HomeMy WebLinkAbout1996 10 28 Consent Item D /" COMMISSION AGENDA ITEM D REGULAR CONSENT X INFORMATIONAL October 28. 1996 Meeting MGR/~EPT @ Authorization REQUEST: Land Management Department requesting Commission approval for the acceptance of the water, sewer, reclaimed water system, and improvements to Shore Road for public ownership and maintenance, Seville Chase. PURPOSE: The purpose of this Board item is to accept the water, sewer, reclaimed water system, and improvements to Shore Road for public ownership and maintenance. These improvements are located in Seville Chase (that property located to the south of Panama Road, east of Fisher Road, north of Dun mar Circle and west of the Florida Power Corporation Easement). APPLICABLE CODE: Code Section 9-76(b) Maintenance Bond. When requesting to record a plat, for which the improvements have been installed, inspected and approved by the City Engineer, and when the City is being asked to accept such improvements, the subdivider will provide a maintenance bond payable to the City guaranteeing the performance of required and installed improvements for two (2) years after the date of completion and acceptance by the City, executed and enforceable in the same manner as the corporate or surety completion bond. The bonds will be ten (10) percent of the estimated construction cost of all improvements to be owned and maintained by the City. As an alternative to the provision of a corporate or surety bond, the subdivider may provide the deposit of equivalent cash in an institution, drawn in a form approved by the City Attorney. October 28, 1996 CONSENT AGENDA ITEM Page 2 FINDINGS: 1) Seville Chase was approved for recordation by the City Commission at their meeting of August 26, 1996. 2) Seville Chase has been inspected by the City Engineer, Fire Department, Police Department and the Utility Department. All departments found the work to be acceptable. The City Engineer has requested that Shore Road deficiencies be corrected and is monitoring this on a daily basis. The corrections are scheduled to be completed prior to the Commission Meeting date. 3) The City Engineer has determined that the construction costs for the improvements to be accepted are $553,561.92 (10% of this cost being $55,356.71). 4) The developer has furnished a Maintenance Letter of Credit in the amount of $55,357.00. RECOMMENDA TION: The recommendation is that the City Commission approve the acceptance of the water and sewer system, the reclaimed water system and the Shore Road improvements for public ownership and maintenance. The work in progress is receiving a daily inspection by the Engineering Department's Construction Inspector, Zynka Perez. From my conversations with the contractor and Zynka, I anticipate the remaining work will be complete in a few working days from now. If, for any reason, the work is not complete by October 28, 1996, or if it is expected to take longer than October 28, 1996, I will immediately notify you. Horatio Avenue Suite 260 Maitland, FL 32751 RE: Seville Chase - Shore Road Deficiencies Need Correction Dear Charley: It has become apparent that erosion corrective action, in the swale area on the west side of Shore Road and where this swale intercepts the creek, needs revisi ting. This area has eroded aaain, allowing a large quantity or sand to wash into the creek and the adjacent wetland area. . The following items are technically not complete: 1. "Please remove the accumulated sand that has w2shed into the creek a t the north end of Shore Road, on both ends of the creek culvert." (September 13, 1996 punch-list item #7) 2. "Please place hay bales, at the north end of the Shore Road swales, to prevent wash-outs into the creek unti.1 .grass is established." (September 13, 1996 punch-list item #9) Use rip-rap instead of hay bales. ~ection 9-160, of the Land Development Code (LDC), states in part; "In certain areas, sodding and other erosi on protecti on measures may be required" ~ The Public Works/Utility Director's letter, dated 199B", states in the Stormwater comments; "The Ci ty will right to require sodding wherever an area that is mulched becomes eroded." Deficiencies October II, 1996 page 2 The swale, south of the check dam on the west side of Shore Road just south of Stoner Road, needs to be redefined in accordance with the approved engineering plans. It appears the check dam is higher than the west berm of the swale and the bottom of the swale is not quite deep enough. This causes the water in the swale to reroute to the wetland, along the side of the road, eroding the west side of the swale. This must be corrected. Please have the contractor contact this office at 327-8397, with a schedule for repair, as soon as possible. MARK L. JENKINS, P.E. On this date, at approximately 2:30 P.M., I called Ms. Sue White of People's First Community Bank. She verified that this letter of credit was valid and issued by their bank. The total construction cost for the improvements that the City will be accepting is $553,561.92. Therefore, ten percent (10%) of this is $55,3567,19. The Letter of Credit is issued in the amount of $55,357.00. See attached City Engineer Mto dated September 24, 1996. (copy of letters attached) The off-si te infrastructure amount, for Shore and Fisher Roads, is stated as $136,474.05 for a total. The on-site infrastructure amount is stated to be $417,087.87 as:a total. I accept these figures and recommend they be used as the amounts for the Maintenance Bond calculation.
