RESOLUTION 879
AN RESOLUTION OF THE CITY COMMISSION OF THE
CITY OF WINTER SPRINGS, FLORIDA: FINDING THAT
THE AREA ON THE ATTACHED MAP WITHIN THE
CITY OF WINTER SPRINGS, FLORIDA, IS A
"BLIGHTED AREA" AS DEFINED IN 163.340(8)
FLORIDA STATUTES, AND THAT THE
REHABILITATION, CONSERVATION OR
REDEVELOPMENT, OR A COMBINATION THEREOF
OF SAID AREA IS NECESSARY IN THE INTEREST OF
THE PUBLIC HEALTH, SAFETY, MORALS AND
WELFARE OF THE RESIDENTS OF THE CITY;
DESIGNATING SAID AREA AS THE WINTER SPRINGS
TOWN CENTER COMMUNITY REDEVELOPMENT
AREA; FINDING THAT THERE IS A NEED FOR A
COMMUNITY REDEVELOPMENT AGENCY TO CARRY
OUT COMMUNITY REDEVELOPMENT WITHIN SAID
WINTER SPRINGS TOWN CENTER COMMUNITY
REDEVELOPMENT AREA.
WHEREAS, the Legislature of the State of Florida enacted the Community
Redevelopment Act of 1969, as amended~ and
WHEREAS, the City Commission of the City of Winter Springs finds the area
indicated on the attached map to this Resolution (879) meets the definitions and
requirements of the term "blight" as defined in 163.340(8) Florida Statutes, specifically
that there is a (1) Predominance of defective or inadequate street layout~ (2) Faulty lot
layout in relation to size, adequacy, accessibility or usefullness (3) Diversity of.
ownership and "all of (b)",
WHEREAS, the City Commission finds that this "blighted area", indicated on
the attached map to this Resolution, constitutes an economic liability imposing onerous
burdens which decrease the tax base and reduce tax revenues, and substantially impairs
or arrests sound growth; and
WHEREAS, The City Commission declares that the preservation or
enhancement of the tax base from which the City realizes tax revenues is essential to its
existence and financial health and that the preservation and enhancement of such tax
base is implicit in the purposes for which a taxing authority is established; that tax
increment financing is an effective method of achieving such preservation and
enhancement in such areas; and that community redevelopment in such "blighted areas"
when complete, will enhance such tax base and provide increased tax revenues; and
WHEREAS, the City Commission of the City of Winter Springs, Florida has
determined it to be in the best interests of the health, safety and welfare of the citizens of
Winter Springs, Florida to cause the creation of a Community Redevelopment Agency
to prepare a Community Redevelopment Plan to address the "blighted area" within the
City,

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA THAT:
1. The area in the attached map to this Resolution is hereby found and declared to
be a "blighted area" as defined in 163.340(8) Florida Statutes.
2. The area depicted in the attached map to this Resolution shall be known as the
Winter Springs Town Center Community Redevelopment Area.
3. The rehabilitation, conservation or redevelopment, or a combination thereof, of
such area is necessary in the interest of the public health, safety, morals and
welfare of the residents of the City of Winter Springs,
4. There is a need for a Community Redevelopment Agency to function in the City
to cany out the community redevelopment purposes of Chapter 163 Part III
Florida Statutes, in the area depicted in the map attached to this Resolution.
5. The City Commission declares itself to be the board of commissioners of the
Community Redevelopment Agency in accordance with 163.357(1)(a), (b), (c)
Florida Statutes.
6. The City staff or other designee shall prepare a Community Redevelopment Plan
in accordance with 163.360 Florida Statutes.
7. All prior resolutions in direct conflict with this resolution are superseded by this
resolution.

8. If any word, phrase, sentence, paragraph or section of this resolution is struck by
a court, the remainder of said resolution shall remain effective.
This Resolution for the City shall become effective immediately upon its adoption..
