REQUEST: Fire Department requesting City Commission consider Second Reading of
Ordinance 613.
PURPOSE: To provide for the financial protection and safeguards for the City of
Winter Springs, Florida, regarding the establishment and operation of the City operated
Emergency Transport System; providing for conflicts, severability and effective date.
CONSIDERA nONS:
A. December 11, 1995 - Regular Meeting City Commission
Commissioner McLeod suggested that another ordinance to Ordinance 608, that whenever
the first tax dollar subsidies are spent that the service (Fire Department Emergency
Transport System) will go out to public bid within 90 days. City Attorney Frank
Kruppenbacher said he would get with the Fire Chief and City Manager and bring a draft
ordinance back to the Commission.
B. January 8, 1996 - Regular Meeting City Commission
City Attorney Frank Kruppenbacher gave the Mayor and Commission a draft ordinance
that was a proposal of financial protection for safeguards on the Fire Department
Emergency Transport System. This will be Ordinance 613.

C. February 12, 1996 - Regular Meeting City Commission
First reading of Ordinance 613. The following changes were made: Section I - add "if the
City elects to extend the ordinance then Section II shall be considered by the Commission
at the time it considers passing a new ordinance." Section II - after the wording "..City
Budget.." , add" ..or at any tine thereafter..."
FUNDING:
No funding is required to finance this program.
Revenues generated from the Emergency Transport Service Fee of$184.63 per
transport, is anticipated to cover the expenses.
Expected revenues from January 15, 1996 through September 30, 1996 are
$91,023.00. Anticipated expenditures for the same period are $22,395.00.
Expected revenues for fiscal year 1996-1997 are $151,342.00. Anticipated
expenditures for the same period are $38,294.00.
RECOMMENDATION:
Approval of Second Reading of Ordinance # 613.
IMPLEMENTA TION:
Ordinance effective immediately upon passage and adoption.

AN ORDINANCE OF THE CITY OF WINTER SPRINGS

FLORIDA, PROVIDING FOR FINANCIAL PROTECTION
AND SAFEGUARDS FOR THE CITY OF WINTER
SPRINGS, FLORIDA, REGARDING THE ESTABLISHMENT
AND OPERATION OF THE CITY OPERATED
EMERGENCY TRANSPORT SYSTEM; PROVIDING FOR
CONFLICTS; SEVERABlLITY AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs, Florida, has upon
available information and data deemed it to be in the best interest of the citizens of the City that
it operate an emergency transport system; and
WHEREAS, the City Commission of the City of Winter Springs, Florida, has deemed it
important to the citizens of the City that the City's operation of an emergency transport system
be at a cost that is equal to and/or less than that of private industry, so that no public monies are
used to subsidize said system;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY
COMMISSION OF THE CITY OF WINTER SPRINGS,
FLORIDA, AS FOLLOWS:
SECTION I: That the City's operation of an emergency transport system shall
cease on or before September 30, 1997, unless the City Commission passes an ordinance
extending said operation; if the City. elects to extend the ordinance then Section II shall be
considered by the Commission at the time it considers passing a new ordinance.
SECTION II: That in the event it is determined by the City Commission during
the budget process for the 1997-1998 City budget or any time thereafter, that operation of a City
emergency transport system has resulted in an increase in the budget of the City's Fire
Department that was not off-set by the fees billed for the use of said system, the City shall

immediately invite bids/requests for proposals for the emergency transport systems operation
from private industry and the City's Fire Department.
SECTION III: That is any section or portion of a section or subsection of this
Ordinance proves to be invalid, unlawful, or unconstitutional it shall not be held to invalidate or
impair the validity, force or effect of any other section or portion of a section or subsection or
part of this Ordinance.
SECITON IV: That all ordinances or parts of ordinances in conflict herewith are
hereby repealed to the extent of said conflict.
SECTION V: This ordinance shall take effect upon passage and adoption
