RESOLUTION NUMBER 2006-23
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
OF WINTER SPRINGS, FLORIDA, SUPPORTING
LEGISLATION TO MAKE DRIVER EDUCATION
MANDATORY IN PUBLIC HIGH SCHOOLS; PROVIDING
FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, traffic accidents are the leading cause of injury and death among teenage
drivers between the age of 16-19; and
WHEREAS, Florida Statutes 1003.48 "Instruction in operation of motor vehicles"
states: "a course of study and instruction in the safe and lawful operation of a motor vehicle
shall be made available by each district school board to students in the secondary schools in
the state. The district school board shall prescribe standards for the course required by this
section and for instructional personnel directly employed by the district school board"; and
WHEREAS, driver education is offered as an elective in public high schools in the State
of Florida; and
WHEREAS, due to resource constraints, driver education in most public high schools in
the State of Florida includes classroom instruction and simulation training but not behind-
the-wheel training and as a result, many teenage drivers are unable to afford to pay for
private classes and behind-the-wheel training or turn to parents who lack the qualifications to
properly meet this need; and
WHEREAS, under Florida Statutes 318.1215, Dori Slosberg Driver Education Safety
Act states "a board of county commissioners may require, by ordinance, that the clerk of the
court collect an additional $3 with each civil traffic penalty, which shall be used to fund
driver education programs in public and nonpublic schools. The ordinance shall provide for
the board of county commissioners to administer the funds, which shall be used for
enhancement, and not replacement, of driver education program funds. The funds shall be
used for program receiving funds pursuant to this section shall require that a minimum of 30
percent of a student's time in the program be behind-the-wheel training;" and
WHEREAS, the City of Winter Springs supports the continuing efforts of the public
schools in the State if Florida to ensure that teenage drivers learn to be responsible and safe
drivers.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, FLORIDA:
SECTION I - That this Resolution urges state legislation to be enacted to make driver
education, including behind-the-wheel training, mandatory for teenage drivers in public high
schools in the State of Florida and to provide funding for the incremental costs of this
mandate.
SECTION II - That this Resolution supporting MANDA TORY DRIVER
EDUCATION IN PUBLIC HIGH SCHOOLS be recorded upon the public records and
Minutes of said City Commission of the City of Winter Springs, Florida.
