Meeting
REQUEST: General Services Department (Land Management Division) requesting
Commission approval of Ordinance No. 618 to vacate a portion of the Flamingo
Avenue right of way, a planting easement and utility easements on City owned
property. Action at the meeting of April 22, 1996 is for First Reading of this
ordinance. Second Reading and adoption will be in May 1996.
PURPOSE: The purpose of this Board item is to cure existing easement violations and to
vacate existing easements and right of way located on City owned property which
will allow more flexibility in the future use of the property. This property is
located between North Moss Road and North Fairfax Avenue and is part of Public
Works/Utility Department and Fire Station No. 24 Complexes.
FINDINGS:
1) Research of records does not show that the utility and the planting easement
located within Block 15 have ever been vacated. If this is indeed correct, it
appears that Fire Station No. 24 is built on these easements. The vacation of
these easements would make Fire Station No. 24 legal.
2) All concerned utility companies have reviewed the utility easements proposed
to be vacated and have offered no objection to this action.

RECOMMENDA TION:
It is recommended that the Commission approve the First Reading of this
ordinance and at a later meeting approve the Second Reading and Adoption of
the ordinance.

easement RIW as described herein; 1.) THAT FOURTEEN (14) FOOT UTILITY
EASEMENT LOCATED ENTIRELY ON BLOCK 15; AND, 2) THAT FOURTEEN
(14) FOOT UTILITY EASEMENT LOCATED ON BLOCK 16, COMMENCING
FROM THE SOUTHERN LOT LINES OF LOT 5 AND 16, EXTENDING TO THE
NORTHERN LOT LINES OF LOTS 1 AND 20 AS RECORDED IN NORTH
ORLANDO PLAT BOOK 12, PAGES 10 AND 11

The city's utility department does not have, nor do we foresee a need to construct water or sewer
lines within the 14 foot utility easements located entirely on Block 15, and the 14 foot utility
easement located on Block 16, commencing from the southern lot lines of Lot 5 and 16,
extending to there northern lines of Lots 1 and 2.
The utility department has no objection to the abandonment of these utility easements.
