Meeting
REQUEST: General Services Department (Community Development Division) Requesting
the Board to transmit the Minter Large Scale Comprehensive Plan
Amendment to the Florida Department of Community Affairs (DCA) for review.
(See Attachment "1" - City Manager Memorandum)
PURPOSE:
The purpose of this Board item is two-fold:
1. To develop an independently, objectively derived base of information to
assist the City to determine if the proposed amendment could be found to
be in compliance with the City's annexation policies, Comprehensive Plan
and Land Development Regulations
2. Iffound to be in compliance, to assist the City in determining the
advisability of approving or disapproving annexation.
APPLICABLE LA W/PUBLIC POLICY:
Following is a listing of the Law and Public Policies applicable to this
matter:
1. The Commission decision to transmit this item for review by DCA,
and other state agencies is a discretionary legislative decision. As such, the
Commission is not compelled to make the decision to transmit on the basis
of quasi-judicial proceedings, or to take any subsequent action relative to
adoption of the amendment, or approval of annexation.
2. The provisions of 163.3184 and 163.3187 Florida Statutes, 9J-l1.006
Florida Administrative Code, Section 15-30 Code of Ordinances of the
City of Winter Springs govern the procedural manner in which the review
will be completed.

3. The Seminole CountylWinter Springs Joint Planning Area Map and Report
adopted by the City Commission on August 14, 1995 establishing the
Battle Ridge area to be included in the area to be considered for
annexation.
4. Annexation polides stipulated in the Land Use, the Potable Water and
Intergovernmental Coordination Elements of the City of Winter Springs
Comprehensive Plan, and other relevant provisions of the City's
Comprehensive Plan.
CONSIDERATIONS:
This agenda item is needed to determine the disposition of the request of the
property owners to amend the Future Land Use Map of the City of Winter Springs
Comprehensive Plan to allow "Lower Density Residential" uses not to exceed 3.5
units per acre on the Battle Ridge property.
November 09, 1995 - The Local Planning Agency held a public hearing and
recommended the City Commission not transmit the
proposed amendment to the Florida Department of
Community Affairs and other state agencies for their
review and comment.
January 11, 1996 - This agenda item was scheduled for a hearing before the
City Commission, but was tabled to give the new City
Manager an opportunity to become familiar with the
record ofthis matter.
ISSUES:
1. Why is the City Commission being asked to transmit the Minter proposal to
the Florida Department of Community Affairs by the City staff when the
City's Local Planning Agency voted to recommend against the proposal?
a. The recommendation of the Local Planning Agency is advisory only
to the City Commission. The staff is not obligated to agree with
the Planning and Zoning BoardILocal Planning Agency in its
recommendations to the City Commission. The staff is obligated
to make their professional evaluations and recommendations to the
City Commission when this differs from the Planning and Zoning!
Local Planning Agency.

Additionally, the staff feels the Local Planning Agency may have
failed to take into consideration the need to evaluate the proposal
made to the City upon the provisions of the City's annexation
policies, Comprehensive Plan and Land Development Regulations
rather than those of the county. A review of the public record
reveals a preponderance of discussion relating the proposal to
county policy. The record is virtually silent on discussion relating
the proposal to City policy.
c.
Staff believes that many issues were left open without adequate
closure based upon the application of relevant facts, public policy
and law. For example, numerous important issues were raised by
parties on both sides of this issue. Comments were made on the
record that adequate information was not available to lend closure
to these issues. Additionally, the Local Planning Agency did not
make specific findings relative to the provisions of applicable public
policy and law consistent with recognized acceptable standards of
good practice in the deliberation of important land use related
matters by governmental reviewing bodies.
d.
In conclusion, the staff finds that the Minter proposal
presented to the City deserves a fair evaluation on
its merits to determine if it can be found to be in compliance with
the annexation policies, Comprehensive Plan and Land
Development Regulations.
2. Concerns have been voiced that the proposed amendment and annexation
would be destructive of the environment.
a. The City of Winter Springs Comprehensive Plan adequately
addresses the protection of the environment as evidenced in the
Land Use and Conservation, and Intergovernmental Coordination
Elements of the City's Comprehensive Plan. This City's
Comprehensive plan was reviewed by various state agencies and
approved by the Florida Department of Community Affairs in 1992.
In addition the City has requirements for environmental protection
. within its Land Development Regulations.
b. The evaluation to be generated by DCA and the other state agencies
as a result of transmittal will further assure the City in determining
if the proposal can be found to be in compliance with the City's
Comprehensive Plan and Land Development Regulations.

