
Contractor has used the monies paid on account of the Contract Price or that title
to any of the Contractor's work, materials, or equipment has passed to the CITY
free and clear of any liens, claims, security interests or encumbrances. Such
representation shall at no time be considered as a legal obligation of the
ENGINEER.
Participate in an inspection to detennine if the project is substantially complete with
punchlists of items to be corrected (if applicable) and a final inspection to
determine if the project has been completed substantially in accordance with the
Contract Documents and that the contractors have substantially fulfilled their
obligations thereunder so that the ENGINEER may approve, in writing, final
payment to the contractors.
The ENGINEER shall not be responsible for the acts or omISSIOns of the
contractors, any subcontractor, or any of the contractors' subcontractors, agents,
or employees or any other persons performing any of the work under the
construction contracts, or of others.
3.5.10
Furnish the OWNER a set of reproducible record drawings for the construction
contract showing those changes made during the construction process, based on the
marked up prints, drawings and other data furnished by the contractor and/or the
OWNER to the ENGINEER and which the ENGINEER considers significant in
accordance with Section 01300 of the Contract Documents.
3.5.11
Furnish three additional copies of reports, permits, and of drawings and Contract
Documents for use by the contractors in performing their work.
3.5.12
Construction Quality Control Testing
All quality control testing will be performed by the contractor in accordance with
the documents.
3.6
Resident Project Services
No Resident Project Services, supplementing OWNER personnel activities, shall
be provided for the project. The OWNER will provide a full time inspector on this
project who will communicate with the ENGINEER.
SECTION 4
SUPPLEMENTARY SERVICES OF THE ENGINEER
4.1 If authorized in writing by the OWNER prior to the rendering of such services, the
ENGINEER will furnish or obtain under subcontracts, supplementary services of
the following types which will be paid for by the OWNER as described in
SECTION 6, Paragraph 6.1.2.
4.2.1 Additional services due to significant changes in the scope of the project or its
design including, but not limited to, changes in size, complexity, character of
construction or due to time delays in initiating or completion of the work as
described herein.
4.2.2 Additional services in connection with the project including services normally
furnished by the OWNER as described in Section 5 herein and services not
otherwise provided for in this Amendment.
4.2.3 Preparing to serve and serving as an expert witness for the OWNER in any protest,
litigation, or other proceeding involving the project.
4.2.4 Additional engineering services required by revisions to regulations (after the date
of this Amendment) as applicable to the Florida Department of Environmental
Protection, the St. Johns River Water Management District, or other regulatory
agency requirements.
4.2.5 Provide, through a subconsultant, additional surveying services if required or
requested by the OWNER.
4.2.6 Provide, through a subconsultant, soils investigation services if required or
requested by the OWNER.
SECTION 5
THE OWNER'S RESPONSIBILITIES
5.1 The OWNER will:
5.1.1 Advise the ENGINEER of his requirements for the project and designate a person
to act as the OWNER's representative with respect to the work to be performed
under this Amendment, and such person shall have complete authority to transmit
instructions, receive information, interpret and define the OWNER's policies and
decisions pertinent to the work covered by this Amendment.
5.1.2 Guarantee access to and make all provision for the ENGINEER to enter upon
public and private lands as required for the ENGINEER to perform his work under
this Amendment.
5.1. 3 Provide data requested that is reasonably available on the existing utility systems,
population and projections, land use and planning information.
5.1.4 Provide personnel to locate facilities and mow, trim, or otherwise make them
accessible for inspection and surveying.
5.1. 5 Examine all studies, reports, sketches, and other documents presented by the
ENGINEER and render decisions pertaining thereto within a reasonable time so as
not to delay the work of the ENGINEER.
5.1.6 Obtain approval of all governmental authorities having jurisdiction over the project,
and such approvals and consents from such other individuals or bodies as may be
necessary for completion of the Project.
5.1.7 Furnish, or direct the ENGINEER in writing to provide at the OWNER's expense,
soils investigations if advised in writing by the ENGINEER that they are necessary
or advisable.
5.1.8 Furnish, or direct the ENGINEER in writing to provide at the OWNER's expense,
necessary additional services as stipulated in Section 4 of this Amendment, or other
services as required.
5.1.9
Provide such legal, accounting, and insurance counseling services as may be
required for the project, and such auditing services as the OWNER may require.
5.1.10
Give prompt written notice to the ENGINEER whenever the OWNER observes or
otherwise becomes aware of any defect in the Project.
