AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF WINTER SPRINGS, FLORIDA, CHANGING THE LAND
USE DESIGNATION OF THE FUTURE LAND USE MAP OF
THE CITY'S COMPREHENSIVE PLAN THROUGH THE
SMALL SCALE AMENDl\.1ENT PROCESS ON CERTAIN
PROPERTY ON THE EAST SIDE OF THE WINTER SPRlNGS
GOLF CLUB BUILDING AND ADJACENT TO THE 9TH
GREEN OF THE GOLF COURSE; PROVIDING FOR
SEVERABILITY AND AN EFFECTIVE DATE.
WHEREAS, Chapter 166, Florida Statutes, empower the City Commission of the
City of Winter Springs to prepare and enforce comprehensive plans for the development of the
City; and
WHEREAS, Section 163.3161, Florida Statutes, the Local Government
Comprehensive Planning and Land Development Regulations Act, empowers and requires the
City Commission of the City of Winter Springs to (a) plan for the City's future development and
growth; (b) adopt and amend the Comprehensive Plan or elements or portions thereof;'
WHEREAS, the City Administration for the City of Winter Springs has received a
request from Dan Wood, representative for Winter Springs Partners (db a Winter Springs Golf
Club and Deutchmark Golf Properties), to change the Future Land Use designation ofa .244 acre
parcel (parcel B) from "Recreation (Conservation Easement)" to "Commercial"; and
WHEREAS, the City Commission of the City of Winter Springs by Ordinance No.
156 duly designated the Planning and Zoning Board as the Local Planning Agency for the
incorporated area of the City of Winter Springs; and
WHEREAS, The Local Planning agency of the City of Winter Springs has held a
duly advertised public hearing on November 9, 1995 on the request of Dan Wood, representative
for 'Winter Springs Partners (dba Winter Springs Golf Club and Deutchmark Golf Properties) and

made recommendation to the City Cominission that the Future Land Use Map be amended
through the Small Scale Amendment Process to change the designation of .244 acres from

"Recreation (Conservation Easement)" to "Commercial"; and
WHEREAS, 163.3187(1)(c)1. Florida Statutes allows, among other requirements,
that a comprehensive plan amendment directly related to proposed small scale development
activities that involve, among other considerations, a residential land use of 10 acres or less and a
density of 10 units per acre or less or involve other land use categories, singularly or in
combination with residential use of 10 acres or less;
NOW, THEREFORE, BE IT ORDAINED,' that the City
Commission of the City of Winter Springs, Florida, changes the
designation of .244 acres on the Future Land Use Map of the
Comprehensive Plan, adopted April 27, 1992, from "Recreation
(conservation Easement)" to "Commercial".
SECTION I - If any provision or portion of this ordinance is declared by any court
of competent jurisdiction to be void, unconstitutional, or unenforceable, then all remaining
provisions and portions of this ordinance shall remain in full force and effect.
SECTION II - This Ordinance shall take effect immediately upon its passage and
adoption.