3. The proposed amendment may lower the Level of Service on S.R. 434.
Current information presented on the trip generation from the proposed
project indicates no lowering of the Level of Service on S.R. 434 between
the Beltway and DeLeon Street for peak hour traffic; however, this will be
further analyzed by the state agencies and the City upon transmittal.
FINDINGS:
1. Transmission of the proposed amendment is consistent with annexation
policy of the City of Winter Springs.
2. The "comprehensive plan amendment application" has been reviewed and
found to be consistent with the provisions of state and local law related to
the transmittal of plan amendments to the Florida Department of
Community Affairs.
3. The City has adequate policies in its Comprehensive Plan to address
stormwater, which is a concern raised by citizens and various agencies.
4. The City has adequate policies in its Comprehensive Plan to address the
issue of wetlands, which is a concern of citizens and various agencies.
5. An urban pattern of development exists of single-family residential at 3 to 4
DU/acre within one (1) mile of the Minter property, suggesting that the
amendment proposal may be compatible with the surrounding area.
Battle Ridge, Carroll, Weaver, and Minter properties are requesting the
same density as that which exists.
6. The Florida Department of Community Affiars approved a similar land use
and density proposal for this land in the Comprehensive Plan of the
City of Oviedo.
Conclusions:
a. To date, the merits of the proposed amendment to the City have yet to be
adequately evaluated on the basis of compliance and consistency with the
City of Winter Springs' annexation policies, Comprehensive Plan and Land
Development Regulations.
b. Transmittal of the proposed amendment is needed to assist the staffin
making intelligent objective findings of fact in a manner consistent with
laws and good practice relative to the proposed amendment's compliance
and consistency with the City of Winter Springs annexation policies,
Comprehensive Plan and Land Development Regulations, and
determinations relative to the desirability for annexation.

AL TERNA TIVES:
The City Commission has two alternatives as follows:
1. Approve transmittal. The consequences of this action are as
follows:
a. Upon conclusion of the analysis staff will return to the Board with
recommendation to approve or disapprove the proposed
amendment based upon point by point findings of fact relative to
provisions oflaw, applicable to the amendment and issues raised in
the process of analysis.
b. If the evaluation finds that the proposal cannot be brought into
compliance with the City's Comprehensive Plan and Land
Development Regulations, City staff will recommend
to the City Commission denial of the amendment proposal.
c. The evaluation will determine that the proposal can be found to be
in compliance with the City's Comprehensive Plan and Land
Development Regulations in which case the City could move to the
next step of determining if it desires to annex the area, or not to
annex the area.
d. If the City finds it to be desirable to annex the area, the owner will
in all likelihood request the City to annex the area, and then the
owner will develop the area in accordance wit this proposal.
e. If the City decides it is not desirable to annex this area, the owner
will in all likelihood request the City of Oviedo to annex this area,
the owner will in all likelihood request the City of Oviedo to annex
the property.
2. Deny trans~ttal. The likely consequences of this action are as follows:
a. The owner will not pursue any additional annexation.
This consequence is not likely. The owner desires to annex the
property. The City of Oviedo has indicated this area for annexation
in its comprehensive plan on Map 1-3 "2010 Long Range Land
Use" and has indicated this area for LDR "Low Density
Residential" (1-3.5 du/ac) - the same designation that the City of
Winter Springs has in its Comprehensive Plan and, that has been
requested by the property owner.

