A RESOLUTION OF THE CITY OF WINTER SPRINGS, FLORIDA, DIRECTING
PREPARATION OF THE PRELIMINARY ASSESSMENT ROLL, ESTABLISHING
THE METHOD FOR COLLECTION OF THE ASSESSMENT, PROVIDING FOR
NOTICE OF THE MEETING FOR PUBLIC COMMENT ON AND ADOPTION OF
THE ASSESSMENT ROLL, ESTABLISHING THE BASIS FOR COMPUTATION
OF THE ASSESSMENT; PURSUANT TO ORDINANCE.: NO. 555, ESTABLISHING
A NON AD VALOREM ASSESSMENT ALLOWING FOR THE COLLECTION OF FEES
FOR MANDATORY SOLIDWASTE/RECYCLING/YARD TRASH COLLECTIONS;
PROVIDING FOR CONFLICTS; SEVERABILITY AND EFFECTIVE DATE.
NOW, THEREFORE, it is hereby resolved by the City Commission of the City
of Winter Springs, Florida, as follows:
SECTION I - That annual charges for the collection of fees for mandatory
solidwaste/recycling/yard trash shall be assessed against each residential lot
in the City of Winter Springs.
SECTION 2 - That the total cost of the annual assessment is
Said assessment is levied pursuant to the authority of Ordinance No. 555 of the
City of Winter Springs, Florida, an ordinance establishing a; non ad valorem
assessment allowing for the collection of fees for mandatory solidwaste/recycling
yard trash collections.
SECTION 3 - The charges so assessed shall be paid by an annual assessment,
which assessment shall continue from year to year unless amended by action of the
governing body, levied on each residential lot in the City of Winter Springs,
Florida, which assessments shall be collected by the Tax Collector of Seminole
County, Florida, in the manner provided by FS197.3632 and shall cast a lien upon
the real property so assessed.
SECTION 4 - That the City Clerk of the City of Winter Springs, Florida, be
and she is hereby directed and ordered to cause a copy of this resolution to be
published once a week for a period of two (2) weeks in a newspaper of general
circulation and published in Seminole County, Florida.
SECTION 5 - That the Director of Finance for the City of Winter Springs,
Florida, be and he is hereby ordered and directed to cause to be made a prelimin-
ary assessment roll, which assessment roll shall be completed and which roll shall
show the lots and lands assessed and the amount of the benefit to and the assess-
ment against each lot or parcel of land. Further, said assessment roll shall show
that the assessment is to be paid in one (1) annual payment reflected in the manner
provided for by FS197.3632.
SECTION 6 -That said assessment roll shall be prepared and filed with the
City Clerk of the city of Winter Springs, Florida on or before August 10, 1994.
That upon receipt of said filing, the City Clerk shall give notice to each person
whose names and lands appear on the assessment roll, that they may appear before
the City Commission of the City of Winter Springs, Florida, on September 12, 1994
at 7:30 p.m., or as soon thereafter as the matter be reached on the agenda, for the
purpose of being heard as to the propriety and advisability of the making of said
assessment, as to the manner of the payment therefore, and as to the amount thereof
to be assessed against each property so improved. Said notice shall be given in
writing on ,or before August 22, 1994 and proof of mailing shall be made by affidavit
of the CityC1erk. Said notice shall contain notice of the. time -.nd place of the
hearing and notice shall also be given by two (2) publications, a week apart, in a
newspaper of general circulation in the City of Winter Springs as published in
Seminole County, Florida, further provided that the second notice shall be published
not later than August 21, 1994.
That the assessment rolls for said charges, be and the same are hereby ratified,
approved, and adopted by the City Commission of the City of Winter Springs, Florida.
SECTION 7 - Conflicts: All ordinances or resolutions or parts of ordinances
or resolutions in conflict herewith are hereby repealed to the extent of any conflict.
SECTION 8 - Severability: If any section, sentence, phrase, word or portion of
this resolution is determined to be invalid, unlawful, or unconstitutional, said
determination shall not be held to invalidate or impair the validity, force or effect
of any other section, sentence, phrase, word, or portion of this Resolution not other-
wise determined to be invalid, unlawful, or unconstitutional.
SECTION 9 - Effective Date: This Resolution shall take effect immediately upon
passage and adoption.

NOTICE OF ADOPTION OF NON AD VALOREM
ASSESSMENT ROLL
PUBLIC BEARING TO BE HELD SEPTEMBER 12, 1994
Notice is hereby given that the City Commission of the City of Winter Springs,
Florida will conduct a public hearing to adopt a Non Ad Valorelll Assessment Roll,
pursuant to Section 197.3632, Florida Statutes on Sept. 12, 1994 at 7:30 p. m.
or as soon thereaftera. possible, at the Winter Springs City Hall, 1126 East
State Road 434, Winter Springs, Florida.
Below is a geographical depiction of the properties subject to levies of Non-Ad
Valorem Assessments for the first time.

Assessment Schedule
Pursuant to Ord. No. 555 which states the intent to use the uniform method for the
levy, collection and enforcement of Non-Ad Valorem Assessments as provided for by
Section 197.3632, Florida Statutes for the purpose of providing for the mandatory
collection of SolidWastelRecyclinglYard Trash levied pursuant to Ord. No. 555 for
1994 and each year thereafter until discontinued. The real property subject to
the levy are the properties described in the City Charter of the City of Winter
Springs, Florida.
.Persons are advised that, if they decide to appeal any decision made at this hearing,
they will need a record of the proceedings, and for such purpose, they may need to
insure that a verbatim record of the proceedings is made, which record includes the
testimony and evidence upon which the appeal is to be based.
As a property owner in the City you have the right to appear at this hearing and
file written objections with the City of Winter Springs within 20 days of this
publication. These assessments will appear on the tax bill you will receive in
November 1994, and will be collected by the Seminole County Tax Collector.

The purpose of the hearing is to adopt a Non-Ad Valorem Assessment Roll for
the purpose of providing for the mandatory collection of Solid Waste/Recycling/
Yard Trash.

As with all taxes, failure to pay the special assessment when due can result
in tax certificates and tax deeds being issued on the property and could result
in loss of title. Weare required to notify each property owner of this pro-
vision.

written objections with the local governing board within 20 days of the notice.
