Meeting
REQUEST: General Services Department (Land Management Division) requesting
Commission approval for the acceptance of improvements for public ownership
and maintenance, Tusca Oaks Phase II.
PURPOSE: The purpose of this Board item is to accept the improvements (infrastructure and
retention/detention ponds within the banks only) for public ownership and
maintenance. These improvements are located in Phase II of the Tusca Oaks
subdivision (that property located to the north of the Florida and Light Power
easement and south of the Florida Power Corporation easement, bounded by
Winter Springs Boulevard and Northern Way).
APPLICABLE CODE:
Code Section 9-76(b) Maintenance Bond. When requesting to record a plat for
which the improvements have been installed, inspected and approved by the city
engineer and when the city is being asked to accept such improvements, the
subdivider shall provide a maintenance bond payable tot he city guaranteeing the
performance of required and installed improvements for two (2) years after the
date of completion and acceptance by the city, executed and enforceable in the
same manner as the corporate or surety completion bond. The bond shall be in the
amount often (10) percent of the estimated construction cost of all improvements
to be owned and maintained by the city. As an alternative to the provision of a
corporate or surety bond, the subdivider may provide the deposit of equivalent
cash in an escrow account with the city, or a letter of credit drawn on an approved
institution, drawn in a form approved by the city attorney.

FINDINGS:
1) The plat (both phases) was approved for recording by the Commission at their
meeting of November 28, 1994.
2) Phase I improvements were accepted for public ownership and maintenance by
the Commission at their meeting of April 24, 1995.
3) Phase II has been inspected by the Fire Department, Police Department, Utility
Department and the City Engineer. All found the work acceptable.
4) The City Engineer has determined that the construction cost for Phase II to be
$308,214.05 (10% being $30,821.41).
5) A Maintenance Letter of Credit, issued by Suntrust Bank, Atlanta, in the
amount of $30,821.41 has been filed with the City and sent to the City Attorney for his legal
reVIew.
RECOMMENDA TION:
The recommendation is that the Commission approve the acceptance of the
improvements (infrastructure and retention/detention ponds within the banks only) for public
ownership and maintenance.

satisfactory to this office. Please refer to the City Engineer Memo dated April 12, 1996 verifying
the construction cost of$308,214.05 (10% equates to 30,821.45, the amount of the letter of
credit). This should be an agenda item for the Commission Meeting of April 22, 1996.

The fire hydrants in the above referenced development have been inspected and meet
City requirements. The inspection results are attached, and no additional inspections will
be required in this Phase by the Fire Department.

SUBJ: Reserve at Tuscawilla all phases, and Tusca Oaks II.

I have received the memo and inspected both Tusca Oaks Phase II and
Tuscora Road include Reserve with all Phases. I have no other
comments at this time.
However, the Reserve Phase II is going to be gated, and none of the
gates or electronic are in place. Is the new gated community going
to fall under the direction of Fire Department for access codes, or
are we still doing the gate inspection and code requirement.

The construction cost amount of $424,049.15, listed in my
April 11, 1996 memo should be disregarded as in error. The
corrected amount is $308,214.05, which is the same as my April 4,
1996 memo on this subject matter. Incorrect and conflicting
documents, submitted by the engineer and developer, are the basis
for the above error.
I accept the $308,214.05 amount and recommend that it be used
to calculate the required Maintenance Bond or Letter of Credit.
If you have any questions, please let me know.

An "as-built" inspection was performed at the subject site on
March 25, 1996, and a reinspection to clear punch-list items was
performed on Apri 1 2, 1996. This phase was found to have been
constructed in general conformance to the approved engineering
plans.
