RESOLUTION NO. 2001-09
A RESOLUTION OF THE CITY COMMISSION OF WINTER
SPRINGS DECLARING AN EMERGENCY WATER SHORTAGE
CONDITION AND IMPLEMENTING THE RESTRICTIONS
DEFINED HEREIN; PROVIDING FOR REPEAL OF PRIOR
INCONSISTENT RESOLUTIONS; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City of Winter Springs has received below average rainfall
for the last two years resulting in significantly lower groundwater levels; and
WHEREAS, conditions are such that there is a possibility that insufficient
good quality water will be available to meet user demands and a reduction in total water
use within the area is necessary to protect water resources from serious harm; and
WHEREAS, City Ordinance #2001-11, Section 19-203, authorized the
implementation of water restrictions by adoption of a resolution; and
WHEREAS, the St. Johns River Water Management District issued an Order
Declaring A Severe Water Shortage effective January 15, 2001; and
WHEREAS, Chapter 40C-21, Florida Administrative Code is the SJRWMD's
Water Shortage Plan; and
WHEREAS, the SJRWMD imposed Phase II Severe Water Shortage
Restrictions in accordance with 40C-21 ,631 , F,AC, as part of the Order;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
WINTER SPRINGS, FLORIDA, AS FOLLOWS:
SECTION I - The City Commission of the City of Winter Springs hereby
declares that an emergency water shortage condition exists affecting Winter Springs said
emergency and the water restrictions set forth hereunder shall continue in full force and
effect until such time the City Commission adopts a resolution declaring the emergency
has ceased to exist.
SECTION II - Landscape irrigation for all water sources, including reclaimed
water, is limited to two days per week and shall not occur between the hours of 10:00 AM,
and 4:00 P,M, Irrigation of existing landscape with even or no addresses is only allowed

on Thursday and Sunday; odd addresses are limited to Wednesday and Saturday, New
landscape is authorized to be irrigated on any day between the hours of 4:00 P,M, and
10:00 AM, during the first 60 days following its installation, Reclaimed usage by golf
courses and public parks shall be voluntarily reduced and exempt from these provisions,
Personal vehicle washing and hand watering are permitted using a handheld hose
equipped with an automatic shut off nozzle, Agricultural, nursery, and commercial car
washing restrictions are in accordance with F.AC, 40C-21-631 - Phase II Severe Water
Shortage, a copy of which is attached hereto and fully incorporated herein by this
reference,
SECTION III - The water restrictions set forth hereunder shall be enforced
by the City as provided for in Ordinance #2001-11,
SECTION IV - All prior inconsistent resolutions of the City Commission are
hereby repealed in their entirety to the extent of the conflict with this resolution,
SECTION V - This Resolution shall take effect immediately upon adoption by
the City Commission,

40C-21.631 Phase IT Severe Water Shortage. The following restrictions shall apply when a
Phase II water shortage is declared by the District.
(1) Essential/Domestic/Utility /Commercial
(a) Essential Use
1. The use of water for firefighting, and health or medical purposes will not be
restricted.
2.Fire hydrant flushing will be undfftaken only on an emergency basis.
3.Sanitary sewer line flushing and testing will not be restricted except on a voluntary
(b)Household and Domestic Type Use
1. Residential type domestic use should be voluntarily reduced to 50 gallons per person