SECTION 6
PA YMENT
6.1
PA YMENT
Payments for services and expenses of the ENGINEER to be as set forth below:
6.1.1 Compensation paid ENGINEER for services described herein and rendered by
principals and employees assigned to the Project will be as described below. The
fee for the engineering design and permitting scope of services described in Section
3.2 and 3.3 shall be $12,600.00. In addition, there are outside consultant fees for
Surveying services in the amount of $13,410.00. The fee for the bidding services
described herein shall not exceed $3,000.00 and can be authorized separately by
the OWNER. The fee for the limited construction administration services shall not
exceed $6,000.00 and can be authorized separately by the OWNER. The total
project amounts to a "not to exceed" fee of $35,010.00
6.2 REIMBURSED EXPENSES
6.2.1 Expenses for items not specifically valued herein are to be reimbursed to the
ENGINEER at the actual cost thereof. Said expenses shall include transportation
and subsistence of principals and employees, when traveling in connection with the
Project, toll telephone calls, telegrams and similar project-related items.
6.2.2 The OWNER will make prompt monthly payments in response to ENGINEER's
monthly statements without retention for all categories of services rendered under
this Amendment and for reimbursable expenses incurred.
6.2.3 Charges for the services rendered by principals and employees as witnesses in any
litigation, hearing or proceeding in accordance with Paragraph 4.1.4 will be
computed at a rate of $400.00 per day or any portion thereof.
6.2.4 If this Amendment is terminated during prosecution of the services prior to
completion of the services of Section 3, payments to be made in accordance with
Paragraph 6.1.1 on account of that and all prior work under this Amendment shall
be due and payable, and shall constitute total payment for services rendered. In
addition, upon termination, the ENGINEER shall be paid for any Additional
Services authorized and rendered under Section 4.
6.2.5 The ENGINEER shall promptly begin work on the services authorized by this
Amendment upon receipt of notice to proceed from the OWNER.
SECTION 7
GENERAL CONDITIONS
7.1
Since the ENGINEER has no control over the cost of labor, materials, or
equipment, or over any construction contractor's method of determining prices, any
opinions of probable construction cost which may be provided in the services of
this Amendment are made on the basis of his experience and qualifications and
represent his best judgement as a design professional familiar with the construction
industry, but the ENGINEER cannot and does not guarantee that bids or the
construction cost will not vary from opinions of probable cost prepared by him.
7.2
The OWNER and the ENGINEER each binds himself and his partners, successors,
executors, administrators and assigns to the other party of this Amendment and to
partners, successors, executors, administrators, and assigns of such other party in
respect to all covenants of this Amendment. Nothing herein shall be construed as
creating any personal liability on the part of any officer or agency of any public
body which may be a party hereto, nor shall it be construed as giving any rights or
benefits hereunder to anyone other than the OWNER and the ENGINEER.
SECTION 8
8.1
The ENGINEER agrees to prosecute the work in a timely manner until the Project
is completed.

Dear Terry,
We are pleased to submit our revised proposal for surveying services on the above referenced
project.
SCOPE OF WORK:
Provide a Topographic Survey in accordance with Chapter 61G17-6 F.A.C. to include the following:
1. Determine R/W limits based on recovered monumentation.
2. Locate all improvements and utilities, as evidenced by above ground features or as marked
by the designated utility company representatives.
3. Coordinate the utility locations.
4. Obtain spot elevations on natural ground and existing improvements, including cross-sections
at a minimum of 100' intervals.
5. Topographic coverage will be limited to the rights-of-way of that subdivision named above
and that 175' FPC easement adjacent to the West line of said subdivision bounded on the
North by the Westerly extension of Wildwood Drive and on the South by the connection point
at the South end of the triangular shaped pond at the North end of the City of Winter Springs
Wastewater Treatment Plant, located in Tract J, Plat Book 17, Pages 48 and 49.
6. Prior to the final submittal, (2) preliminary bluelines will be submitted for review and
comment.
Task I
The final product for the Greenspointe portion of the project will be one set of photo based mylars,
two certified blueline prints and an electronic file of the information that was gathered by
Southeastern Surveying and Mapping Corp. and added to photo based mylars.

Task II
The final product for the FPC easement portion of this project will be one set of mylars "not photo
based", two certified blueline prints and an electronic file of the information that was gathered by
Southeastern Surveying and Mapping Corp. This field effort will be coordinated with the city to
arrange for city personnel to mow this area prior to our mobilization as discussed.
Option A
Perform a Topographic Survey within a 10' strip lying in Tract I adjacent to the perimeter boundary
of Greenspointe. Approximately 3,400 linear feet.