b. The owner will pursue annexation. As discussed above there is
reason to believe that the owner will pursue this course of action -
requesting annexation into the City of Oviedo.
c. The owner will present another proposal to the county.
d. The owner will not pursue any additional development of the
property. Our understanding is that this is not a likely course of
action based upon prior dicussions with the owner and the property
owner's representative.
RECOMMENDATION:
Based on the findings discussed above, it is recommended the City Commission
consider approving the request by Harling, Locklin & Associates (representing
Ms. Mary Minter, property owner) for transmittal of the Large Scale
Comprehensive Plan Amendment (LG-CP A-4-96) to the Florida Department of
Community Affairs and other state agencies in accordance with 163.3184 Florida
Statutes and Section 15-30 of the City Code, for the purpose of:
a. Receiving an independently objectively derived base of information to assist
the City to determine if the proposed amendment could be found to be in
compliance with the City's annexation policies, Comprehensive Plan and
Land Development Regulations.
b. To assist the City in determining the advisability of approving or
disapproving annexation.
As stated, approval of this recommendation will not create an obligation on the
part of the City to take any further action regarding this proposal, nor does it
create any right on behalf of the applicant to require action by the City.
IMPLEMENTATION SCHEDULE:
Upon approval for transmission, the City will send copies of the proposed amendment to
the appropriate agencies as indicated in 163.3 184 F. S. and 9 J -11.006 F. A. C. According
to John Healey ofD.C.A., the Objections, Recommendations and Comments (ORC)
Report takes up to 90 days to send back to the local government from DCA. There is
then a period for response to DCA's ORC Report by the local government if it chooses to
respond with further data and clarifications and "negotiation in good faith" with DCA on
the various issues etc. raised. Following this is action by the local government to adopt,
adopt with changes, or not adopt the proposed amendment.

Should the amendment be adopted by the local government, it does not take effect until
DCA issues a "NOTICE OF INTENT" to find the amendment in compliance with the state
comprehensive plan, ECFRPC's Regional Policy Plan, and the City's Comprehensive Plan
[per 163.3189(2)(a) F.S.]. The NOTICE OF INTENT is issued by DCA within 45 days
of receiving the adopted amendment from the City.
Depending on the complexity of the amendment, the whole process normally takes from
six (6) to eight (8) months.

The effect would be to allow development of the property
between 1.1 to 3.5 dwelling units per acre.

The property owner has requested the City of winter
Springs to annex his property into the City and has
requested the City provide sewer and water service. The
City has indicated it is very interested in providing
these services and the other urban services presently
provided to all other properties within the city.

This section of the Orlando Metropolitan Area
(north and east) is experiencing tremendous
growth. The recent completion of S.R. 417
(the beltway), the widening of S.R. 434 and
the expansion of the cities of winter springs
and Oviedo in the region has provided for many
housing opportunities for a variety of income
levels. Some of the major employers that have
added to the demand for housing in this area
through new location or expansions are
university of Central Florida, Oviedo crossing
Shopping Mall, the Quadrangle Office Park and
the Central Florida Research Park.
b. Land requirements for the total estimated
housing need of the jurisdiction:
The low-density designation for this site will
not allow for density of more than 3.5
DU/acre. It is anticipated that much more
land will be needed to house the population of
this area than can be afforded by the subject
property.
The City's Comprehensive Plan indicates the
need for 1,150 additional acres for
residential development by 2010 to allow
development of up to 6,800 dwelling units with
an average dens i ty of 5. 91 DU / acre. This
comprehensive plan amendment involving 28
acres for residential development, will in
part address the City's need for additional
land.

areas are dominated by maidencane, giant
cutgrass, sawgrass, and rushes. The
understory includes fetterbush, running oak,
lopsided indiangrass, inkberry, saw palmetto,
pineland threeawn, waxmyrtle, chalky bluestem.
These vegetation types may be disturbed in any

