REQUEST: General Services Department (Land Management Division) Updating the
Commission on the Chelsea Parc Phase II, error on recorded plat
PURPOSE: The purpose of this Board item is to receive an update on the steps being taken to
alleviate the problems caused by the error found on the recorded of plat.
CONSIDERA TIONS:
Because of the error on the recorded plat, three (3) houses already built are
in Code violation and at least one (1) air conditioning unit supposedly
within the confines on a property is now partially on another property.

- City notified that Bolin is no longer General Partner of
Chelsea Parc at Tuscawilla - Bob Robinson is General
Partner as of January 2, 1996.
- LeBlanc called Robinson and told him of problem
- Property owners spoke at Public Input at Commission
Meeting - will be an Agenda Item on January 22,
1996.
- Meeting with developer and two (2) property owners -
all agreed to give developer until February 12, 1996
to solve problem.
- Commission Meeting confirmed that property owners
were in agreement for postponement until
February 12, 1996.
- Sent letter to Robinson reminding him of
February 12, 1996 meeting.
Because of the error in platting, the houses located on Lots 23, 24 and 25 are no longer in Code
compliance in that the houses now encroach into the side yard and utility easements, both
requiring three (3) feet. Also, the air conditioning unit for Lot 23 is now partially on Lot 24.
This is an issue now, but unless there is a solution, there will be difficulties ahead if the owners of
these properties attempt to sell their homes. The developer should have notified the City of the
error once found.
Section 9-26 and 9-27 of the Code gives the City Commission approval authority on recording
plats.

RECOMMENDATION:
Based upon the developers failure to comply with the Commissioners mandate of October
23, 1995 to cure the defects in the plat within ninety (90) days, it is recommended that the
Board authorize Staff to withhold building permits in Chelsea Parc at Tuscawilla Phase II
effective this date until such time that a replat satisfactorily curing the platting defects is
approved by the City Commission.
This recommendation is conditioned upon concurrence of the City Attorney and any
additional information that may be provided by the parties at the Commission meeting.
