RESOLUTION NO. 2003-10
A RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, FLORIDA, AMENDING
RESOLUTION NO. 728, CORRECTING A SCRIVENER'S
ERROR REGARDING THE LOT IDENTIFICA TION
NUMBERS OF THREE (3) PARCELS OF LAND (LOTS 17,
17 A, AND 18) LOCATED AT NORTH ORLANDO RANCHES,
SECTION 2, RECORDED IN PLAT BOOK 12, PAGE 12,
PUBLIC RECORDS OF SEMINOLE COUNTY, FLORIDA;
PROVIDING FOR SEVERABILITY; PROVIDING FOR
RECORDING IN THE PUBLIC RECORDS OF SEMINOLE
COUNTY, FLORIDA; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of Winter Springs, Florida, ("City
Commission") adopted Resolution No, 728 on January 10, 1994, approving the subdivision of two
(2) platted lots into no more than three (3) parcels or lots; and
WHEREAS, upon adoption of Resolution No, 728, the City Commission recorded the
resolution in the Public Records of Seminole County, Florida; and
WHEREAS, Resolution No, 728 contained as exhibits surveys of the subdivided lots and
identified the lot numbers as Lots 17, 17 A, and 18; and
WHEREAS, the Property Appraiser of Seminole County, Florida ("Property Appraiser"),
erroneously identified Lot 17 as Lot 17 A and Lot 17 A as Lot 17 when creating the new parcel
identification numbers for the subdivided lots; and
WHEREAS, the lot numbers contained in Resolution No, 728 and the parcel identification
numbers provided by the Property Appraiser are currently inconsistent and the inconsistency is
causing confusion; and
WHEREAS, the Property Appraiser's Office has informed City staff that they are unwilling
to change the parcel identification numbers for the subject lots; and
WHEREAS, the City Commission deems it to be in the best interests of the public health,
safety, and welfare of the citizens of the City and the owners of the subject subdivided lots to correct
this inconsistency in order to eliminate the existing confusion and to avoid potential title problems
involving the subject subdivided lots,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, SEMINOLE COUNTY, FLORIDA, AS FOLLOWS:

Section 1. RECITALS. The foregoing recitals are affirmed and incorporated as part of this
Resolution.
Section 2. AMENDMENT OF RESOLUTION NO. 728. For purposes of providing
consistency with the parcel identification numbers provided by the Property Appraiser, the lot
identification numbers contained in Resolution No, 728 are hereby amended as follows:
A. Lot 17, identified on Exhibit "A" of Resolution No, 728, shall hereby be
referred to as Lot 17 A.
B. Lot 17 A, identified on Exhibit "B" of Resolution No, 728, shall hereby be
referred to as Lot 17,
Section 3. RECORDA TION. The City Clerk is hereby directed to record this Resolution in
the Public Records of Seminole County, Florida.
Section 4. SEVERABILITY. If any section, clause, phrase, word, or provision of this
Resolution is for any reason held invalid or unconstitutional by a court of competent jurisdiction,
whether for substantive or procedural reasons, such portion shall be deemed a separate, distinct, and
independent provision, and such holding shall not affect the validity of the remaining portions of this
Resolution,
Section 5. EFFECTIVE DATE. This Resolution shall become effective immediately upon
passage by the City Commission and pursuant to the City Charter. _ _ _ _., , " \\ . , . , ,
DONE AND ADOPTED in regular session of the City Commission of the City of Winter