BLACK HAMMOCK FLIER
A recent flier from residents of the Black Hammock has raised several issues that need
a response. The purpose of the Black Hammock flier appears to imply that a decision
on annexation by the Winter Springs Commission has supposedly been made. The
purpose of this response is to present the facts on this issue and to update the citizens
of the Winter Springs Commission position on this issue and on annexation in general.
First. The Black Hammock issue has not been discussed by the Winter Springs
Commission in any depth or length. The only time this issue was on the Commission's
agenda was January 22. The item was pulled from the agenda by the Mayor to give
the new City Manager, Mr. Ron McLemore, the opportunity to discuss this issue with his
staff prior to bringing this before the Commission.
Second. The Winter Springs Commission has not taken any position on the Black
Hammock annexation issue. The Commission had directed the previous City Manager,
Mr. John Govoruhk, to investiage annexation possibilities of contiguous unincorporated
land. As of this date the Commission has not directed the City Manager to stop this
investigation and the Black Hammock areas meets the guidelines established by the
Commission for research and investigation.
Third. The Black Hammock flier imples that the Commission was haphazardly
progressing with annezxation without evaluation the impact the Black Hammock land
may have on the City. The implicaton that neither the infrastructure or financial
resources were adequate to provide for this area to be annexed. Since the
Commission has not heard any presentations from City Staff on this land it is
presumptuous to imply that property taxes would be increased if annexation were to
occur. This Commission has lowered taxes for two consecutive years and has been
fiscally responsible in the spending of your tax dollars. They deserve credit for this type
of governance and any implication that they have changed should be based on facts
and not hearsay.
Fourth. The current City Commissioners have resolved two very difficult issues
regarding zoning, The Early property in the Ranch Lands and the mall. The mall issue
was the direct result of a previous commission not annexing the Duda property in the
80s. If this had been accomplished then the City of Winter Springs would have had a
say on the zoning of this property and not having to take what the County and Oviedo
have decided. In this regard annexation of the Duda property could have had a
significant impact on the use of this land. It appears to me that it was a wise and
prudent decision for the Commission to continue to investiage future annexation of
contiguous land to prevent such an occurrence from happening again.
Fifth. The current Commission has always attempted to negotiate the lowest densities
within the current growth management laws and procedures. The flier assumes the
Commission will approve a density that is not compatible with surrounding areas and do
so without public input or further discussions in an open meeting. To imply this is totally
irresponsible and without merit. This tactic has been used by other groups in our City to
misinform and mislead the public. I would like to believe that this was not the intention
of the Black Hammock Association. I have confidence that this issue will be thoroughly
evaluated by the Commission and all parties will have the opportunity to ask questions
and speak there minds.
Sixth. The fliers appear not to have been distributed throughout the City but appeared
to have been only distributed in the Tuscawilla subdivision. Winter Springs is
composed of over 26,000 citizens who live in many different areas and subdivisions
within the City limits. This distribution leaves some questions unanswered and I hope
the this was not an attempt to divide the City on an issue that effects all citizens.
The Black Hammock annexation issue will be discussed in an open meeting with public
input. This issue will be evaluated within the framework of the City Charter and laws of
the State of Florida. I encourage all interested citizens to attend these meetings and
provide input to the Commission. The Black Hammock issue will be on the agenda for
the meeting.

Re: Battle Ridge, Carroll, Weaver, Minter, Plan Amendments
This is a follow-up memorandum to the memorandum of February 23, 1996 contained in your
Agenda Package relative to the Battle Creek, Carrol, Weaver and Minter Property Plan
Amendments. In that memorandum I advised you that I would have a memorandum that I
would like to publish in the record regarding the framework in which I believe we should
conduct the transmittal process if the Board should decided to move in that direction.
The four plan amendments represent some 365.6 acres of land, 297 in Battle Ridge, 13.6 in the
Carrol property, 27 in the Weaver property and 28 in the minter property.
Preliminary review reveals, of the 365.6 acres ofland being proposed for plan amendment and
annexation, approximately 113.2 will be developable, including 50 acres in the Battle Ridge
property, 8.2 acres in the Carrol property, 27 acres in the Weaver property and 28 acres in the
Minter property.
This would result in approximately 30.9 % of the property being developable, including 17% of
the Battle Ridge property, 60% of the Carrol property, 100% of the Weaver property and 100%
of the Minter property.
The decision to recommend transmittal of the proposal was made after an extensive review and
analysis of the record of this matter.
GOALS: If the Board decides to move forward with the transmittal it appears to me that
four goals need to be accomplished as follows:
1) That at the conclusion of the process everyone feels good about the open, fair,
disciplined manner in which the process was carried out regardless of what the
final recommendation might be.
2) The final recommendations will be based upon compliance with the City's
Comprehensive Plan based upon specific findings of fact applied to the revelent
law and good practice.
3) That the final decision provides an adequate measure of protection of the chosen
life style of the surrounding property owners based upon specific finding of fact
and good practice.
4) That the final decision provides an adequate measure of protection of the Lake
Jesup Ecosystem based upon specific findings of fct nd good practice.
5) That the final decision is acceptable with the economic and life style interest of
the residents of the City of Winter Springs.
If the Commission decides to move ahead with the transmittal and consideration of annexation
the Commissioners will eventually be faced with deciding two issues as follows:
1) Can the proposed annexation be found to be in compliance with the Comprehensive
Plan, and;
2) Is the annexation in the overall best interest of the City?
Since this is a discretionary legislative proceeding all of these issues can be merged at the final
public hearing of the Plan Amendment Process, or be taken into consideration in two separte
proceedings. It is my recommendation at this time that we make separte findings and decisions
on both questions, but both questions be addressed at the same final public hering date.
Due to the intensified concerns of the various interest groups in this project, I think it is fair to
advise that the owners may be held to a higher burden of proof in this project than might
otherwise be required of a project in this type of process in order to facilitate specific findings of
fact in all pertinent provisions of law and all issues. For example:
1 ) Wetland jurisdiction lines
2) Endangered species
3) Economic feasibility
4) Transitional land uses
5) Traffic impact
6) Dedication of Public Conservation Lands
Additionally it is quite possible that the final plan that the Staff would be willing to recommend
may be different from that proposed, or that Staff may not be able to recommend any form of a
plan that Staff believe is mutually acceptable to the property owners and the City. Relatedly, it
is possible that the Staff may recommend dropping one or more of the properties from
consideration.
MEET AND CONFER STEERING COMMITTEE
In order to fascilitate open communications and confidence in the analytical process, I am
recommending that the Commission authorize me to appoint a Steering Committee that will
meet and confer on a regular basis during the process. No decision would be made in these
meetings. I am recommending that the Committee be composed of the following:
The City Manager
1 member from City Staff
1 member from County Staff
1 member from the Friends of Lake Jesup
1 member from the Black Hammock Property Owner's Association
1 property owner from each property and/or their designees
EX PARTE COMMUNICATION
Although this is not a quasi judicial process, I would like to recommend that the members of the
City Commission voluntarily agree to Ex Parte Rules during this process. I believe, in this case
this agreement would help the process.

