AN ORDINANCE OF THE CITY OF WINTER SPRINGS,
SEMINOLE COUNTY, FLORIDA, RELATING TO
COMPREHENSIVE PLANNING; SETTING FORTH AND
ADOPTING A LARGE SCALE COMPREHENSIVE PLAN
TEXT AMENDMENT, REFERENCED AS LG-CPA-07-03,
WHICH SHALL AMEND THE COMPREHENSIVE PLAN
RELEV ANT TO THE FUTURE LAND USE ELEMENT;
CREATING POLICY 1.8.4 ESTABLISHING AN EASTERN
ANNEXATION BOUNDARY COMMENCING ON THE
SOUTHERN BOUNDARY OF THE SHORES OF LAKE JESUP
AND RUNNING SOUTHWARD ALONG THE EASTERN
MOST BOUNDARY OF THE DELEON STREET RIGHT OF
WAY AND TERMINATING ON THE NORTHERN MOST
BOUNDARY OF THE CITY OF OVIEDO, BEYOND WHICH
THE CITY SHALL NOT PROCESS VOLUNTARY OR
INVOLUNTARY ANNEXATIONS; PROVIDING FOR
TRANS MITT AL OF THE PLAN TO THE DEPARTMENT OF
COMMUNITY AFFAIRS; PROVIDING FOR REPEAL OF
PRIOR INCONSISTENT ORDINANCES AND
RESOLUTIONS; SEVERABILITY; AND AN EFFECTIVE
DATE.
WHEREAS, section 163.3161 et. seq., Florida Statutes, established the Local Government
Comprehensive Planning and Land Development Regulation Act; and
WHEREAS, section 163.3167, Florida Statutes, requires each municipality in the State of
Florida to prepare and adopt a Comprehensive Plan as scheduled by the Florida Department of
Community Affairs; and
WHEREAS, on May 22, 2006, the City Commission adopted Ordinance 2006-02,
establishing a formal policy ofthe City not to annex any real property located East of an imaginary
line commencing on the Southern boundary of the shores of Lake Jesup and running Southward
along the Eastern most boundary of the DeLeon Street right-of way and terminating at the Northern
most boundary of the City of Oviedo; and
WHEREAS, the City desires to amend its Comprehensive Plan consistent with the formal
policy; and
WHEREAS, the Local Planning Agency of the City of Winter Springs held a duly noticed

public hearing, in accordance with the procedures in chapter 163, Florida Statutes, on the proposed
Comprehensive Plan amendments and considered findings and advice of staff, citizens, and all
interested parties submitting written and oral comments and has recommended adoption to the City
Commission; and
WHEREAS, the adoption ofthis Comprehensive Plan Text Amendment, is consistent with
the Goals, Objectives and Policies of the City's adopted Comprehensive Plan; and
WHEREAS, the Comprehensive Plan amendments adopted by this Ordinance comply with
th(~ requirements of the Local Government Comprehensive Planning and Land Development
Regulation Act and the amendments are in the best interests ofthe public health, safety, and welfare
of the citizens of Winter Springs, Florida.
NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF WINTER
SPRINGS, HEREBY ORDAINS AS FOLLOWS:
Section 1. Recitals. The foregoing recitals are true and correct and are fully
incorporated herein by this reference.
Section 2. Authority. This Ordinance is adopted in compliance with, and pursuant
to, the Local Government Comprehensive Planning and Land Development Regulations Act,
sections 163.3184 and 163.3187, Florida Statutes.
Section 3. Purpose and Intent. It is hereby declared to be the purpose and intent of this
Ordinance to clarify, expand, correct, update, modify and otherwise further the provisions ofthe City
of\Vinter Springs' Comprehensive Plan.
Section 4. Adoption of Amendments to Comprehensive Plan, Future Land Use
Ekment. The City of Winter Springs Comprehensive Plan, Future Land Use Element, is hereby
amended as follows tJnderlined type indicates additions and stI ikeont type indicates deletions, while
asterisks (***) indicate a deletion of text from the Comprehensive Plan, Future Land Use Element.
It is intended that the text denoted by the asterisks shall remain unchanged from the language
existing prior to adoption of this Ordinance):

D. GOALS, OBJECTIVES AND POLICIES
GOAL 1: Quality of Life. To effectively manage the land use pattern in the City to enhance the
qualify 0 f life for its citizens; promote economic vitality; and, accommodate population and
development growth in an environmentally acceptable manner.

Objective 1.8: Annexation. The City shall pursue a policy of annexation which wi 1\
provide for the most efficient use of public facilities and services, eliminate areas of
jurisdictional problems, and provide for sound growth and development of the City and
surrounding area.

Policy 1.8.4: The City shall not process any voluntary annexation petitions received
from property owners. nor shall the City initiate any involuntary annexation
procedure. involving any real property that is located east of an imaginary straight
line which commences on the southern boundary of the shores of Lake Jesup and
runs southward along the easternmost boundaryofthe Deleon Street right-of-way and
which terminates on the northern most boundary of the City of Oviedo.

