REQUEST: General Services Department (Land Management Division) Requests approval of
Public Safety Complex bids.
PURPOSE: The purpose of this Board item is to award the bid for construction of the Public
Safety Complex and authorize the City Manager to enter into a contract with the
recommended bidder.
cONSIDERA nONS:
This item is being presented to the Commission in order to facilitate construction of the
Public Safety Complex.
August 22, 1994
- Contract signed with Architects Design Group to design the
Safety Complex and coordinate with Staff to achieve final
plans.
January 07, 1996
- Advertised for bid in "Orlando Sentinel".
February 07, 1996
- Bid Opening
The Staffwill meet with Architects Design Group on February 12, 1996 to review the bids
and reach a decision on a possible contractor. If this cannot be accomplished on this
date, this item will be tabled/pulled from the agenda and rescheduled for the next
Commission meeting.

FUNDING:
Estimated cost of the building was $1,500,000,00 to be funded from the 1993
Improvement Revenue Refunding Bond proceeds.
Approximately $1,900,000.00 is available for construction, furnishings, design and
permitting fees.

Architectural estimates for construction and design fees are $2,112,000.00.
Final costs in recommended funding will be presented at the Board meeting of February
12, 1996, or if necessary February 26, 1996.
RECOMMENDATION:
To be provided at the Board meeting.
IMPLEMENTATION SCHEDULE:
Three-Hundred Fifteen (315) days from authorization to proceed (estimated completion
date is January 24, 1997).

REQUEST: City Manager Requesting the Commission to find Bid Protest of Gel Contractor's
Inc. to be invalid
PURPOSE: The purpose of this Board item is to have the Board consider the facts regarding
its Bid Protest of Gel General Contractor lnc for the Public Safety Building.
cONSIDERA TIONS:
A. On February 12, 1996 the City Manager received a formal bid protest from
Gel General Contractors, Inc, regarding the Public Safety Building Bid
COMPLAINT 1:
The low bidder did not return plans and specifications with the bid as stated in the
bid documents.
FINDING: Section 5.3.1 of the bid documents provides that the Owner (City) reserves
the right to waive minor irregularities of this type. The City is choosing to waive this
minor irregularity.
CONCLUSION: The City is within its rights to waive minor bid irregularities of
this type,

COMPLAINT 2:
The Contractor states that he was given an instruction to provide structural
improvements beyond those contained in the bid documents, that his bid was
based upon these instructions resulting in him having a bid higher than other
bidders.
lFINDING: Section 1.3 AlA Document A701 of the Bid Documents provides that
changes to bid specifications will be made by written addendum. According to the
Structural Engineer the Contractor contacted him regarding concerns he had regarding
the need for additional concrete beams and reinforcing steel. The structural engineer did
not issue an addendum requiring a change in structural components of the building as a
result of the discussions with the Contractor due to the fact that he (the structural
engineer) does not believe the additions prepared by the Contractor are needed to make
his design functional or to meet Code requirements. The structural engineer states that
he did not instruct the Contractor to make any changes to the structural arrangements of
the building beyond those contained in the bid documents.
CONCLUSIONS: A written addendum to the bid specifications was not issued
regarding this matter. The General Contractor of his own volition applied construction
methods and materials beyond those needed to meet the minimum requirements of
the bid documents,
RECOMMENDATION: Based upon the facts provided in this matter it is recommended that
the City Commission find Gel General Contractor's Inc. bid protest to be invalid,

GCl/GENERAL CONSTRUCTORS, INC. is filing a protest to the bid on the above referenced project based on
the following two items:
]. The apparent low bidder did not return the plans and specifications as called for in the bid documents:
2. GCI received information from the strUctural engineer regarding the need for additional concrete
beams and reinforcing over the entire project which is an extremely high dollar item. To the best of
GCI's knowledge, this information was not issued in the form of an addenda nor were any of the other
bidders recipients of this information.
Furthermore, GCI respectfully requests permission to review the bids on this project. GCI is concerned about the
apparent low bidders pricing as their submitted bid is below GCl's raw cost on this project prior to General
Conditions, Overhead and Profit. Additionally, Gel wishes to verify that all bidders included pricing for the Air
Quality Control.

In reference to your letter of 9 Feb 96, which identifies your intent to protest the bid of the above
referenced project. We offer the following responses to the items cited.

The apparent low bidder did not return the plans and specifications as called for in bid
documents.

5.3.1 It is the intent of the Owner to award a Contract to the lowest responsible
Bidder provided the Bid has been submitted in accordance with the
re{}uirements of the Bidding Documents and does not excee.d the funds
available. The Owner shall have the right to waive informalities or
irregularities in a Bid re~ived and to accept the Bid which, in the Owner's
judgement. is ,in the Owner's own best inte.rests.
It is our intent to recommend to Ihe Owner to waive this minor irregularity.

Gcr received information from the structural engineer regarding the need for additional
concrete beams and reinforcing over the entire project which is an extremely high dollar
item. To the best of Gel's knowledge, this information was not issued in the fonn of an
addenda nor were any of the other bidders recipients of this information.
Response; Contained in the Contract Documents (Specifications) is AlA Document A 701
"Instructions to Bidders" see 1.1, 1.2, 1.3, and 2.1.4
1.1 Bidding Documents include the Bidding Requirements and the proposed
Contract Documents. The Bidding Requirements consist of the Advertisement
or Invitation to Bid, Instructions to Bidders, Supplementary lnstructions to
Bidders, the bid form, and other sample bidding and contract forms. The
proposed Contract Document,; consists of the form of Agreement between the
Owner and Contractor, Conditions of the Contract (General, Supplementary and
other Conditions), Drawings, Specifications and all Addenda is~ued prior to
execution of the Contract.
1.2 Definitions set forth in the General Conditions of the Contract for Construction,
AlA Document A20I, or in other Contract documents are applicable to the
Bidding Documents.
1.3 Addenda are written or graphic instruments issued by the Architect prior to the
execution of the Contract which modify or interpret the Bidding Documents by
additions, deletions, clarifications or corrections.