We have reviewed the site plan signed and sealed January 24, 1996 and have found all previous
comments satisfactorily addressed. A completed Industrial Waste Permit application will have to
be provided with the meter application. We recommend approval of the proposed site
improvements.
The proposed funeral home use will require 2 Equivalent Residential Connections of water and
sewer capacity at $2,282 each for a total capacity charge of $4,564. There will be a charge for
the Hayes Road service line jack and bore that will be based on actual costs of time and materials.
This is generally around $150. Other fees are the $90 meter fee, $200 customer deposit
(refundable after 24 months of good payment history), $20 sewer inspection fee, and $10
application fee.

Medical Patient Transport Report
Reporting Period 15 January 1996 - 31 January 1996
On the 15 January 1996 at 8:00 AM the Fire Department began transporting
medical patients to the hospital. Prior to this time all patients were transported
by Lifefleet Atlantic Ambulance Service. On the Fire Department monthly report
for January 1996 Lifefleet Atlantic Amulance up till the 15th of the month
transported 29 patients from the City to the hospital. After the 15th of the month
the Fire Department transported all City patients with no assistance required
from any other transport agency.
During the report period the following information is submitted for accounting
purposes for the Department Transport Service.

. Still working with Police Department on miscellaneous troubleshooting
items and recommendations on hardware and software needs.
· Worked with Building Department on printer and network problems. Also
helped them with hardware and software needs/questions
· Miscellaneous City hardware/software troubleshooting and setup issues were
taken care of including software upgrades.
· Attended Florida Innovations Group's Internet Seminar at Valencia
Community College in Orlando (West Campus) on January 25, 1996.
· Attended a Colamco Seminar on January 30, 1996 in Longwood on
computer networking in the 90's. The company making the presentation was
Attachmate. This was an extremely informative seminar.