2, Domestic type use in industrial and commercial establishments should be voluntarily
reduced,
(c) Water Utility Use
1. Initial pressure at the point of use (meter) will be reduced by 15% where it is
op erationally feasible to do so. Prior to the reduction of pressure, the utility will notify the
appropriate fIre-fighting agencies and make arrangements for direct commmication when additional
pressure is required.
2. New water line flushing and disinfection will be restricted to the hours of 9:00 p.m.
to 7:00 a.m. sevm days per week
3. As appropriate the utility should institute additional voltmtary conservation
measures such as reclaiming of backwash water, improving and accelerating leak detection surveys
and repair progams, installing and calibrating meters, and stabilizing and equalizing system
pressures.
(d) Power Production Use
Water used for power production should be vohmtarily reduced.
(e) Commercial and Industrial Process Use
1. Commercial car washes will be restricted as follows:
a. for washes servicing passenger vehicles and mobile equipment weighing less than 10,000
pounds,
i. use in excess of 75 gallons per wash will be prohibited and
ii. use equal to or less than 75 gallons per wash should be voluntarily reduced;
b. for washes servicing mobile equipment wei!ping 10,000 pounds or more,
i. use in excess of 150 gallons per wash will be prohibited and
Hi. use equal to or less than 150 gallons per wash should be voluntarily reduced.
~, 2. Watff use for cOI11Irercial and industrial proresses should be voluntarily reduced.
(2) Agriculture
(a) Agricultural Use
1. Overhead irrigation, including portable volume guns, will be restricted to the hours of
2:00 p.m. to 10:00 a.m.
2. Low volume irrigation hours will not be restricted.
3. Flood and seepage irrigation will not dismarge tailwaters from the property.
4. All irrigation systems will be operated in a manner that will maximize the percmtage
of water withdrawn and held whim is plared in the root zone of the crop and will minimize the
amOlmt of water which is withdrawn and released or lost to the user but is not immooiately available
for other users.
5. Users having access to more than one source class will maximize the use of the lesser
or least restricted source class.
(b) Livestock Use
Livestock water use should be voluntarily reduced.
(c) Agricultural Use
Aqricultural water use should be voluntarily reduced.
(d) Soil Flooding
1. Soil flooding for pest control or soil preservation will be prohibited.
2. Soil flooding to permit harvestingof sod should be voluntarily reduced,
(e) Freeze Protection
Water use for freeze protection will be restricted to situations in whidl official weather
forecastingservices predict temperatures likdy to cause permanent damage to crops and when the
wet bulb temperature drops to 43 Fahrenheit or lower,
(3) NurserylLandscape IrrigationiRecreaion
(a) Nursery Use
1. Low volrnne irrigation uses and low volrnne hand watering should be voltmtarily
red uced.
2. Oved1ead irrigation uses will be restricted as follows:
a. insne - 8:00 a.m. to 8:00 p.m., sevm days perweek
b. outside - 7:00 p.m. to 7:00 a.m., on odd numbered days.
3. Flood irrigation systems will be restricted to 6 days per month.
4. Applications of fertilizers, herbicides and pesticides should be coordinated with
irrigation schErlules.
(b) Landscape irrigation - New Installation
1. For installations whim have been in place for less than 30 days and
a. less than 5 acres in size, water use for irrigation shall be restricted to the hours of 2:00 a.m.
to 8:00 a.m., Monday, Wednesday and Friday,
b. 5 acres or greater in size, water use for irrigation shall be restricted to the hours of
12:01 a.m. to 8:00 a.m., Monday, Wednesday, Thursday and Friday.
2. Low volrnne hand watering of new landscapingshould be voltmtarily reduced.
3. Cle<ning and adjusting of new irrigation systems will be restricted to 10 minutes per
zone on a one time basis.
(c) Landscape Irrigation - Existing Installation
Ac 1. For existing installations less than 5 acres in size, water use for irrigation will be
restricted to the hours of 4:00 a.m, to 8:00 a.m., two days per week
a. Installations with odd addresses will be permitted to irrigate on Wednesday and
Sat urday .
b. Installations with even addresses or no address will be permitted to irrigate on
Thursday and Sunday.
2. For existing installations 5 acres or greaer in size, water use for irrigation will be
restricted to the hours of 12:01 a.m. to 8:00 a.m., two days per week
a. Installations with odd addresses will be permitted to irrigate on Wednesday and
Saturday.
b. Installations with even addresses or no address will be permitted to irrigate on
Thursday and Sunday.
3. Applications of fertilizers, herbicides and pesticides should be coordinated with
irrigation schedules.
(d) Recreation Area Use
Existing and new recreation area water use will be restricted as provided in paragraphs ( b)
and (c) respectively.
(e) Golf Course Use
1. Irrigation of grems and tees should be voltmtarily teduced and will be accomp lishro
during nondayHght hours,
2. Irrigation of fairways, roughs and nonplaying areas on the ftrst nine holes of the
course will be restricted to the hours of 12:01 a.m, to 8:00 a,m, on Wednesday and Saturday,
3. Irrigation of fairways, roughs. and nonplaying area; on the last nine holes of the
course will be restricted to the hours of 12:01 a.m, to 8:00 a,m. on Thursday and Sunday.
4. Applications of fertilizers. herbicides and pesticides should be coordinated with
irrigation schedules.
(f) Water Based Recreation Use
1. Water based recreation water use should be voluntarily reduced,
2. Draining of facilities into sewers or onto impervious surfaces will be prohibited.
3. Existing facilities will not be refilled except for makrup water.
(4) Miscellaneous
(a) Heating and Air Conditioning Use
1. The use of water for heating will be restricted to that amount of watff necessary to
maintain a maximum temperature of 68 degrees Fahrenheit.
2. The use of water for air conditioning will be restricted to that amount of watff
necessary to maintain a minimum temperature of 78 degrees Fahrenheit.
(b) Dewaering Use
Discharge of fresh water to tide from dewaeringwill be prohibited.
(c) Othff Outside Uses
1. Washing or cleaning streets. driveways, sidewalks, or other impErVious areas with
water will be prohibited.
2. Mobile equip ment washing with water will be restricted to the hours and days
prescribed for existing landscape irrigation in paragraph (3)(c) using only low vohnne methods.
3. Outside pressure cleaning will be restricted to only low voltnne methods, seven days
per week
(d) Divffsion and impoundment into non-District facilities water used for divffsion and
impoundment into non-District facilities should be vohmtarily reduced.
(e) Aesthetic Use
1. Outside aesthetic uses of water will be prohibited.
2. Inside aesthetic uses of water should be voluntarily reduced.
