RESOLUTION NO. 839
A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA,
PROVIDING FOR THE EXTENSION OF A WATER LINE TO
PROVIDE POTABLE WATER TO CERTAIN LOTS ADJACENT TO
AND WITHIN THE CITY OF WINTER SPRINGS, FLORIDA;
PROVIDING FOR NOTICE OF CITY'S INTENTION TO ESTABLISH
BY SUBSEQUENT ORDINANCE A SERVICE AVAILABILITY
CHARGE FOR PROPERTIES BENEFITED BY SAID
IMPROVEMENTS AND THE PROCEDURE THEREFORE TO
DEFRAY THE EXPENSE ASSOCIATED WITH SAID
IMPROVEMENTS; DESIGNATING THE PROPERTIES TO BE
CHARGED; DESIGNATING THE TOTAL ESTIMATED COST OF
THE IMPROVEMENT; PROVIDING FOR THE TIMING AND
SEQUENCING OF WHEN THE CHARGE WILL TAKE EFFECT
WHICH WILL RELATE TO WHEN THE PROPERTIES ANNEX INTO
THE CITY OF WINTER SPRINGS OR CONNECT TO THE WATER
LINE IF DIFFERENT; CONFLICTS AND AN EFFECTIVE DATE.
WHEREAS, the City of Winter Springs, Florida, has determined it to be in the
best interest of the City to provide for a public improvement to areas adjacent to and
within the City, but wholly within the City's designated service area, and that the nature
of said public improvement shall be providing potable water along Old Sanford/Oviedo
Road; and
WHEREAS, the area to be served by this improvement can not readily be served
by any other public water utility system; and
WHEREAS, the area to be served by the proposed potable water system
improvement is within the City or an enclave for annexation purposes pursuant to State
law; and
WHEREAS, it is the policy of the City of Winter Springs to require a property to
annex into the city as a condition of receiving City water service; and
WHEREAS, the City has adopted Resolution No. 828 declaring the area adjacent
to Old Sanford/Oviedo Road at Wade Street, north of the railroad tracks as part of the
City water service area as permitted by Chapter 180, Florida Statutes; and
WHEREAS, the City is desirous of establishing a servIce availability charge
applicable to the properties benefited by said public improvement to defray the
expenditure of monies for said improvement pursuant to the terms of Chapter 19 of the
City Code; and
WHEREAS, the construction firm of Master Site Development, Inc. has
submitted a bid for the construction costs of the extension of the water line on the street
to be improved; and
WHEREAS, the City has been made aware of the necessity of said improvement.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF WINTER SPRINGS, FLORIDA, AS FOLLOWS:
SECTION I - That there shall be a public improvement consisting of the extension
of the water lines to deliver potable water to property within and immediately adjacent to
the City of Winter Springs, Florida.
SECTION II - That there shall be established by ordinance a service availability
charge to the properties benefited by the aforementioned public improvements pursuant
to the terms of Chapter 19 of the City Code for the total cost of said public improvement
to defray the expense thereof.
SECTION III - The water line to be constructed is to serve properties along Old
Sanford/Oviedo Road and Wade Street north of the railroad tracks, which street right of
way is located within the City of Winter Springs, Florida.
SECTION IV - That the lands upon which the service availability charge shall be
levied are all of the lots and lands adjoining and contiguous or bounding and abutting
upon such improvements on Old Sanford/Oviedo Road and Wade Street north of the
railroad tracks and are specially benefited thereby, and further designated by the location
map hereinafter provided for.
SECTION V - The manner in which the aforementioned servIce availability
charge shall be calculated is based on the potential water usage and by the lineal front
foot of properties fronting Old Sanford/Oviedo Road and Wade Street north of the
railroad tracks and the "front" of said property shall be determined by the City
Commission of the City of Winter Springs, Florida.
SECTION VI - That the service availability charges provided for herein shall be
payable as provided in the ordinance to be adopted by the City establishing the actual
service availability charge pursuant to City Code. Said ordinance shall be adopted and
the actual service availability charge determined at the conclusion of the construction of
the improvements by the City Commission of the City of Winter Springs, Florida.
SECTION VII - That the total estimated cost of the public improvement provided
for herein is $86.995.00.
SECTION VIII - That there shall be on file with the City Clerk of the City of
Winter Springs, Florida, a property location map showing the area to be subject to the
service availability charge with plans and specifications and an estimate of the cost of the
proposed improvement which shall be open to the inspection of the public.
SECTION IX - This resolution shall remain in force until supplemented,
amended, repealed, or otherwise altered.
SECTION X - All resolutions or parts of resolutions In conflict with this
resolution are hereby repealed.
SECTION XI - This Resolution shall take immediate effect upon its passage and
approval.