Public Works Monthly Report - January
Operations - During the month of January there were 20 Right-of-Way inspections
and 47 Arbor permit inspections performed. 2 tons of asphalt were used for repairs
on Sheoah Boulevard, First Street, and Forest Circle. The 1994/95 resurfacing
contract with MacAsphalt finally completed. We should be ready to advertise for
bids on the 1995/96 resurfacing work by late February.
Mosquito spraying has been drastically reduced with the onset of cold weather and
several hard freezes that have occurred. A total of 90 feet of sidewalk was
replaced on Dogwood Court, Forest Circle, Mos.s Road, S. Edgemon Avenue,
Boxwood Circle, and Sheoah Boulevard. Handicap ramps were installed at
Northern Way and Winter Springs Boulevard. We picked up 100 railroad ties at no
charge from the contractor removing them from the railroad right of way. 17 curb
miles were cleaned with the street sweeper collecting % ton of sand/debris.
Seminole County opened bids for Tuskawilla Road Phase Two - Red Bug to Lake
Drive on January 31. Construction should begin around April/May.
Friends of lake Jesup - The January meeting focused on the Ordinary High
Water Determination of Lake Jesup. The OHWL defines the line between
sovereign lands of the State and private property. Some members of the Friends
are seeking an increase in the OHWL to further protect the lake. The DEP
representative has indicated that the OHWL will not change from elevation 3.2 MSL
based on their recent inspection of the lake perimeter.
Stormwater - The SJRWMD permit for the outfall modifications at 1207 Howell
Creek was received and bids will be opened on February 14. The SJRWMD
permit: was received for the ditch modifications at Old Sanford-Oviedo Road. The
permit for the Shore Road culvert replacement is still pending. The approval of the
low bid for these projects to Prime Construction Group, Inc. of Orlando for $97,500
is scheduled for the February 12 City Commission meeting. The Notice of Award
will be withheld until all permits are in hand.

Stormwater repairs were made on Shore Road/Coral Way and on Eagle Nest
Circle. The underdrain installation project on Eagle Nest Circle, and Golfpoint
Drive was closed out. Road rebuilding will be included in the pavement resurfacing
contract. The stormwater problems at Central Winds Park/Orange Avenue are
under review by the consulting engineer under the supervision of the City Attorney.
Transportation - Design continues on the Moss Road/Panama Road/Hayes Road
improvements. The finished field survey work was provided to the engineer for
preliminary layout. The preliminary design for the Moss Road bridge improvements
should be ready for review by mid-February. The Traffic Study is underway
although a supplement will be needed to expand the consultants scope of work.
Information that was originally thought to be available from the planner will have to
be compiled by the consultant.
Engineering - Site plan reviews were conducted for the Duncan Realty
Commercial Site (Hayes & 434), and The Oaks (Shepard and Edgemon Avenue).
Drainage complaints were received and addressed from residents at the
Wedgewood Tennis Villas, Winding Hollow Phase I and Dunmar Estates. The "as-
built" inspection punch list for The Reserve at Tuscawilla Phase /I is not yet
complete. The developer and engineer were notified to correct the "tearing" of the
pavement that is occurring on the newly constructed section of Tuscora Drive.
Construction inspection continues on Tusca Oaks Phase 2, Winding Hollow Phase
/I, and Howell Creek Reserve Phase /I. A preconstruction meeting was held for the
Seville Chase (Earley) project with construction starting within thirty days. A review
of the proposed LOR changes was completed and forwarded to planning.

WATER FACILITIES
The authorization for the construction of a second well at WTP #2 (Sheoah
Boulevard) is scheduled for February 12. We are recommending the contract be
awarded to American Drilling, Inc. of Lutz, FL for $130,000. The design continues
for the replacement of the water lines in North Orlando Fourth Addition (David
Street, Bennett Street...). The construction will be budgeted for FY 1996/97.
The water quality master plan study by Conklin, Porter, and Holmes Engineers, Inc.
Continues. The plan will determine what capital improvements are necessary to
improve the potable water quality and meet future regulatory requirements. The
design of the variable frequency drive at WTP #3 and generator relocation to WTP
#2 continues with a projected completion date of June 1, 1996.

WATER RECLAMATION FACILITIES
Shop drawings have been submitted for the Emergency Power Improvements
project by Prime Construction Group. This project includes the addition of a new
725 KW generator at the East WRF, upgrade of the West WRF generator to 725
KW, relocation of two generators at Lift Station #7/WTP#1, and modernization of
the electrical systems at both WRF's. Construction will begin March 4, 1996.
Construction of the $682,000 digester addition at the East WRF continues with an
estimated completion date of March 15, 1996. The 12" reclaimed water distribution
main on Third St./Moss Road/Bahama Road continues with an estimated
completion of the end of February, 1996.

Design continues on the East WRF reclaimed water pump station and storage tank
improvements. The civil and mechanical drawings are 90% complete and have
been released for electrical design work to commence. We expect to bid the
storage tank portion of the job by April 1 ,1996. Design continues on the reclaimed
water system for Highland Village 1 &2 (MacGregor Road) and North Orlando
Terrace Section One (Murphy Road/Boxwood Circle). Preliminary drawings should
be ready for review by mid-February. The design of the improvements to Lift
Station #7 continues.