Inasmuch as this information was not issued as an adde,ndum, it is not to be construed as
a part of the Bidding Documents.
In closing, you can pursue your request to review the Bids as submitted with the City of Winter Springs.
The Bids are public record and available upon your request. We remind you, however, that the Bid
Proposals are Lump Sum and there is no schedule of values or breakdown of specific disciplines and/or
items. Further, we recommend G.C.I. reconsider pursuit of a protest to the bid.

Dear Mr. Frank:
GCI/GENERAL CONSTRUCTORS. INC. is in receipt of your letter of February 9, 1996 with respect to the
above referenced project and wishes to infom you that it will pursue protesting the bid and that it takes objection
to your responses.
You state that failure to turn in the plans and specifications with the hid was a nUnor irregularity. In GCl's
opinion, this is a major item. You must realize that those bidders who complied with tJUs rc.quirement were at a
distinct disadvantage from those who kept the documents as the complying bidders were without any plans and
specifications for an hour or mote prior to the bid. Surely you are aware that the major trades (HV AC, Electrical,
Plumbing, etc.) generally submit bids at the last minute and arc calling with questions up Wltil that time. It is
extremely difficult to do this without the bid docwnenlS. Thl;1'efore, Gel objects to your calling this item "a minor
irregularity!' IfturnJng in the bid documents was unnecessary, it should have been so stated in an adde~~um. ~,
Gel also takes objection to your response to tho structural issue. Approximately tlfty-\36) pages of addenda were
lS$ued on thJs project in an effort to clarifY the bidding documents and still GCI fOWld it neccssary to contact the
structural engineer for f\u'thcr clarification as instructed by you prior to the bid, How could Gel have omitted the
jnformation it received from your structural engineer from its bid, possibly have come in low and then built a
structurally inadequate project?? Who would accept liability for this?? Or should Gel have bid the project
blatantly ignoring this information and subsequently expect a Contract Change Order from the Owner duo to the
onUs sian of this structural information on the plans??

GCI docs not wish to foster an antagonistic attitude towards anyone working on this project; however, given the
time and money expended in putting together a quality bid package, Gel does want to have the opportunity as
everyone else bidding these projects. That is. to be able to bid fairly and competitively within the: constraints called
for in the bidding documonts. In Gel's opinion, the circumstances surroWlding this bid were not exactly fair and
competitive:. Gel will govern itself accordingly. Please comlder t.his letter as GCl's formal protest to this bid.

approval to award Bid for Public Safety Complex,
PURPOSE: The purpose of this Board item is to award the bid for construction of the Public
Safety Complex to Southland Building Contractors, P,O. Box 915304, Longwood,
Florida 32779-5304, in the amount of one million eight-hundred thirty-one thousand
three- hundred forty-four ($1,831,344.00) dollars, (this figure includes base bid and
all three (3) Alternates - 3,000 square foot shell, landscaping and irrigation system).
This Board item also requests the Commission to authorize the City Manger to
enter into this contract with Southland Building Contractors, and authorize the City
Manager five (5) percent of the contract contingency fund for unforeseen
circumstances,

- Bids opened. Apparent low bidder is Castle Design and
Construction, Inc.
- Castle Design & Construction filed a letter with Architects
Design Group requesting to be relieved from bid without penalty
because of a calculation error of $65,000,00. According to the
Bid Bond submitted, the City could call on this in the amount of
$49,144.00, provided Castle would not honor the contract.
However, Castle states they will honor the contract if the City
intends to call upon the Bond,

- Architects Design Group letter to City addressing Castle Design
letter recommending that Castle be released from the bid,
- City Manager, Commissioner McLeod and Staff met with M,
Frank of Architects Design Group. It was recommended that
relief without penalty be granted to Castle Design and that, the
next low bidder, SoutWand Building Contractors be awarded the
bid in the amount of$1,831,344.00. The City Manager requests
that he be granted a five (5) percent contingency fund of
$91,567.00 to address unforeseen circumstances during
construction.
NOTE: The Building Official will serve as the on-site coordinator and inspector for the
project. This action will realize in substantial savings to the City,
FUNDING:
The recommended bid of $1,831,344.00 is $331,344,00 over the original estimate
of$I,500,00.00,
No additional architectural and engineering design fees are required to cover the
additional cost.
Funding is available from 1993 Refunding Bond Proceeds and the Police and Fire

Dear Mr. Frank,
Upon examination of my estimator's bid package for the above ref~renced
project, I have discovered a mathematical e~ror in calculating the site work
p~ckage in the amount of $65,55~. Specifically, when he tallied up the
total after a spread sheet ~~as developed, he went back to the original bid
and omitted the figures on the back page. I am enclosi,ng copies for your
inspection.
Therefore, we are requesting to be relieved from our bid without penality.

Items Discussed:
David came to our office and hand delivered a letter {see attachment} requesting to be relieved from his bid
without penalty. David cited a math error in excess of $65,000.00 in the site package as his reason to be released.
David stated he would not forfeit his bid bond, and if not excused from his bid be would "nickel and dime the
projeclto death trying to creatively find ways to make up the difference". Keith said he understood his dilemma
and would recommend to the City to go with the 2nd apparenllow bidder and excuse Castle Design from their bid
without forfeiture of the bid bond. We felt it would be in the best interest of the project to review the proposal
from the second apparent qualified low bidder and recommend negotiating with that General COnlractor.