Section 5. Repeal of Prior Inconsistent Ordinances and Resolutions . All prior
inconsistent ordinances and resolutions adopted by the City Commission, or parts of ordinances and
resolutions in conflict herewith, are hereby repealed to the extent ofthe conflict.
Section 6. Severability. If any section, subsection, sentence, clause, phrase, word or
provision of this Ordinance is for any reason held invalid or unconstitutional by any court of
. competent jurisdiction, whether for substantive, procedural, or any other reason, such portion shall
be deemed a separate, distinct and independent provision, and such holding shaH not affect the
validity of the remaining portions of this ordinance.
Section 7. Incorporation into Comprehensive Plan. Upon the effective date of the
Comprehensive Plan Amendments adopted by this ordinance, said Amendments shall be
incorporated into the City of Winter Springs Comprehensive Plan and any section or paragraph
number or letter and any heading may be changed or modified as necessary to effectuate the
foregoing.
Section 8. Effective Date and Legal Status of the Plan Amendments. The effective
date of the Comprehensive Plan Amendments adopted by this Ordinance shall be the date a final
order is issued by the Florida Department of Community Affairs, or the Administration Commission
findmg the Amendments in compliance with section 163.3184, Florida Statutes. No development
orders, development permits, or land use dependent on these Amendments may be issued or
commenced before the amendments become effective. If a final order of noncompliance is issued
. by the Administration Commission, the Amendments may nevertheless be made effective by
adoption of a resolution affirming its effective status. After and from the effective date of these
Ammdments, the Comprehensive Plan Amendments set forth herein shall amend the City of Winter
Sprmgs Comprehensive Plan and become a part of that plan and the Amendments shall have the
City of Winter Springs

legal status of the City of Winter Springs Comprehensive Plan, as amended.
ADOPTED by the City Commission of the City of Winter Springs, Florida, in a regular
meeting assembled on the 22nd day of January ,2007.

Dear Mayor Bush:
The Department of Community Affairs has completed its review of the Comprehensive
Plan Amendment for the City of Winter Springs (DCA 07-1) adopted on January 22,2007, by
Ordinance Number 2006-15. The Department has determined that the amendment meets the
requirements of Chapter 163, Part II, Florida Statutes (F.S.). The Department is issuing a Notice
of Intent to find the plan amendment "in compliance." The Notice ofIntent has been sent to the
Orlando Sentinel, Seminole County Edition, for publication on March 14, 2007.
The Department's Notice ofIntent to find a plan amendment "in compliance" shall be
deemed to be a final order if no timely petition challenging the amendment is filed. Any affected
person may file a petition with the agency within 21 days after the publication of the Notice of
Intent pursuant to Section 163.3184(9), F.S. No development orders, or permits for a
development, dependent on the amendment may be issued or commence before the plan
amendment takes effect. Please be advised that Section 163.3184(8)(c)2, F.S., requires that a
local government having an Internet site should post a copy ofthe Department's Notice of Intent
on the Internet within 5 days following receipt of the mailed copy of the agency's Notice of
Intent.
Please note that a copy ofthe adopted City of Winter Springs' Comprehensive Plan
Amendment 07-1 and the Notice of Intent must be available for public inspection Monday
through Friday, except for legal holidays, during normal business hours, at the City Hall, City
Clerk's Office, 1126 East State Road 434, Winter Springs, FL 32708.
If an affected person challenges this "in compliance" determination, you will have the
option of mediation pursuant to Subsection 163.3189(3)(a), F.S. If you choose to attempt to
resolve this matter through mediation, you must file the request for mediation with the
administrative law judge assigned by the Division of Administrative Hearings. The choice of
mediation will not affect the right of any party to an administrative hearing.

The Department gives notice of its intent to find the Amendment to the Comprehensive Plan for
the City of Winter Springs, adopted by Ordinance No. 2006-15 on January 22,2007, m COMPLIANCE,
pursuant to Sections 163.3184, 163.3187 and 163.3189, F.S.
The adopted City of Winter Springs Comprehensive Plan Amendment and the Department's
Objections, Recommendations and Comments Report, (if any), are available for public inspection Monday
through Friday, except for legal holidays, during normal business hours, at the City of Winter Springs City
Hall, City Clerk's Office, 1126 East State Road 434, Winter Springs, Florida 32708-2799.
Any affected person, as defined in Section 163.3184, F.S., has a right to petition for an admin-
istrative hearing to challenge the proposed agency determination that the Amendment to the City of Winter
Springs Comprehensive Plan is In Compliance, as defined in Subsection 163.3184(1), F.S. The petition
must be filed within twenty-one (21) days after publication of this notice, and must include all of the in-
formation and contents described in Uniform Rule 28-106.201, F.A.C. The petition must be filed with the
Agency Clerk, Department of Community Affairs, 2555 Shumard Oak Boulevard, Tallahassee, Florida
32399-2100, and a copy mailed or delivered to the local government. Failure to timely file a petition shall
constitute a waiver of any right to request an administrative proceeding as a petitioner under Sections
120.569 and 120.57, F.S. If a petition is filed, the purpose of the administrative hearing will be to present
evidence and testimony and forward a recommended order to the Department. If no petition is filed, this
Notice of Intent shall become final agency action.
If a petition is filed, other affected persons may petition for leave to intervene in the procPP1i1ng.
A petition for intervention must be filed at least twenty (20) days before the final hearing and must include
all of the information and contents described in Uniform Rule 28-106.205, F.A.C. A petition for leave to
intervene shall be filed at the Division of Administrative Hearings, Department of Management Services,
1230 Apa1achee Parkway, Tallahassee, Florida 32399-3060. Failure to petition to intervene within the
allowed time frame constitutes a waiver of any right such a person has to request a hearing under Sections
120.569 and 120.57, F.S., or to participate in the administrative hearing.
After an administrative hearing petition is timely filed, mediation is available pursuant to Sub-
section 163.3189(3)(a), F.S., to any affected person who is made a party to the proceeding by filing that
request with the administrative law judge assigned by the Division of Administrative Hearings. The choice
of mediation shall not affect a party's right to an administrative hearing.