ADMINISTRATION
Construction continues on Tusca Oaks Phase II, Winding Hollow Unit 2/ Phase 3
and Howell Creek Reserve Phase II. Development continues on Winter Springs
High School, Shepard Road Elementary, and S.R. 434 water main installation. The
new S.R. 434 water main should be completed in January and placed in service by
March.
Bids were opened on January 3, 1996 for the sale of two surplus blowers. No bids
were received. They will be placed in storage unitl a future need can be
determined.

This section of the Orlando Metropolitan Area
(north and east) is experiencing tremedous
growth. The recent completion of S.R. 417
(the beltway), the widening of S.R. 434 and
the expansion of the cities of winter springs
and Oviedo in the region has provided for many
housing opportunities for a variety of income
levels. Some of the major employers that have
added to the demand for housing in this area
through new location or expanisons are
University of Central Florida, Oviedo crossing
Shopping Mall, the Quadrangle Office Park and
the Central Florida Research Park.
b. Land requirements for the total estimated
housing need of the jurisdiction:
The low-density designation for this site will
not allow for density of more than 3.5
DU/acre. It is anticipated that much more
land will be needed to house the population of
this area than can be afforded by the subject
property.
The City'S Comprehensive Plan indicates the
need for 1,150 additional acres for
residential develpment by 2010 to allow
development of up to 6,800 dwelling units with
an average density of 5.91 DU/acre. This
comrpehensive plan amendment involving 25
acres for residential development, will. in
part address the City'S need for additional
land.
The City has very little land vacant for
additional residential development. Much of
the remaining vacant land is environmentally

sensitive. The influence or impact of the
beltway (GreeneWay S.R. 417), economic

Seminole County. If Figure I (based on the
Florida Natural Areas Inventory) indicating
generalized locations of specially designated
species does not show any such locations of
specially designated species on the property.

. No distrubance of wetlands is proposed. Any
such impacts will be in accordance with local,
state and federal guidelines. A portion of
the property is indicated as having wetlands.
The city through policies in the Conservation
and Land Use Elements of i ts Comprehensive
Plan requires protection of wetlands. For the
annexation, property owner requests a Future
Land Use Map designation of Lower Density
Residential (1.1 to 3.5 DU/acre). Proposed
development would ba a residential subdvision
with the usual disturbance associated with
construction of such a development.
c. The effect on vegetative communities:
Existing vegetation will be saved in
accordance with the City's land development
regulations.
According to the soils Survey of Seminole
county, the soils on this property indicate
the natural vegetation would consist mostly of
mixed stands of cypress, red maple, sweetqum,
cabage palm, sweetbay, and blackgum, longleaf
and slash pines and live and laurel oaks,
maidencane, giant cutgrass, sawgrass and
rushes. The understory includes lopsided
indiangrass, inkberry, saw palmetto, pineland
threeawn, waxmyrtle, bluestem, panicum, and
other grasses. These vegetation types may be
disturbed in any residential subdvision with
the usual disturbance associated with
construction of such a development. Until
such development is proposed the effect on
vegetative communities is difficult to
determine at this time. It should be noted

that the City's Comprehensive Plan requires
conceptual engineering proposals to include
identification and mapping of natural
resources within property intended to be
developed, which shall include an inventory of
plants and animals designated as endangered,
threatened or species of special concern and
associated habitat required for the species to
remain viable.

the developer. The intention of the City is
that private development will not incur a
fiscal impact on the city.

identified in other Comprehensive Plan
elements and relative priorities of those
needs:
There will be no fiscal impact to the city
with respect to the extension of sewer and
water lines. The City has a policy that "In
no event shall the city be required to pay the
cost of the installation of the water and
sewer trunk line system." [Sec. 9-261(b) City
Code]. similarly, the City does not pay for
required drainage, stormwater improvements
related to private development. There should
be no fiscal impact to the City with respect
parks and recreation since the city requires a
"contribution to the (recreation) system
proportionate to the magnitude of the new
subdivision or project", or "require
developers to supplement public recreation by
alloca ting pri va te parks on a proportional
